The driver of a cattle truck got more than he may have intended Thursday morning when he drove his tractor-trailer unit onto the scales at Ag Choice in the 1000 block of Road 80 near Olpe.

The driver realized his waste traps were full, and he needed to unload some of the weight, so he backed the unit down Road 80 to the west, opened the traps and allegedly dumped more than a ton of manure onto the roadway.

The action did not go unnoticed by neighbors, who saw the driver return to the scales. Kansas Highway Patrol Trooper Elwood Phelps responded to the call and, after investigation, learned where the driver was headed and that he would return later with a load of cattle.

By comparing weight tickets, Phellps was able to determine how much manure had been dumped.

“He came back, and he was 2,700 pounds lighter,” Phelps said.

Phelps issued a citation for littering to the driver, Thomas Clark of Pipestone, Minn.

Lyon County Road and Bridge Department was preparing for the road clean-up this morning.

Good job Trooper Phelps for catching this guy.

I wish the driver Thomas Clark would have been detained and handed a shovel, or maybe have to use his hands, to load everything back up into his truck and dispose of properly. Then, take his CDL away permanently and put him in jail for a while. What other kind of illegal actions does he do?

I hope Clark is also charged by the EPA for this illegal dumping and has to deal with them. The EPA is always monitoring livestock producers along Eagle Creek to be sure there isn't too much run-off. Deliberately dumping 2700 pounds on the roadway should definitely qualify as an offense the EPA could charge Clark with.

Thats totally disrespectful to the county workers who keep them roads maintained and such, I think the driver should have to clean that mess up.

I wouldn't ind if someone delivered a load of manure to my garden. Just ask me first so I can show you where to dump it. :-)
