It is now 7:45 p.m. on a Saturday night.

My windows are closed, my air conditioner is running and my television’s volume is on 30 out of a possible 60 and I can still hear or should I say feel the music that is coming from Las Casitas park. The music is so loud that my windows literally vibrate when they play certain notes. Let me just mention that I live a mile and three tenths from Las Casitas.

The City of Emporia supposedly has a loud noise/music ordinance that they selectively enforce. I realize they purchase a permit to hold their venues, but why must the rest of us not attending the event be forced (and I do mean forced as I was at 6th and Commercial and could hear it) to tolerate this excessive amount of pure loudness. Has anyone from the city tested the decibel levels at one of these events? When someone coined the term “Feel The Music,” I do not think they meant from a mile and half away.

My son has a scanner and I was listening to the police dispatcher sending an officer out there to tell them to turn it down a little and stated that she had taken four calls in the last 45 minutes about the loud music. Every single time they have an event at Las Casitas, officers are sent there to ask them to turn it down. Why must the entire community endure this? I really feel sorry for the people who live directly nearby. Even if you love the music, Loud is Loud. What is the cost to the city in dollars and cents for the manpower and time it takes to send an officer out there two, three, four, five times in an evening to tell them to turn it down. Is the permit fee sufficient to cover the labor costs. There seem to be more events at “Las Casitas” this year than I can remember in the past and every event is loud. It seems the thinking is “OK, let’s see how loud we can really get this time.”

I am not against the music and enjoy some of it at a decent volume. I have several neighbors who are Hispanic that are upset with the volume levels as well as myself. If you are trying to enforce a prohibited noise ordinance coming from cars and house parties, how can a fee for a permit change that? Pay a dollar fee for a permit and then get as loud as you want?

What if the music were hard core rock and roll, or worse yet, Opera, would the Hispanic community embrace that? I pray to God the tornado sirens never go off during one of these events. In the meantime I will be investing in ear plug stock. Will the city be doing anything about this?

I feel bad for the people who live next to the fairgrounds. Those poor souls have to deal with revving engines all night long during the demolition derbies, tractor pulls and races. Talk about annoying! Then there is the hootin' and hollerin' that goes on at such events. Horrid...
Also, I imagine people living near ESU can't stand to hear the announcer on the loudspeaker during all the games and events that go on there. Don't even get me started on fireworks! No matter where you live, you're bound to be roused with sporadic to constant booms and bangs. Stupid people celebrating stuff... Why can't they show some respect for us people who never do anything fun? Oh, and thunderstorms...those are a pain. Why would god torment us with window-rattling thunder? Something needs to be done about that guy's lack of respect.

How about those loud intercoms and industrial noise, the train horns and interstate traffic noise? Throw in the bands at the ball games, extra traffic due to garage sales on early Saturday mornings.

Admit it's the genre that bothers you most Terry, everyone else who read this should recognizes it.

Really.....

I hear train horns all night long as well as Las Casitas Park, drag racers on sixth avenue, and the loudspeakers and bands at Welsh Stadium during home games. I also live in the flight path for the medevac helicopter coming and going to NRH. Noise is a part of everyday life....get used to it.

I agree with neighbor and bobhornet...it seems it might be the genre that is bothering you the most. In fact, if you can hear the music from Las Casitas Park, you have to be able to hear the trains all night long since the park and the tracks are right next to each other.

All I can say is ... I like " Dead Silence " even less than the everyday and night noises, that may be annoying . " Dead Silence " makes me wonder if I am dead, but when I hear the everyday and night noises of " Life " and some may annoy me, then I know that I am alive and able to enjoy life, good or bad !

I sent a formal letter of complaint to the city after an event was held in a parking lot near my house this past summer. It was a fundraiser, and I applaud the organizers for wanting to do good, but once again the city had issued a permit for loud music through midnight just 1/2 block from a residential area.

