A notice of termination has been issued to a local home health care agency by the Centers for Medicare and Medicaid Services because of unsatisfactory compliance with regulations.
The Gazette received a public notice this week that ViaCare Home Health LLC, 332 Neosho St., operated by Via care Home Health LLC as a home health agency provider, has been found not to be in substantial compliance with Medicare regulations for Home Health Agencies. The legal notice stated that the Medicare Program will not make payment for post-hospital extended care services furnished to patients after March 21.
“For patients whose plan of care was established on March 21, 2010, or earlier, payment may continue for up to 30 days of post-hospital extended care services furnished after March 21, 2010,” the legal notice stated.
Mike Fierberg, public affairs officer for the Centers for Medicare and Medicaid Services, said Wednesday afternoon that the agency is required to publish the notice of termination.
“They are on track for termination if they don’t correct the problems that we have discovered,” Fierberg said. “We’ve basically notified them that unless they reach compliance, the prospect of termination is definitely there.”
Fierberg added that ViaCare is in the process of coming up with a plan for correction. Information from ViaCare was not available by press time.
“Frequently what happens is the termination date is extended if the process hasn’t been completed ...” Fierberg said. “I know we have been talking with them in terms of getting this fixed.”
Fierberg said the agency’s first priority is the safety and well-being of patients and the agency is not there to close them down if progress is being made.
The process of correction requires the provider to submit a correction plan and they are reinspected without notice.
“What usually happens more often than not is that compliance is achieved and they go on serving their patients,” Fierberg said.
Fierberg declined to talk about specific violations.

Here we go again. This again proves that there is more fraud with these programs and nobody does much to correct it. The claim is that they don't have enough IRS people to police the program. Bull crap we have laws on the books to take care of this and nobody has the gump to inforce it.

It's good to know, however, that problems were discovered and serioius enough to involve termination of services. At least Medicare was vigilant here. I hope it continues.
Yes, kciddor, I agree with you. I'm guessing that these programs have been rife with fraud for a reason -- nobody has been watching the treasure. It's been way too easy to bill for services that were never provided, or provided poorly when no agency existed for policing providers.

Yeah, the government loves big programs that are easy to fraud. Why should they be concerned about it? It's not their money, it's ours. It baffles my mind that the government has proven over and over again that it can't run anything efficiently and there are still so many people wanting more and bigger government programs. As a former employee at Via I would like to say that the nurses who worked there provided the best care possible and were lied to and decieved by the owner! To make things even worse the owner put a stop payment on our paychecks not caring that we have families to provide for making our lives hell over the last week! These people are cruel and don't give a darn about anyone but themselves!! You try to call the Dept of Labor and you get "fill out a claim and submit it!" Who is going to pay my rent and bills until the dept of labor has the time to deal with the issue? I didn't know I had to do a back ground check on my employer, it's usually the other way around!! What has this world come to?

I'm sorry this has happened to you, tryingtomakeadifference. But one thing you must not forget to do. Document everything and save every piece of evidence you can. All of you need to get together and sue these people for all they are worth. There are many lawyers in this town who you can hire. Go get those crooks. And yes, fill out those claims at the Dept. of Labor. Make a lot of noise. Those crooks own something, bank accounts, cars, house...and you need to go after it.

The correct location is 1811 W. 6th Ave, the other was their old address. The owner is Jeff Phillilps and he has his girlfriend Joann and his "assistant" Jamie running the place. The sad thing is they are in there conducting business as usual while the nurses are still waiting for their pay! If you look up Ms. Moffitt's address that is on the legal KS document you will see that she and Jeff live in Olathe in a house appraised at over $400,000.00!!! Why would you run a back ground check on someone who you already know is a con artist and is your GF? They sure had us fooled!

Jeff Phillips is not allowed to own long term care facilities in the state of Kansas anymore so he has all of his businesses under his girlfriend's name. This is the same Jeff Phillips who can fly to China Town for Chinese food but cannot pay his employees.

As someone who has been "there before", I STRONGLY suggest that you file your complaint! I am sure this is not the first time either of them has taken advantage of the system and people who work for them. I know it will take time from you - but think of what else these two could do if you don't. Contact others that worked there and have everyone file! You all could make a difference!

i to also use to work there and on sunday it will make a month that i havent worked there and i still have not been paid for the last 2 weeks i worked therel. I have turned them in and am still waiting for reply from them. They do not answer my calls or call me back. I wish they would get closed down so that the people that are paying are useing there money for there care and not being cheated!
