In Lyon County, taxpayers are singing “We can feel the tax increase comin’” because our county commissioners are rumbling toward adopting a budget with a 5.5-mill property tax increase.

This increase is being justified by needed repairs to roads and bridges caused by the weather. Although those needs are real, they shouldn’t be handled with a blank check and only after a detailed plan is in hand.

The best news is that the budget hasn’t been adopted yet, leaving time for commissioners to apply the brakes, but today’s study session might be our last hope.

School districts have tightened their budgets with staff reductions, furloughs and building closings.

Emporia city is holding the line by adopting a deficit spending plan funded by reserves made possible by actions taken earlier to prepare for this situation. Time will tell if their plan is successful, but there is no mill increase in the Emporia city budget.

That leaves only Lyon County .

Several years ago, Lyon County taxpayers supported a new sales tax with the understanding it would help keep property taxes in check. The 5.5-mill increase proposed by county staff will certainly test the taxpayers’ trust level if adopted.

My suggestion is that the commissioners look hard at recent spending increases and roll back budgets to keep the mill levy flat.

Easy? Of course not, but department budgets have grown across the board in recent years.

Where should they look?

How about starting with the departments where the greatest growth has occurred?

Here’s an interesting fact — of the Lyon County budget, 36 percent is spent on police and safety.

When you consider that nearly four out of five Lyon County residents also pay for the operation of the fully staffed and funded Emporia Police Department, you start to wonder just how much law enforcement do we really need?

The study on law enforcement consolidation a few years ago didn’t provide overwhelming evidence for such a move, but it did strongly suggest “dispatch” was an area where duplication was present, yet we still have two dispatch centers.

The time is right for our county commission to think outside the box and lead the effort to downsize government. Without such an effort it’s doubtful the taxpayers will be so willing to approve the next sales tax question.

I wonnder has Mr. Sauder been to any of the City Budget and County Public Budget hearings and protested about the excessive and unnecessary spending ?

I certainly don' t recall seeing him at any !

And wasn' t Mr. Sauder one of the major proponents and supporters of the recent sales tax extension, which he touted as the single most important thing in keeping the property tax mil levy from being increased ? Oh, thats right he's one of the big " Honchos " of the RDA isn' t he . So I guess he really wouldn' t want to shoot himself in his own foot would he ?

Make up your mind Mr. Sauder. You can' t be on both sides of the river at the same time.

Meth, can you show me where it stated the tax extension was supposed to prevent an increase in property tax? I don't recall seeing that. I do recall that it was supposed to curtail an increase.

On the sales tax question itself, as it appeared on the ballot, one section reads as follows:

"...such tax to be used for general governmental purposes including providing funds to (a) promote industrial and economic development in the city and (b) reduce city levied property taxes, provided that such retailers' sales tax shall terminate on December 31, 2024 all pursuant to KSA 2009 supp.12-187, ET SEQ., as amended?"

Would you say that part (b) would cause people to vote "Yes" because they believe doing so would save a raise in property taxes?

You are absolutely right about the State statute and sales tax useage. What you looked up at the courthouse is the actual State Statute on sales tax usage.

I was going to refer you to the State of Kansas website that deals with local sales tax usage, but create already give you the exact wording of part of the State Statute.

Therefore as I see it at least the County is in violation of Kansas Sales tax Statute " KSA 2009 supp. 12-187, ET SEQ, as amended . " The City may also be in violation of the same State Statute if they do not use the sales tax to " reduce City levied property taxes. " -

And yes both the City and County, misrepresented what the Kansas State Sales Tax usage Statute was intended to accomplish .

A good start would be to get rid of the commissioner's county counsel and let the district attorney's office handle those duties. He left the office once then came back as assistant counsel and is now the counsel again - complete waste of taxpayer funds.

Emporians for Drug Awareness Director, Theresa Walters, has issued a challenge to the Emporia community. If she can collect $5,000 in donations for Emporians for Drug Awareness scholarships, and another $5,000 for a woman with breast cancer, she will publicly have her head shaved. She said the idea came to her rapidly one day, after discussing scholarship money sources. Then she learned that an acquaintance has breast cancer.

Walters said that she is thinking of allowing someone who gives $500 to have the first swipe with clippers. She said it was not a hard decision to make. She said the event will be a public event, and hopefully people will donate and come and watch. The fundraising will be September 6th to through 26th. The head shaving will come after that.

