Lyon County Commissioners approved a motion for Lyon County Extension and Research to join with the Frontier Extension District by a vote of 2-1. Rolie Martin and Teresea Walters voted yes. Scott Briggs voted no.
The issue was almost decided in a commission meeting two weeks ago, when, after a lengthy public debate, Commissioner Rollie Martin moved to approve the resolution to allow Lyon County Extension to join the district. Commissioner Teresa Walters agreed, but as Commissioner Scott Briggs was set to vote, a sudden executive session was called by County Attorney Marc Goodman. The meeting was reconvened, and the commissioners announced they would table the motion until today.

I'd sign it. As I understood it at the meeting Marc Goodman would have to approve the language of any petition. I think that means the petition would have to be very carefully worded.

Where will the petition be and you damn betcha I will sign a petition and even join a public demonstration in front of the Court House ( Taj Mahal ) if need be .
Constitution/Bill of Rights ? What the hell are those ? Do they mean anything anymore ? Must be some sort of scrap material, to be used for starting a camp fire or a revolt !!!
And people wonder why more people don' t attend City or County Commission meetings !
It makes no difference whether the public/taxpayers attend and say anything or not . Fact is, decisions by both Commissions' are/were made , behind closed doors, with certain people, long before any public notification, meeting/input/discussion or debate !!
Another fact of how our City/Lyon County Commissions operate/do things is, they only listen and do what they and their " Elite " friends want them to do, not what the majority of the people want or need them to do .
These commissioners say that they are representatives of " All the people " ! Fact is, nothing could be further from the truth ! The " People " they listen to and do their bidding are the " Few People ", not " All of the people " !
The " Unlimited Taxing Authority " that was approved, may just be the " Swan Song " of Emporia and Lyon County !!
How many businesses/industries, etc. are going to be willing to locate in an area/city when, after their 10 year tax abatement sunsets, they are going to be looking at ever increasing property/sales and " rearend " taxes " ?
I think every taxpayer should send the City/County/State and Fed a " Butt rape tax statement/bill " every time they raise/increase a tax on the taxpayers, without the consent/vote of all of the citizen taxpayers !!

Does anyone know? Has Walters or Martin voted NO on ANYTHING since they've been in office that involves spending or increasing taxes? Hell, I'm going to see about having the Lyon County Taxpayers subsidize me. 1/2 cent tax to help my standard of living. Maybe we should all petition for this. They vote against the wishes of the peple and do whatever they want anyway. Thanks Briggs for voting against this ! ! !

I am curious as to why they think this is a good idea.
Can someone with knowledge of the whole issue enlighten me? I don't know what the pros and cons are however, I believe that if it gives someone unlimited taxing authority that the public should vote on it....not just 3 people.

I don't have a lot of knowledge about it, but enough to let you what I think they may have been thinking.
A couple of years ago the extension office tried to do the same consolidation - with Coffey county. Their rationale was that they were trying to develop an economy of scale. The proposal was anything but an economy of scale. It was actually nothing more than an attempt to develop a bureaucracy and extend its tentacles. Everyone knew that so they pulled the proposal.
I suspect in the time since then they've been currying political favor to get what logic and good sense said wasn't necessary. They did quite well with the help of Mr. Martin and Ms. Walters. Mr. Martin gave some convoluted explanation for his support (I like the service and I use it a lot). Ms. Walters said she just thought it was a good idea, even though she acknowledged that a majority of her constituents were against it.
That's it in a nutshell. Small town politics.

Lots of rules and regulations on these petitions. Nothing decided yet and we would have to make sure of the wording, You are correct, netloafer, Goodman would have to approve it.
There is also a cost issue of an election. Would it have to be a special election? Or could the question appear on a regularly schedueled election?
I know my physical abilities would keep me from getting all the signatures myself. There would have to be some others willing to help out.

So in other words, one member of the board, Martin, uses the services a lot (of course, he's a farmer) so it's a good idea for all taxpayers in the county even those of us who don't use their services? I admit, I have used their services too, but not enough to agree to this kind of open taxation of the entire county.
Then the other member, Teresa Walters, whose constituents VOTED HER INTO OFFICE, paid no attention to what they wanted and voted yes because she thought it was a "good idea" ? What the hell kind of empty-headed female thinking is that?

Just got off the Phone with Ms. Vopat. 990 signatures so at least 1200 would be needed. The question, (if a petition is done) would probably go on the Aug. Primary so no special election should be needed. I think there is interest in this, just not sure how many would be willing to get out and do some work on it.