I first asked the people in charge to turn down the music (and quit blocking the alley), and was met with snideness. I then called the police who were able to make them remove the blockades and vehicles from the alley, but couldn't make them turn down the volume. Yes, it was a Saturday night, but that doesn't mean I and others in the neighborhood didn't need our sleep. Nor did I wish to be forced to listen to their music in my own home for 6 hours.

So far, no response from the city to my complaint.

And before you ask: no, it wasn't a Hispanic event or any other "ethnic" event; I'm probably one of the younger people who comment here; and I'm used to the trains and sirens and noise of living near downtown Emporia (I don't particularly like it, but I'm used to it).

I'm pretty sure we must live near each other, as I recall the fundraiser you were talking about.
And yes, I can hear the ESU games (I was a Marching Hornet, so watch what you say about the band!) and also the Live in the Lot concerts and movies. Some of the concerts have made me roll my eyes, and go inside and turn my tv up, but the difference in these events is that they don't go past "normal" bedtimes. And while I don't abide by that normal bedtime, I'm still annoyed when one of my neighbors starts cranking their music at midnight, whether I'm up or not. One of the reasons I chose to buy a house instead of renting any apartment any longer was so I didn't have to listen to my neighbor's music. Guess I should have moved farther away from campus.

The argument can be made that there are certain “noises” we have no real control over…at least for the time being. Trains fall into that category. But Emporia does indeed have a so-called noise ordinance and, like so very many other laws in Emporia, they basically go un-enforced. Music, whether it is from the cars cruising downtown or in this case at a public event, is, after all, controllable. First off, people should be willing to comply with a request to “turn it down” without hostility and sarcasm. To my knowledge disturbing the peace is not a “right” in our society, at least not yet. Simply stated, it is always a shame when people will not willingly comply with a reasonable request in the first place, or for that matter, put others in a position to complain when it shouldn’t be necessary. One would think that, after a certain hour, people would have the commons sense to know that a loud band or DeeJay is bound to be a problem for others.
So much for respect and common courtesy. Which, bye-the-by is where the law ostensibly should step in. If there is a noise ordinance enforce it. Or take it off the books.

We could re-route the train tracks outside of town. Heck, they don't even stop here anymore do they?
What about parades? All those bands, music, honking horns and sirens! Something should be done about this. Where's a cop when you need him? Oh, they're in the parade too... What if I work nights and I'm trying to get some sleep in my apartment on main street? Why doesn't the city enforce the sound ordinance during parades?
Then there are the spoiled little white kids who put big speakers in their fancy SUV's and blast "whitey" music all up and down my cul-de-sac. I have some white neighbors who also don't like it, so I'm not racist or anything. I mean, I like some of that whitey music at decent volumes, but come on! I wonder if the cracker community would be so tolerant of it if it was some sort of non-whitey music or, even worse, opera music.

P.S. I'm a "white" and don't really think the type of music or race of the people listening to it has any relevance to the issue. Ol' Terry Wells does, though. With the Republicans in office, we can expect more comments like Terry's in the near future. "If you ain't prayin' to our god, speakin' our language, and listenin' to our music, then you must be stopped."

What is wrong with us is a direct cause and effect of the current political climate. You can't have all the vitriolic rhetoric, hate, and anger that passes for political debate anymore with out it further spilling over in to other areas and further dividing our country.

I really have serious concerns for the future of America when we can't even disagree anymore with out attack and anger and hatred from both sides. If it continues it will tear this country apart.....I just hope I am dead before that happens. It doesn't have to be this way. There is an old fellow (Korean War veteran) that lives near me. He is an arch-conservative. Listens to Rush Limbaugh every day. We agreed at the outset not to discuss politics with each other. As a result we set on his front porch and talk about our respective wars....the nice weather......and women and good times we have both known. We like each other. The sad part is we can only like each other by ignoring our political differences....but by doing that we guarantee we will never be able to find common ground. And that failure is what will destroy us.

Just call that ole biscuit's prophecy...and Charlie Manson says...."we fear our prophets, so we kill them."