While this is such a noble act, it seems like an inflated view of her head/hair.

Besides, if Theresa and the other 2 county commissioners pass the increased mill-levy, some locals may just scalp them all before any fundraising is done:>)

I just about had a heart attack last night driving my car. going through a nice neighborhood and noticed a nice cottage with a for sale sign in the front yard.

Was that Matt Zimmerman in the yard wrangling leaves? Yep, for a minute I thought yahoo, he's moving on. But then I realized he's probably just moving on up, to the lakeside.

Methusla, I was quoting the partial wording of the sales tax question as it appeared on the actual ballot in our last election.

Still, the way it read on the sales tax question, I can see where people might believe that if they voted no, then their property taxes would be raised.

I find it interesting that Sauder thinks it is a better deal to pass a city budget with a $750,000 negative budget and no mill increase than for the county to pass a real budget with an increase. Just where is the deficit going to be made up? Don't think I've ever heard of a budget being called a budget when both income and expense sides didn't match.

I also find it interesting that the city has money to spend on those irritating signs saying that the street repairs are being paid for with the county sales tax but it's not ok to repair the county roads destroyed by the weather. Sometimes I think he just likes to hear himself talk.

Steve has a finger pointing at the Lyon County Commission but, he has 3 fingers coming back at himself which his RDA buddies cover up the 75% of the people don't like the city way of doing business. The city of Emporia is a piece of work. I call them the good ole boys. And good ole boys listen up--57% of commerical Real Estate loans are 3 months behind and under water. Most of these loans are none recoarse loans.

Yes, the Zim Man, has purchased a new home . And just like the " Jeffersons " he is " Moving On Up " .

I just wonder if part of the 2011 City Budgets,$11,278,938, Personnel Services and merit pay expenditure didn' t include a nice raise for the " Zim Man !

reddog is 100% right. How Sauder and Walker can think that the city's $750k shortfall is something to be proud of is beyond me. Would you balance your own checkbook that way?

I got a better idea - why don't we just CONSOLIDATE the newspaper and the radio station? They both say the exact same thing ("duplication of services," I think that's called) and at least the radio station doesn't outsource its broadcasts to Lawrence.

FYI, there are a total of 11 businesses in Emporia that have not paid sales taxes to the tune of $267, 572.54 .

To those business owners who have and do pay their sales taxes ... I say " good job and thank you ! " To those business owners, who have not, do not or will not pay their sales tax obligations ... I say to you " shame on you and you are nothing more than " leeches " sucking the life blood of a City and its taxpayers.

There are 3 businesses outside of Emporia that have not paid sales taxes to the tune of $82,235.34 . These businesses and their owners are also leeches.

Taking into account the deliquent sales tax monies and the fact that Emporia and Lyon county is becomming one of the most expensive places in Kansas to live. I am surprised that Emporia and Lyon County still has any residents or shoppers living here !

The wording on the sales tax ballot was genuinly misleading to those who wanted to believe that a sales tax extension would mean property tax, " Relief ", however I think that most of us who have been around a while and know how things are done in Emporia and Lyon County , knew that a tax would be increased and most likely it would be property taxes .

I was born and raised in Emporia, my family set down roots in Emporia or the Emporia area many years ago . I can say, that at one time I truely loved Emporia and respected the City and County leaders. But my attitude and feeling about Emporia, the County and its leaders have changed drastically in recent years ... since there has been a rise in the overwhelming desire of Emporias, so called," elite, intellectual " leaders to push the idea or obsession of wanting to transform Emporia into one of the other Citys that they are so infatuated with . And the problem is these people do not care what it may cost or whom it may hurt or destroy in doing so !
And therein in ... in my opinion ... lies a big part of Emporia's problems.

Well, I see that at least one person has managed to absolutely misunderstand the last part of my lastt opinion or comment .

Let me try and explain, as it seems, for some, I must clarify my comments.

First of all I am not against progress or moving forward ! However moving forward or progressing has absolutely nothing to do with copying, being like someone else, something else or somplace else or being an exact clone of someone else, something else or someplace else that you/me or anyone else is infatuated with or enamored with and that certainly doesn' t mean spending a myriad of taxpayers money to accomplish any or all of the aforementioned copying, cloning etc., just to copy, clone or be like someone else, somplace else or something else !

