A continuance was granted Wednesday in the case of Christina Devine, the woman who allegedly put her newborn baby into a trash bin at Chapel Ridge apartments this past October.
Judge Merlin Wheeler on Wednesday granted the continuance in the trial. The trial was scheduled for next month. The defense requested the continuance. Wheeler set a new date of Oct. 17-20.
In a court affidavit, Devine said she was raped and did not know who the father was. The same document said that Devine didn’t realize she was pregnant until early October, and that she was scared of what she would have to do as a mom.
A Walmart co-worker of Devine’s contacted police that day to inform them Devine’s appearance had changed and that she did not look pregnant any longer, according to the court affidavit.
Police arrived at Walmart and upon questioning Devine, she admitted that she gave birth to the boy and left it in the Chapel Ridge trash bin. She did not live at Chapel Ridge.
The boy was breathing when police arrived and he was taken to Newman Regional Health and was expected to be fine.