Yes.....I am not being a hypocrite....I am as guilty as anyone. When I am met with anger I respond with anger. When some body fights dirty with me....I fight dirtier with them. You kick sand in my face I'll kick rocks in yours.

But it doesn't have to be that way. Just because I do it doesn't make it right......anymore than it makes it right when others do it to me.

On a personal note. I have been in full battle mode since yesterday morning. I do apologize and will do my best today to get it fixed.

Bottom line. There is no need for the music at Las Casitas park to be so frickin LOUD. That music is so loud it is probably sterializing everyone within a half mile. The music could still be enjoyed at half the volumn and there is absolutely no excuse for the police to look the other way and ignore this problem. I have also heard them on our scanner telling each other "Wait until someone complains, or we had them turn the speaker a little, maybe that will help". That music was so loud the last time I drove down South Avenue, it peeled the paint off my truck!!!
Jeeezzzz, Just turn the music down already!!!!!!!!!

Loud music gets on my nerves but especially loud music in Spanish. Let me explain. It makes me wonder, how is it that there are hundreds of people congregated over there that understand Spanish that well.

And, given the current status of our southern border, I then get to wondering, how many of them are here illegally? Now before you people go off on me for being racist, stop for a second. That is not racism it is prejudice.

I also feel the same way when I'm behind someone in Walmart who cannot speak english and is using food stamps. Except that I also wonder how someone who cannot speak english and is probably here illegally came to be on food stamps.

Why would someone like me, a person with legally hispanic close relatives who I love jump to the conclusion that people who speak spanish only might be here illegally?

I'm not saying that I don't feel for these people, whether they are legal or illegal. But if they are illegal they are basically stealing. And the ones who are here illegally are making things bad for all of them.

Think about that.

For once I am not really arguing with you on your basic premise that most people that are here illegally speak little or no English. I do want to point out though that I too have Mexican in laws, some of which I love dearly, they are all natural born American citizens of parents that were naturalized American citizens. Most of them are bilingual and they speak Spanish around the older members of the family because the older members are more comfortable speaking Spanish.

Any bilingual person will choose their first language over subsequent languages, given the choice, because you are always more comfortable with your first language. So many English speaking legal aliens still speak Spanish whenever they are with other Spanish speaking people because it is their first language.

So just because a person is speaking Spanish does not necessarily mean they are here illegally. And the last I heard it was not illegal to speak any language other than English in this country....nor to play ethnic music either.

I wasn't saying you were a clown at all, I'm sorry you took it that way. And I don't agree with the gazettes argument that anonymity is a bad thing. I'll respectfully retain mine until the gazette stops allowing it, at which point I'll leave.

Still waiting....and waiting....and waiting.....There are conservatives on these boards that I respect and even like.

Ones like open_eyes, tbluma, bluelightspecial, and several others. They give thoughtful reasoned arguments to support their beliefs and have even been known to change my mind at times.

Then there are the anonymous clowns.

I hope I don't get the ones I mentioned by user name kicked out of the conservative league for actually using thought and reason to present their case.

Just wondering if it was a country western or rock in roll concert if it would be tolerated as much and as often.

I hope you get a chance to see the cartoon, biscuitboy, especially since you are prominently featured. It's really rather good. I can't quite make out who the cartoonist is, however.

I like the sign in the background that accuses the 4th Estate of being for sale -- something I've heard quite frequently on these threads.

Since I am about the only poster on here using an anonymous user name that does sign post when I feel it is important, I do wonder why they singled me out. And of course that might be the reason they did. Whatever the case it is a good cartoon....and like Lindsey Lohan always says....Hell, bad press is better than no press at all. At least I know I have their attention.

I believe what your knickers are really in a twist about is the fact that I called you a hypocrite yesterday...I stand behind that statement today. When it pertains to the comment you made on a different thread yesterday. Each comment and each discussion are different and individual. We agree on some things, but not on everything and that is fine. It doesn’t really change anything one way or the other. It’s just a forum on the Emporia Gazette. Keep it in perspective.