I would be willing to help in any way possible and I don't think 1200 signatures of Lyon County registered voters would be hard to obtain. Heck, take the petition to Steve's place, the VFW, Legion, and a few other bars in town and I think we could do it fairly easy.

The big thing to remember is the 60 day timeline which would end March 17th, (I think). And after the ban petition, I can tell you there is a lot of work involved actually getting REGISTERED voter signatures. We had sheets with 20 signatures and none of them were registered. They would tell s they were registered but they weren't. Embarrassed i guess.

I talked to Tammy at the courthouse. She said 1200 would be the safe number. I think only 990 are actually required. But all signatures have to be valid - a registered Lyon county voter with a good address.
I'm not sure if someone from the extension office is going to be there when signatures are reviewed. If they are it's gonna' be a donneybrook.
I also got a copy of the agreement the commissioners signed. I think we're going to need an attorney to draft a petition for us based on that agreement.

On the petititon we worked on we did hire legal help for the wording. Once we started getting signatures on the petitions Dan Slater provided us, (at cost, which we expected) an excel program disc with all registered voters on it so we could check the signatures against the county rolls. It worked out pretty good.
We tried to throw out the bad sheets so Tammys' crew didn't have to deal with them. The sheets had twenty names on them and there were several sheets that no-one on them was registered.
Also the person who is getting the sheet signed has to be a registered voter in Lyon County. and each sheet has to be notarized. but we did it then.

There is no benefit to the taxpayers. The only people who stand to benefit from this are the extension offices. They get the power to tax independently with no real accountability to our county commissioners. As things are now the local extension office represents one line item on the county budget and the county commissioners control that. No one ever said it, but I think that the local extension people felt they weren't getting enough money from the county to support their plans. Now, if this gets final approval without our intervention, they can start dreaming champagne dreams at our expense.

I could talk to Randy Heavener, manager of the local Walmart and see if he would be willing to set up a table at the entrance to Walmart and have petitions there, ready to sign !
Almost everyone in Lyon County goes to Walmart.
I know Randy fairly well and he is against any new taxes or increased taxes.
There is also Bluestem, Sutherlands, Courthouse, etc..
Let me know and I will try and talk to Randy about it.
And one thing to remember is, the Extension District will have " UNLIMITED TAXING AUTHORITY " !!!

Obviously Walters and Martin have NO understanding of the concept of representing their constituents. All three commissioners were told loud and clear to vote against this, many many times.
Now there will have to be all kinds of time spent with the hassle of drafting a petition correctly and getting signatures, and trying to get this on the ballot for vote, all because of these two idiots. Another petition at the same time to put both Walters and Martin up for recall vote would be equally as appropriate.
It simply is not enough to want to screw the taxpayer as before, is it, Walters and Martin? You just advocated UNLIMITED TAXING AUTHORITY!!! Do you even understand what that means, or care????
If this gets finalized, I'm betting we'll see some big huge new building(s) that will just have to be built ASAP, with a whole plethora of new additional staff, cars, equipment, etc. A new expanding empire will be established, and it will need hefty, annually increasing tax levies to support. No problem, just hose the taxpayer for whatever is needed. Why would any taxpayer trust the Frontier District to operate efficiently, closely scrutinize their spending, etc when all they have to do
is just raise the tax levy however much they want?
Shame on you, Lyon County Commissioner Teresa Walters!

I would be very glad to sign a petition. My major question is 'WHY"...with Lyon County taxpapers paying the most...how will this be a benefit to us in Lyon County? Why was it so important to rush in joining the Frontier group? Just don't believe there was enough research into joining. I don't feel it is truly the "free taxation", which we have given to some areas without a vote, but WHY is this even needed and how will WE benefit.in Lyon County. Believe that is why we VOTE concerning our commissioners to be our voice. PLEASE tell me WHY and how I, as a taxpayer, will benifit, ALL in FACTS!!!!!!!!!!! Plus have this done BEFORE a vote by said commissioners, then LISTEN to the public you represent.

I don't want to see some glossy brochures mailed out at taxpayer expense, extolling what the extension does. Because the election wouldn't be about that, it would be about the way it's funded.

Thanks for the offer. I would be willing to pay for the cost myself. I am in no way running anything here, but taking donations means some bookwork and I'm not sure it's needed (now). My main goal would be to just get it on the ballot and let the people decide. I'm hoping someone like Phil will step up and help get the petiton drafted and reviewed and then we can help by getting signatures. His legs and lungs are in better shape than mine. What do you think Phil?

