A rash of roving-animal calls, combined with a shortage of Animal Control pickups, has prompted Police Chief Gary Smith to provide information to the public about how to call in animal reports and how those calls will be handled.
Animal Control officers continue to share one small pickup truck, while waiting for an insurance settlement that will enable the department to buy a replacement pickup and special box to equip it.
Smith said that the department’s new pickup has arrived to replace one demolished on March 4 in an accident in front of the BP station at West Sixth Avenue and Prairie Street.
That pickup, one of two owned by the department, collided with a dump truck when the animal control officer drove through a red light and was struck by the truck. Rescue crews peeled the pickup apart to free the officer, who was not seriously injured, according to an earlier report.
Recently, the remaining pickup had to be taken out of service for a short time, Smith said; serious calls during that time were handled by the Lyon County Sheriff’s Office’s animal control division.
Even when both city animal control trucks are on the streets, it has become challenging to be able to answer the calls reporting dogs and cats at large.
“The reality is, I’ve got one and a half animal control officers,” Smith said.
They are available to answer calls only 60 hours a week, when calls are coming in around-the-clock, seven days a week — and vacations, sick leaves, and testifying in court routinely trim the number of hours they are on the streets even further, he said.
Police officers will respond to calls as their schedules allow, Smith said, unless a dog or other animal appears to pose an immediate threat to humans or other animals. At that point, the call will become a priority.
Smith reminded Emporians that if commissioned police officers are answering calls about animals, they are not able to be on the streets and working their primary jobs.
In an ideal world, the animal control division would be fully staffed, which would take five to seven employees for “24/7” coverage. It is something the city budget cannot cover.
“Everything comes with a price on it, at some point,” Smith said.
If people are not satisfied with the ways calls are handled, he said he would be happy to talk with them and explain why actions were or were not taken.
He recommended several ways that the public can make the most best use of the animal control services available, with the first suggestion coming in the way those calls are reported.
“If you want a response to a call about a dog running loose ... a potential threat, call the dispatch center,” Smith said. “Obviously, if it’s a real dangerous threat, call 911.”
Describe the animal and its actions or condition in as much detail as possible, so dispatchers will know how to classify the call.
Smith used a recent incident as an example. A woman called in to say that a large “kinda scary” dog, dragging a chain, was in her yard. The dispatcher asked whether the dog had acted in a threatening manner, and the woman responded that she did not know; she was in her house and not going outside with the dog present. The dispatcher told her to call back and let police know if the dog became a problem.
In a short time, a man one block over called in a report about the same dog. This time, the caller was more specific: the dog was trying to chase other dogs and was acting in a menacing way. He described the dog as perhaps a Rottweiler-Beagle mix.
The call, which came during the period when there were no animal control trucks in service, was passed on to the Lyon County animal control officer to handle.
“They came out once they knew it was aggressive,” Smith said. “If they think it’s aggressive, they should tell the dispatcher.”
Calls about neglected animals may not be answered for up to 24 hours, unless an animal is in immediate danger.
Smith reminded citizens that calls for animal control officers are not answered through the animal shelter. The shelter has restricted hours and callers often can connect only with an answering machine.
The shelter accepts homeless animals from the public, and adopts out to new owners, but unless the animal control officer happens to be on-site — and that is only for short periods — the best volunteers who staff the shelter can do is call the dispatch center and pass on the information.
“The Buck Fund and Humane Society folks have been good to us,” Smith said of the volunteers. However, they are not able to hop in a city truck and pick up dangerous animals or strays.
Animals that are picked up are held at the shelter until owners pay to pick them up, or new homes are found for them; other animals are euthanized.
Smith said that owners may owe other costs, in addition to the charges incurred for time at the shelter.
“My understanding is in previous cases, the dog’s owner has been cited for letting the dog run at large,” Smith said. “... If it’s a repeat thing, we look at it more critically.”
Smith said that in the past, animal control officers have tried to enforce the law more actively, driving around the city’s streets and trying to find animals running at large. Even when the department is back to two animal control trucks, that past policy likely will change.
“With the gas crunch, we’re going to have to probably limit their prowling around,” Smith said. “We’ll be as responsive as we can.”

Sometimes the truth hurts. There is only so much to go around. Maybe you ought to go ride with the city cops and sit in with their dispatchers to see just what they actually have to deal with. Sounds like based on what I'm reading, they, with the help of some citizens who work with the police instead of bellyaching about them, actually caught a few folks involved in real crimes.