I just returned from the Gazette office where I got a copy suitable for framing and it will soon be hanging on my wall. Also had a good laugh about it with Chris and he said my name was used because I am one of the most prolific posters on here and consequently a name that would be widely recognized.

I was all in a bunch to start with partly because I couldn't see it until seriouslyfolks linked it to me and was imagining something much worse....and partly because you and I have had a couple of heated exchanges in the past so I saw it as a personal attack. I will be man enough to apologize for overreacting....and look forward to having more heated exchanges with you in the future.

Personally I think the loud parties should move to the country. Most of us work hard to buy our homes and expect them to be the way we want them to be inside them. If your music penetrates my walls that I am paying for and paying taxes on then you are treading on me. There is no reason to play music so loud that it can be heard through an insulated exterior wall of a home several blocks away. If you feel that you have the right to tread on me in a way that you see is ok, should I also have the right to tread on you in any way that I think is ok?

wait, wait, the country is too loud already. no peace and quiet here between the 30 to 50 dogs living 100 to 300 ft away, the roosters, chickens, geese, ducks, rabbits and cats and dogs. huge dogs oh i really can't forget about the 4 peacocks. they will wake you up in the middle of the night. gimme a band anytime, one family has close to 50 animals on 1/3 of a acre. plus the 12 or so humans living on that piece of land. anyone ever hear a peacock at 3 am?

I easily sleep through train horns, loud cars, and sirens, but when the music gets louder with each passing hour and its thumping my walls, I thinks the music is to loud. Complaining was pointless, I was told they had a permit so they could carry on. Not everyone has weekends off and it pisses me off that someone can have a permit to blast their music as loud as they do at the park.

As the crow flies, I live about five to six blocks from that park. I can walk two blocks from my house and see the park across the BNSF yard.

When I am outside on a summers eve I can hear the music quite well, inside my house when the windows are closed it doesn't sound much worse than my neighbor's TV. It is a little louder than the trains while it is happening but it doesn't happen remotely as often as the trains.

It seems to me that some on here are being very sensitive to something that I don't see as a problem. Of course music to one person's ears is a terrible noise to another...depending on your perspective going in.

But speaking from the vantage point of one that lives much closer to the park than our letter writer, I say it is no big deal. Plus winter is coming on now so for the next few months Terry should have a respite to sooth his/her sensitivities.

I live less than half the distance of our letter writer from the park. In fairness though I must say the problem might be a much bigger deal to me if I only lived two blocks from the park, or even worse right across the street. For the ones that are just driving past on South Avenue when they are so bothered, might I suggest they try Sixth Avenue. Unless you are going to the tipping station you will end up there anyway.

Well just to let you ya'll know that as a person who has organized events at Las Casitas Park, there have been times when the dj or band was just unloading their equipment when we had a visit from Emporias finest already telling us that people were already complaining about the noise level. Hell nothing was even plugged in! These people must have been psychics??? LOL....VR

They were probably going from past experience and didn't want the baby woke up when the music started thumping! I'll bet dollars to donuts that if OSHA showed up at any of these events they would shut them down because of the decibal levels! Harmful is harmful and music this loud is not enjoyable. Move your venues out of town and stop making these people suffer. No consideration for your fellow human beings.

I did miss a couple of things....I've had two divorces and several traffic tickets. I also ruined my credit with the drug problems....and there was a sweet little girl that I treated like crap when I was too young to know any better. Just last year I finally got the chance to apologize to her. She forgave me which is something I wouldn't expect you to know anything about. I used to drink to much.....I still have a temper and a potty mouth.

Boy Oh Boy, I really wasn' t going to comment on this issue either, but I believe it is time for everyone to take a " testosterone " lowering drink of Jack Black, Jim Beam, Coors, Bud or something and calm down . We have all made mistakes in our lives, some bad, some not so bad ! Point is, if you don' t make mistakes and learn from them, you are not " Human " ! I have made my share, and learned from them . I have even gotten into some pretty nasty, heated arguments/debates with just about everyone on these threads, but have apologized, when warranted and moved on and some of those I had heated words with are still talking, arguing, bantering and joking with me.