I've started doing some of the leg work. I've got a copy of he agreement and am going to contact a lawyer to help in drafting an appeal.
I've had a few people contact me since the meeting yesterday. They are willing to help.
At the meeting Bob Agler voiced his disapproval. I think if we could get him to get support in the business community would be very helpful. I'm going to contact him about that.
You're absolutely right about being sure we've got support. Ms. Walters and Mr. Martin know full well that the appeal process is difficult. They are counting on public apathy. Like all our politicians they decry the fact that less than 20% of registered voters go to the polls, but inwardly they are delighted. It serves their purposes very well.
Our big task is going to be translating the public dislike of this idea to action.

How about the local media, conducting a " Straw Poll/vote " on the matter and see how many Lyon Countians are in favor of or against the County Commission/commissioners approval of the Frontier District merger and the " Unlimited Taxing Authority " the district will have and would vote on the matter ?
Doesn' t our local mecia outlets perform any " Public Service " now a days ?
And conducting a " Straw Poll/Vote " on this matter would be a great service to the public .

I just spoke with Bob Agler. He supports bringing this issue to the voters. He will support the appeal.
Do you still have a copy of the ballot initiative you guys had drafted concerning the smoking ban? If so, I'd like to get a copy so I can sit down with an attorney and compare with the ban's language, etc as a starting point for a draft.

I, like you, do not have the best " Wheels/legs " in the world , but would be willing to do what I can to help .
And don' t forgett that there a lrge number of non-english speaking , potential, voters in Lyon County and Emporia also . Do these citizens have a good grasp of the consequences of such a County Commission decision ?
Fact is we should not forget the ethnic and cultural diversity of our country, locally and nationwide !

I have been trying to understand what " Unlimited Taxing Authority " actually means.
As I understand the term, it means that " " The District has taxing authority separate from any other taxing authority, and may, subject to voter approval, issue an unlimited amount of bonds and levy an unlimited rate of tax in payment of such bonds. "
So if I am understanding the meaning of " UNLIMITED TAXING AUTHORITY " ! If Lyon County merges with the Frontier REDD, which now consists of Franklin, Osage Counties, this would mean that this enlarged Frontier district would have " UNLIMITED TAXING AUTHORITY " over 3 counties and be able to tax the citizens of all three counties, to pay for bonds/borrowed funds, etc., that any one of the three counties deems necessary !
That is the way I understand this " UNLIMITED TAXING AUTHORITY " would work. Kinda like a sales tax, that everyone has to pay even if they don' t live in any certain district, but are forced to pay it anyway .
Now if I am right, that doesn' t sound like a fair and equitable tax " Authority " to me, at all .
Did/Do the Commissioners fully understand what " UNLIMITED TAXING AUTHORITY " means/is ?
If I am wrong, please, tell me or prove me wrong .

Here is the Kansas State statute concerning the taxing authority of a County extension district,
2-620: Extension councils in certain counties; office facilities; tax levy, use of proceeds; protest petition and election. In any county having a population of not less than sixty thousand (60,000) nor more than seventy-five thousand (75,000), the board of county commissioners may levy, for a period not to exceed two years, a tax on all taxable tangible property in such county not in excess of one-quarter (1/4) mill on each dollar of assessed valuation of such property for the purpose of creating and providing a special fund to be used for the purchase of real estate, including any buildings or structures thereon, and to make improvements on such real estate for the purpose of providing office and meeting room facilities for an extension council operating under article 6 of chapter 2 of the Kansas Statutes Annotated and acts amendatory thereof and to pay a portion of the principal and interest on bonds issued under the authority of K.S.A. 12-1774, and amendments thereto, by cities located in the county. No levy shall be made under the provisions of this act until a resolution authorizing the making of such a levy be passed by the board of county commissioners specifying the amount to be raised each year by such levy and published for three successive issues in the official county newspaper within the county, whereupon such a levy may be made unless a petition in opposition to the same, signed by not less than ten percent (10%) of the qualified electors of such county, as determined by the vote for secretary of state in the last preceding election, is filed with the county clerk of such county within thirty (30) days following the last publication of said resolution.
In the event such petition is filed it shall be the duty of the board of county commissioners to submit the question to the voters at an election called for such purpose at the next general election.