I read the above article twice and each time it boiled down to the same obvious conclusion: the city of Emporia does not consider animal cruelty, animals running loose, or possible animal attacks to be a priority and is not prepared or willing to deal with such mundane infractions of the law. The comments from Mr. Smith make it clear that if you encounter a stray animal, vicious or otherwise, you are on your own. No surprise, coming from a city that doesn't recognize Independence Day. People of Emporia must really love living here to put up with such a lack of services and irresponsible government behavior.

Did we read the same article Bjnemp?? I believe that the article stated the police would respond if there was an IMMEDIATE risk to safety. The cops only follow the policy set by the city commission. Nobody wants to spend more money. You do the best you can. I think everyone here needs to be careful about spouting off or reading into things that aren't there. Some people call that slander.

We all object to paying taxes. I do, too. I believe that taxes are too high. However, if we got all the government services that we demand, our taxes would be twice as high as they are now. The Police Department can only do what they have resources to do with, and therefore must establish priorities. Clearly, they will respond if there is an immediate risk to safety. If there is not, then they will respond to cases where there is. Of all the departments in the city, my observation is that the Police Department, which must maintain operations 24/7/52, does the best with the resources given to it. Thank you, police.

I read this article and I came to the conclusion that our city does not care to enforce to laws that they themselves set forth. We can pass a law about dogs not riding in trucks (which I agree with) but we cant enforce dogs running loose. What about the taxpayers that do follow the laws and pen up their dogs. Is it fair to them when other's are allowed to run free. What about the animal control officers telling me that they do not like coming to my neighborhood cause there are too many dogs running loose. Sounds to me like they dont want to do their job

Smith seems to have plenty of manpower to enforce the fireworks shooting. I do grow weary of hearing folks continually whining about not being able to do their jobs because they don't have enough money. Few of us do have enough money. And we just never hear of any efforts to figure out ways to do jobs more efficiently....just that there isn't enough money. He must have thought there was enough money when he took the job.

Life isn't always gonna be fair. The city ordinance book is about 3 inches thick if you count everything. Laws were intended to give those who choose to follow the law. Punishment was intended for the very few who would not meet the social and moral edicts of the day. Our Constitutional principles were written in a time when there was honor and integrity in more of the population than not. It was a time when social services issues were resolved by churches and neighbors. People spoke to each other rather than expecting the government to intervene in everything. You could have 300 cops and they still wouldn't have enough to enforce everything all the time. In this town, when they do try to enforce the laws that have been around forever, they start screaming at the cops for doing it. Calling them fat, lazy and stupid. I'm surprised they even bother to give you the time of day. It keeps being repeating the fact that this person told you that and others they didn't want to come to your neighborhood. I don't blame the cops and animal people based on what I read here.
I'd be interested in knowing how long ago it was and if that person still works there. If he/she does then why don't you call their supervisor and complain so they can fix it rather than beating it to death? Is it more convenient to push the story around rather than fix the problem or be part of the solution?
I've talked to those people and they do work hard. They take pride in their job despite the fact they are ridiculed, insulted and second-guessed by all the "experts" who actually know very little about the law and how it is applied. They get paid like crap, work several jobs to keep afloat like most everyone around here. So what's the beef?
I've dealt with "curb-side" and "Internet" attorneys most of my life and when push comes to shove, they fold like the house of cards they are. What's fair to you isn't gonna always be fair to the other person. That's why we live in a Republic not a democracy. It's majority rule...not consensus. Communism fell because the government can't be all things to all people cause it went broke and besides the people got sick of the government being in their lives all the time. It was repressive. So that's why in this same forum pages the same people who are called storm troopers by some are ridiculed as communists by others and even other terrible, terrible names that should not be found in a public forum. Until you walk a mile in their shoes, I would suggest you consider giving them the benefit of the doubt.
It's very obvious to me that the all the howling and whining that goes on in this town isn't limited to the animal shelter.

F.. Or possibly the hundreds of clean and safe motels we would find along the way that can provide temporary shelter?
G.. I guess having thousands of restaurants with varying cuisine from around the world is just not good enough either.
H. Or could it be that when we wreck our car, emergency workers show up and provide services to help all and even send a helicopter
to take you to the hospital.

Make no mistake about it. The troops in Iraq and Afghanistan have volunteered to serve, and in many cases may have died for your freedom. There is currently no draft in this country. They didn't have to go. They are able to refuse to go and end up with either a ''general'' discharge, an 'other than honorable'' discharge or, worst case scenario, a 'dishonorable' ' discharge after a few days in the brig.
So why then the flat-out discontentment in the minds of 69 percent of Americans?
Say what you want but I blame it on the media. If it bleeds it leads and they specialize in bad news. Everybody will watch a car crash with blood and guts. How many will watch kids selling lemonade at the corner? The media knows this and media outlets are for-profit

I have the solution....give the street sweeper police powers and a box to throw strays in. For a city that is so strapped for cash I see the street sweeper running all the time. How many street sweeping machines does the city have...are there city employees that this is their only duty ...If we have only a couple of these machines then they dont cover the entire city before they come back down my block and the only thing they are sweeping this time of year is cotton wood. Hell, let them write tickets to all the speeders through the school zone around the downtown area and we could line the streets with gold.