And being loud, obnoxious, disrespectful of others and law breaking is not an inherently ethnic or social class problem !

I am just wondering what the people who live in close proximity to the Music, think about it !

Just yesterday, while I was on my way to pick up my sister from work, while stopped at the traffic signel at 12th & Industrial, a person in a fairly new blue and white " Viper " stopped behind me and the stereo was so loud in this " Thing " my rearview mirror was vibrating like it had " St. Vitus Dance " ! I don' t see how anyone can stand to have there music that loud in an enclosed vehicle, unless they are " Deaf " or something ! It was bothering me and I have lost 40% of my hearing ?
I have found in my life there are things you will have to endure, even though you really shouldn' t have to endure . Thats just part of living and life !

(LMFAO!) Justaflushaway, I don't know how you would know this, but I have been called "HotDog Fingers" by a few woman friends of mine. Either way, I had to go back and reread what I posted. I was just mentioning that it doesn't take Loud music to get the law called on us, it can be just the action of unloading the equipment. And without getting into the science of the wind and soundwaves, I can tell you that I have tried to keep the sound to a minimal during our events. But there are other aspects of nature and sound that tend to carry the music clear across town. But hey thanks for the laugh.... And for the record, yes I sometimes had to type with a pencil or else mty poistys woiulfd somntimnes look luike this with mny Hotdsog Finghersd.

I have heard people talk about their loud thumpity thump music and their reasoning for having it so loud, they say it is essentially to "upset" other people. Of course they didn't use such nice language. This isn't a problem of a particular "race" it is a problem with immature people(I know, I know, I'm one to talk. :-) ). The people I heard/hear talking about their loud music and "parties" aren't teenagers they are "adults". If they were teenagers I could understand but I would think that as people get older they would grow out of feeling the need to do such things but I guess not.

I have been told by some, that I have been in my second childhood for a while now. This may be because I still get a kick out of a good practical joke, someone telling a good joke, a good cartoon or animated movie and I still get a big kick out of " Disneys', Fantasa " , Donald Duck, also Tom and Jerry cartoons and I think " Popeye " is the absolute funniest thing I have ever had the pleasure to watch ! In fact I like it so much I have made " Popeyes " little saying my saying, you know, " I am what I am and thats all that I am ! " This is what I will usually tell people if they say I need to change or conform !

However I do have a penchant for " Classical " music and Rock and Roll of the 60s, 70s, and 80s, which I don' t believe any of the younger generation particularly like !

These people who call the law and complain are not psychic, they more than likely know that from seeing the sheer size of the amplifiers, speakers and etc. that the sound coming from these monsterous comtraptions will be at least 180 + decibles, and will be heard most likely in Americus, Olpe and Hartford !

The only question I have is, Why the giant amplifiers and speakers when the people that wll be entertained will be at the, not that big of Park ?

Again this all comes down to respecting others " PRIVACY " .
When the " Music/Noise " can be heard upwards of 2 to 3 miles away, that is absolutely " Disrespectful to others.

I am not saying that you do not have the right to celebrate your ethnic heritage or to have a party, but respect for others will go a long, long way in being accepted !

So my advice is, it does not take a 10,000 watt amp. or 4 ft.X 6ft. 10,000 watt speakers to have a small private party !

Thank God, winter is not too far off !

I love all the same music you do.I was talking about intentionally acting like a fool to make people mad or to "stick it to 'the man' ". Stuff that teenagers(including myself) do/did in the rebellious years.

We know there is no need turn up the music so it can be heard through walls several block away so they must have an altererior motive to do so. I meant no offense, I was just relating to how a lot of people I knew and know tell me to " grow up " when, at times, I act a little silly and regress back to my younger more carefree days . You know those days when you had less stress, gave and recieved more respect than today, because your parents taught you a much different lesson about life than is taught today !