2-623: Extension districts, establishment or expansion; agreement therefor, terms, prior approval by attorney general; publication of notice of proposed new district or expansion, protest petition and election; district name, powers, personnel and property; governing body, appointment or election and terms of office of first members.

That 1/4% levy from the county applies only to the establishment costs of this proposed consolidation. That was Rollie Martin's argument. He said this would only cost us $23K. Here's the truth. Once a district is established and the protest period of a vote has been completed and the extension service has won, then they would have the unlimited tax authority. I don't think they're insane so they wouldn't tax to the upper limit, but as with anyone with the power to tax (the old adage - "The power to tax is the power to control"), they will begin to dream the champagne dreams. Small projects would become large. Small expense items would baloon. I think the output in that case would put Lyon county in the place where it's like the frog slowly being boiled. Further, we would have no direct accountability link. Franklin county would become the home district. Any protests would have to go through them.
This isn't just a bad deal, it's a raw deal.

Depending on the lawyer you go with they should be able to fax back and forth with Goodman to get something acceptable for the county. Maybe something simple like;
"Should the Lyon county extension office join the frontier extension district?"
It would be specific to this issue, but would not cover any future effort by the county extesion office.

So I call the police department today to have animal control come out and pick up a stray that has been around for a few hours, they tell me I will have to wait until tomorrow and to just leave it alone and hope it goes away.

It seems to me that there is a serious lack of " Thoughtful Thinkers, Planners and Studiers " on both the City and County Commissions . And plenty of " DO AS I WANT, WISH OR SAY PUPPETS " on both Commissions .
If I sound upset and angry, well it is probably because I am ! It would seem that the only thing, we the taxpayers of Emporia and Lyon County have to look forward to is " paying more taxes " and " Keeping Less of Our Earned Money " for our own personal needs !

Evidently the powers that be want this to happen, what with giving unlimited taxing authority to a completely separate entity, and spending half a million dollars on rocks when the city is $55,000,000 in debt. I seriously believe that there are people in the city government who want to see a total capitulation of the city government so they might take charge of the aftermath. In my mind, that is the only explanation that makes sense any more.
The citizens (including me) of Emporia/ Lyon County should be ashamed for what they allowed to happen.

You're deferring from the topic at hand with your left-field posting about welfare recipients in California. That's not the point, but I am open to an intelligent debate on the topic in another forum.
Back on track... When I say Kansas (and other red-states) is a welfare state, it is because you require funding from profitable blue-states like California for your basic needs. Again, refer back to the stats I shared of blue-states receiving from the government less than what they pay in, while it is the exact opposite for red-states. Explain to me why Kansas cannot support itself and requires California to supplement it's funding to stay afloat. Don't! Do not bring back up your null argument that we have a larger population. That is the most laughable excuse, and certainly so mathematically inaccurate in so many ways.
If you want to be fair, then let's make it that every state receives for their contribution to the federal government; 90 cents on the dollar! (I realistically recognize we must continue to pay for the politicians salaries, the military, etc.) That said, California will be getting back much more than it currently does, which is enough for us to pay for our investments (even the welfare recipients). Kansas, on the other hand will have to learn to economize. $1.12 being reduced to 90 cents. How are you going to survive without the federal handout (unjustly milked from blue states)?

There are some who feel it is not the best use of our tax dollars or resources.
There are some who feel strongly about the unlimited mill levy aspect of this district.
There are some that worry about local control and accountability.
There are even some, (according to the latest unscientific Gazette poll), who feel that we should not fund an extension office at all.
The reason given for the districts is to increase the number of agents in specialized fields to all of the counties in the district.
And yet do these extra specialized agents actually do anything to improve the business, social or standard of living for the people of the districts?
I would counter to Richie that this petition processs will bring forward the discussion of ideas on both sides, Maybe a different solution will be found.
Part of Richie's gripe is his states funding, (through federal tax dollars) of other states operations. He states:
"Kansas, on the other hand will have to learn to economize. $1.12 being reduced to 90 cents. How are you going to survive without the federal handout (unjustly milked from blue states)?"
I would reply to Richie that is exactly what this petition and the resulting vote will do. We are trying to become involved in the American political process, and by doing so if we decrease spending here, maybe that will cut the money from your state that goes to fund other states.
IT IS THE AVERAGE VOTER BECOMING INVOLVED IN THEIR GOVERNMENT.
As someone who now lives in California, (and I think it's a great state), YOU should know that is the way it should be done. Look at your own states history of propositions on your election ballots. That is all we are doing with this petition.