Another solution- Issue these(at the link below) to senior citizens around town.Pay a 15 dollar bounty for every carcass.In 3 months there won't be stray dangerous dog or feral cat.(never happen,but it worked for coyotes and jackrabbits!)

In almost every article I read on here you always have something negative and idiotic to say about everything.You sure must have alot of degrees because you seem to think you are an expert in everything you talk about. That's probably why Lieutenant Kelsch thinks I'm suddenly dangerous. He has refused a ride along for 8 years straight and
refuses to give a reason.

The dispatchers always send immediate assistance or backup if I can't handle a threat that is imminent and proximate.

If the city would lay down the law and up the fines for dog at large, nuisance dog and a very large fine for vicious dogs people would be forced to get their animals in check.
I would also let animal control be able to go to the owner if known while picking up a loose dog and collect the fine and turn the dog back over immediately. Less costs and time housing the animal.
I also think that they could hire and pay for another person to go out and check living conditions and collect city tag fees. That salary would pay for itself with the money collected. It would also weed out the owners who have dogs just chained up to trees in the back yards with no lifes.
I would also like to see that ALL animals that are picked up and impounded spayed or neutered before returning out to the owners.
Just a few thoughts tossed out there.....

I'm not going to disagree with anyone here except the information in this article. I understand the fact that there are not enough animal control officers to handle every little call. I also understand that when a threatening call about a dog attacking comes in, that is above the other "innocent" calls. And with reading the article it says that when calls cannot be taken by the city animal control because they are off duty it gets diverted to the county animal control if it is a threatening and dangerous situation. But wait, what about the two times I have made calls about a vicious dog (and I really do mean vicious not just a large dog)? I'll tell you. "Animal control is off duty you'll have to call back tomorrow morning". WHAT?!?!? Didn't this article just say that those situations that ARE dangerous get diverted to the county animal control? Yes, I thought so. Something looks fishy here...hmmm.

I agree that it's up to the owners to take care of their animals. Perhaps the answer is not so much more animal control officers but a way for neighbors to turn in the problem owners and actually get action. We tried that in the county but nothing was done. I will say that once the jerks moved to Emporia their dogs were taken away from them. Then at least one adopted out without telling the new owner it had been reported for attacking people. Something needs to be revamped in the whole system. I wish I could come up with the perfect answer since ultimately it's the innocent animals who suffer the most. And to have to worry about getting attacked by a dog in your own yard is disgusting. We have that issue out in the county right now. Good luck to us all!

I responded because I actually read the comment to editor and editor was not the other user name that I thought you were referring. I use several computers throughout the day, not all being at my home.
You were the one that got all cranky and brought up the fact that I was using separate user names.
Any ways, I'm sorry that you are not satisfied with the City and County response to your animal problems. I know it is fustrating for the public and probably the City and County workers as well. I wish there was the funds to provide 24 hr Animal Control, but in reality there is not enough money.

I understand calls come in order and also taken on viciousness but not all dogs can be read so easliy nor should a regular person be trying to make that decsion.I see people speeding am I suppose to pull them over?No of course not it is not my job. IThe city spends money on stupid things like big clocks and floors of the court house and desk's that cost more than my house and expect us to pay for these things but not the things to protect our community.My nieghbor is 87 years old a jump from an over friendly dog could hurt her, her skin is thin and her 30% bone denisity a fall could cause her to break a hip and then we are still disscussing how to make this problem better?? DO YOUR JOB CITY WRITE TICKETS TO EVERY ONE WHOM LETS THEIR DOGS RUN AND YOU CAN PAY THE ANIMAL CONTROL FOR A GOOD DAYS WORK stop slapping their hands and expecting people not to get peeved off. Animal owners that let thier dogs run loose can stir up a nieghborhood faster than anything.I personally have an outside dog she does not run loose nor do I walk her or let her go to poop in the nieghborhood but I get mad when people do it to me. Ask our nieghbor HOW she liked cleaning her dogs poop off of her car handle a few monthes ago at 6 am before work just as much as I liked picking up out of my yard everyday because she lets it out the front door instead of her BACK fenced in yard. People this is a no brainer enforce..enforce..enforce and you be taken seriously!!

Easy to rant...not so easy to come up with viable, financially responsible positions. Just my opinion..nothing more.
