Mundy guilty on six counts

A jury deliberated about four and a half hours Friday before bringing in verdicts convicting Vivian Mundy of six counts of making a false claim to Medicaid.

Mundy was found not guilty on one count of making a false claim for payment for consecutive hours of service, but not accounting for driving time, and not guilty of concealing or destroying records.

Mundy is owner of Cognitive Care Connection, 1101 Commercial St. The company until late last year also had an office in Topeka.

Mundy provided therapy to Medicaid clients who suffered from traumatic brain injuries.

After the verdict was read, Mundy was ordered to report to Court Services to make an appointment for a pre-sentence investigation. Judge Lee Fowler set sentencing for 1 p.m. on April 20.

The jury found Mundy guilty of false Medicaid claims in billings for: overlapped time, undocumented services, services for time she was shopping, therapy sessions for clients while simultaneously billing for other clients during potions of the same time period, claims that already had been submitted to Medicaid. She also was found guilty of obstructing a Medicaid fraud investigation.

With the exception of Count 2 — billing for overlapped time — all of the fraud convictions were for dollar amounts greater than $1,000 but less than $25,000. Count 2 involved $25,000 or more.

Mundy has to be one of the many people that are much smarter then she would lead you to believe. This sort of crap goes on all the time and they know the system doesn't have near enough people to ride herd on them. When Johnson put Medicare in place in 1965 they didn't have a clue as to how to police this and never have done at all well and people like her are aware of it. And acts like she never had a clue? Give me a break. I'm betting all she will get is a slap on the hands and perhaps a 1 year probation.

She needs to be locked up and the key thrown away... what she has done is prey on the disabled for her own gain. She is playing the victim and blaming others for her own faults. There is no excuse for what she has done...

In addition to jail time, she also needs to repay the system for all that she has bilked from it. Sell her belongings if must be. The system is you and me, and she stole our money. I'm glad that justice has been done.

kciddor, you're right about not having enough people to ride herd on crooks like this woman who have figured out an easy way to bilk the system. Just this week I read about a medical practice in Florida charging Medicare millions and using the names of two doctors who have been dead for nine years.

They need a task force just for investigating Medicare fraud.

With the odds of getting caught next to nothing, money to be gained, and laughable punishment, it is no wonder everyone and their dog is defrauding the medicaid/medicare systems.

I agree with genexer. This sentence is ridiculous! She needed to be put away for a long time as punishment for her and a warning to others who have schemes for defrauding the system.

Yeah thnx for the update.. the Gazette sure wasn't going to cover it. According to the KS AG's office she also received a sentence of 18 months is the state penn, suspended pending payment of the restitution, but if she misses a payment, off to the penn she goes. And yes it is only 60 days but anyone who knows Vivian knows that those 60 days are going to seem like years to poor sheltered lil Viv. No more casual lunches at Red Lobster on my money honey!!! Anyone know how to get a copy of mugshots from Lyon County? I'd sure like one :o)