I'm going to ctc county again this morning to arrange for a meeting place. I like your idea of a Saturday a.m. meeting. Will let you know. As soon as we get word will get press releases cooking. We need to move as quickly as possible on that. If I don't hear back we need to consider alternate location. Will be looking into that as well.
Will be making copies of the petition today
I am also going to make copies of voter registration forms for those circulating petition. Will also make copies of your instructions.
Will be setting up a checking acct today for funds as we move further downstream in the persuasion process.
For those interested in signing. We have to wait till Friday to circulate the petition From that point on we'll be firing away on all possible cylinders. Maintain your enthusiasm

Also, I am speculating as it would take a bit of research, but I would fathom that the gov't. subsidies to farmers plays a big part in our price gap between our state and yours. The price of our commodities are in most cases for political purposes for trading worldwide. I personally believe that we don't receive a fair share of the profit for the commodities we produce, but our government seems to want to give it away to other countries, I guess to make us look good. If we could or would levy a tax on the food we produce much like oil rich states like Texas, then we would probably be far less indebted than your state.

You seem to forget the fact, that California also receives 74 cents in " Fed Prop Up money " , which by the way is also funded by Kansas taxpayers, as well as all of the other States taxpayers . Yet you don' t acknowledge that fact, do you.
FYI, 46 out of the 50 U.S. States are broke or going broke including California . How do you think the taxpayers of those 4 or so States that are not broke or going broke feel about " Proping Up " California to the tune of 74 cents per dollar of their taxpayer dollars they pay to the Fed , or the rest of the other 49 States, that are undoubtedly receiving Fed prop money, including Kansas ?
Yet again, you do not think about that, do you ?
Instead, you would rather degrade, insult, disrespect and bad mouth those taxpayers in States, particularly Kansas , who oppose excessive, unnecessary spending, borrowing to spend and our leaders who wish to join an entity that will have " UNLIMITED TAXING AUTHORITY " and relenquish their decision making authority to outsiders, because they just want to pass the " Buck " and not make the really tough decisions !
I have no problem with the points of your argument . Just how you singled out Kansas, especially Emporians and Lyon County and your bad mouthing and insults, lack of courtesy and degrading, disrespectful manor .
It is going to be up to the people of each respective State, County, City to see that their elected leaders reduce spending, to a level that the taxpayers can afford and most of all " Stop " unnecessary " Borrowing " in order to spend unnecessarily, which causes more unnecessary/higher taxation/taxes ! As well as demanding that the Federal Government do the same .
Fact is the U.S. Government' s and consequently the States are in debt/owe others countries, such as 1. China 2. Japan 3.Great Britain/England 4.Brazil 5. Canada 6. Russia 7. Russia 8. Switzerland and others to a lesser extent, most likely more money than the U.S. Government and States will ever be able to pay back . If you wish to thank anyone for propping up the U.S. Government and the States, you will need to thank those countries who have lent the money to do so !
So you see, California and you are not " propping up " Kansas or anyone else for that matter. The foreign countries are !
So, Richie, please let us Kansans, especially those in Emporia, work on trying to solve our own problems and you work on your own state' s financial and other severe problems and stop bitching who is receiving Fed assistance via foreign loans . And remember California is also " Broke " and receiving Fed/Foreign assistance.
Not only my opinion, but the real life world we are living in .

Another way we could look at the welfare state comment from Richie (accepting his numbers) is that for every dollar we Kansans send to Washington, we get $1.12 back, and for every dollar California sends they get $0.78 back, so we are getting 12% return on our investment, and California is taking a loss of 22%. So who is the wiser, better represented state?

Oh boy ! Paccifier, I have a feeling that you are about to incur the wrath ow Richie, on how he and other Californians are getting " screwed " by the rest of the States , especially Kansas, via the Fed.
Oh, and yes, your thinking could be another way to look at the welfare state . But, boy oh boy, Richie is going to go into a terminal " Boil " over your thinking, that Kansas is getting a return of 12% on their tax dollar and California is losing 22% on their tax dollar, especially if it is due , as you say, to Kansas being a " Wiser " and better " Represented " State !

Just another way of looking at things my friend. As long as I turn the other cheek, his burn will not be to bad. But, I like the idea that we turn in our dollars and get more back in kind. Perhaps we will meet at Steve's to sign the petition and toast our benefactor friend, Richie, in his absence.. After all, listening to him, it is his money we are getting back.