Does that clarify my comment for you, "cooter ."

Perhaps Gwen will comment on that and let me/us know whether I can post a sales tax deliquency list on this forum and not be banned for doing it. How about it Gwen. Looks like at least some of the taxpaying citizens of Emporia would like to know who is not fulfilling their tax obligations.

I would be more than glad to post the names address of those tax evading individuals !

In the meantime, maybe there are other cities in Kansas that we can take a few pointers from.

Your suggestion that taxpayer money would be used to magically "copy" another town is nonsensical. Where/how/when is that happening?

What I would like to see is private business, like there are in Lindsborg, Hays, Winfield, Fort Scott or Salina want to set up shop here. If that's the kind of "copying" you're against, I'm sorry, but I'm all for it.

I don' t know how long you have been reading these forums or listened to the so called leaders of Emporia. But there are plenty of comments about how Lawrence, Topeka, Salina, Manhattan, Wichita, etc. are and have done things, such as spending millions of dollars of taxpayer money to attract industriy and jobs to their particular and the first thing you know, hail and behold there is an RDA created, a CVB created in Emporia that are funded by the Emporia tax and job base, which is much smaller than any of the larger citys, and the RDA and CVB is funded to the tune of several million taxpayer dollars, which the taxpayers and the City of Emporia can' t possibly afford and hence salex tax extension upon sales tax extension a possible 10.364 or 10.5 property tax mil levy increase .... and all just to try and keep up with, emulate, be like and compete with the much larger tax and job base Citys . No indeed, cooter, common sense does not prevail in Emporia and Lyon County, only the stupid, unneeded desire to be like something, someone or somplace else.

I have no objection to private businesses locating in Emporia. However, as long as Emporia and Lyon county has one of the highest property and sales tax burdens of anyplace in the State of Kansas and possibly elsewhere that is not likely to happen anytime soon.

As a matter of fact, the jobs and taxpayer base of Emporia and Lyon county may just continue to " dwindle " to almost nothing.

That is not " negative " thinking that is seeing and knowing what is happening and that is " rational reality " ! Something which seems to be lacking in Emporias leadership community.

I have read the complaints. Does anyone have any ideas/recommendations how to get out of this mess, besides the obvious common sense, live within our means basics?

Some cities compost the yard waste, grass clippings/tree leaves, then bag it and sell it. Why can't we? Do I need to volunteer to drive the tractor? I will. Do I need to volunteer to bag the black gold (dirt), I will.

Methusla has written that the Zim Man "has purchased a new home", where is it? what's the address? I want to know where he is moving to and into what neighborhood. And how does one go about finding out this kind of information regarding the sale/purchase of his new home?

Along with the comments about his new home purchase is the inference that the new city budget will be increasing his salary, but I was under the impression that that was public information and printed in the paper. I haven't seen anything in the Gazette about his salary being increased so is it just his salary or the raises too?

How do you find out about his salary, new home and why he is wrangling his own leaves.......?

I mentioned that according to the actual 2011 City Budget, the Personnel Services/wages/salaries would increase by $689,423 and then if you add Merit Pay increases to that figure the total pay/salary package increase for 2011 would be a total of $815,162 and that is a pretty hefty pay increase, considering that the number of people that work for the City . My comment was, " I wonder if this raise in wages and salaries, included a nice raise in pay for the " Zim Man " . I am just guessing that it does include a raise in pay for Zimmerman, I don' t know absolutely for sure. However, one can almost bet that the increase in wages/salaries will be mostly in the managerial, supervisor, administrative levels and/or executive levels.

And Mrs. Z let it slip to her co-workers that they, " Zim Man and Mrs. Z were purchasing or had purchased a new house . Don' t know exactly where and don' t know how to find out. I also don' t really care. As far as if the Zim Man will get a raise in pay or not ... that fact will not be disclosed until after the first of the 2011 year and then it may not be made public knowledge. However the Zim Man has gotten a good raise in salary almost every year, if not every year since he was hired as City Manager, I really don' t think 2011 will be any different.

willow, you ask some good, interesting questions and they are ones that may never get answered . As is all questions about government leaders, their salaries, etc.. Transparency and accountability in government is an elusive animal indeed.
