No interpreter, no hearing

A family emergency left a Lyon County District Court without a qualified interpreter this morning for a preliminary hearing in a case that resulted from the shooting death of 25-year-old Jose Levya Arroyo, also known as Samuel T. Rosado.

Today's hearing was for Jorge A. Jurado, 22, who has been accused of aiding and abetting in first-degree murder and aiding and abetting in attempted first-degree murder.

Another man, Juan Jose Rosales, 28, was shot and injured as he and Rosado emerged from Rosado's garage in the 600 block of South Union Street early on the morning of Dec. 20, 2009.

"We were notified late last night that a large number of witnesses ... would need an interpreter," District Judge Lee Fowler said after court convened around 9:45 a.m. this morning. "That interpreter was not able to attend today because of a family emergency."

Fowler said that court personnel had been trying since 8 a.m., but had been unable to locate another qualified interpreter.

He ordered the hearing postponed until 9 a.m. on Friday, Feb. 26.

The hearing will be before Magistrate Judge Doug Jones, who has agreed to come to Emporia that day from Chase County District Court.

Witnesses who had been subpoenaed were dismissed for today and were told by Fowler that they would be entitled to regular witness compensation and, whether they receive another subpoena for the next yearing, they still will be required to be back in court on the 26th for Jurado's preliminary hearing.

Jurado was the second person arrested in Arroyo's death.

Jimmy Anthony Dominguez, 32, was arrested Dec. 24 and charged with first-degree murder and attempted first-degree murder. He is accused of shooting Arroyo.

Jurado was arrested on Jan. 8 at the home of a family member in Kansas City.

According to earlier information from Emporia Police Lt. Edward P. Owens, local detectives worked with police in the Kansas City, Kan., area and arrested Jurado without incident.

Police said that Arroyo and Dominguez had been at a dance at the Anderson Building on the Lyon County Fairgrounds the night before the shooting. An altercation between the victims and the alleged assailants occurred before they left to go to a local bar.

Arroyo and Rosales later went to Arroyo's home and were drinking in the garage at the home. They were shot when they stepped outside the building.

I would think they'd have several people "qualified" to interpret in Emporia. I wonder what you have to do to get that gig? Like seriously said, bilingual people are needing work right now. Poor foresight on the part of the court to only have 1 or 2 interpreters on tap in a town with a fairly large Spanish speaking population.

Just because someone is bi-lingual doesn't mean that they are qualified for the job. One has to be qualified and appropriate to interpret in court, pass a background check, and have a basic understanding of the court process, not just know Spanish.

I can't believe there are so many Haters in this town. Most of them seem to be white no less. I agree that the illegals do not mean only Mexicans, and as far as I'm concerned I know alot of hispanics "Mexicans" as you all seem to think they are from only one country..lmao...but no less, I know very few of them that are rude, I know alot of them here in Emporia and believe me the white race is a whole lot worse in the rude department than the mexicans. I am white and am ashamed of how my race always seem to be the first to be so judgemental. Now for the question about how much an interpreter gets paid...I have also done this work for the court and police and I was paid $20 an hour. That may seem like a lot to some of you folks, but believe me its a lot of work translating everything. My belief is that there should not be a lack of interpreters here in Emporia, I for one was not called for this and I am on the list for this service as is two of my friends which also were not asked to offer their services.So I believe the fault lays in the hands of the court system. As far as the wet back statement goes, whatever, it fits right in with all the "white trash" posting all their negative racist thoughts. God Bless

I too understand and appreciate the thoughts of Teddy Roosevelt on this issue....and agree that assimilation is necessary to truly become a citizen...not just a resident....of any country. But what might be refusal to assimilate to one might just be pride of heritage to another.

Does the wearing of the green, and the Erin Go Bragh, signs of St Patty's day reflect a good natured attempt to celebrate Irish heritage....or is it a holding on to dual allegiances? The same can be said of the various Saint's Day celebrations that are common on the East Coast in the Italian communities where Italian flags are flown and the Italian language is still spoken. American culture is a hodge-podge of cultural celebrations and customs from around the world. We borrowed the fireworks we use for Fourth of July from the Chinese...and the hamburger came from Germany.

It seems to me the only time the recognition of culture seems to ruffle feathers is when those cultures being recognized are newer to our shores and are from south of the border. But then much of the clothing and working tools of the great American cowboy was borrowed from the Spanish and the Mexicans...as well as the names of most of our Southwestern cities.

If you remove from American culture everything we have assimilated from other cultures....hell buddy....there won't be anything left. Nothing but the culture of the indigenous American Indian....and even their name was derived from Columbus's believe that he had landed in India. So just where do you want to start demanding that everything be American? If it wasn't for everybody else there wouldn't be any American.

I was just talking about football seriouslyfolks. I personally don’t know any Europeans or Latinos so I can only base my comments on the football games I have watched on youtube. It appears that the football games played in Europe turn into a spectator riot in the middle of the game where the football games played in Latin America don’t turn into a spectator riot until after the game is over. American football teams wear helmets and stuff pads inside their clothes and the football isn’t round and they hold the ball in their hands like a bunch of Sissies.

Why would court personnel say that they had been trying to get ahold of interpreter's since 8am, when the above poster and 2 of her friends didn't receive calls. With this being a Lyon County court, in Emporia, KS they would have known interpreter's were needed for this case, and contingency plans should have been in place with backup prior to the emergency. Can we say ineffeciency? Court services better get to the bottom of that so the waste of taxpayer time and money isn't repeated in the future.

The discrimination based upon race and color was implied in the blogger's comments.

How trite it is listening to persons complain about "illegal immigrants" only to use tax dollars as a front to cover up for their prejudices. If a Caucasian who had just arrived from Europe were to ask for a job or a handout, I'm certain the treatment they would receive would be much more hospitable and kind.

seriouslyfolks.... I don't have a prejudice bone in my body, I love people from all nationalities. Color and race has nothing to do with a persons heart or that persons right to be treated the same as any other person would like to be treated. We, every color and nation, were created equally. When will people start treating each other with a little respect. If a certain person treats you bad...remember "that" person...not every living being of his nationality. I apologize if I came off with the attitude that I am against the white people as I realize not everyone who posts on here are white...Instead of saying "I am ashamed of how my race always seem to be the first to be so judgemental" I should have used the words "fellow americans" The real problem here is we can never change a hater, nothing that anyone does is going to please this type of person. I'm just real tired of seeing people post hateful comments about mexicans...cmon, lets be real here, there are a lot of law abiding, caring respectful hispanics in our community and these hateful comments effect them too, it effects everyone who is not racist towards any nationality. I remember about a year ago here in Emporia when a woman stabbed her boyfriend and he died...seems awful funny nothing was posted about her nationality being the reason for why this happened, oh wait.. I just remembered...she wasn't "mexican"...

This video says more than any words I could say here. Just goes to show, don't judge a persons legal status by his nationality, not all Latinos in our town are here illegally. So please get facts before you make judgement. How would you feel if this happened to you if you were visiting a country and didn't speak their language and no one gave a damn one way or the other why you were in their country to begin with, you don't speak there language. Thankfully here in Emporia we do have people that will stand up for the Latino community.

My sister in law is Latino with family roots that run deep in this town. Her family is as nice a group of people as I have ever known They have accepted my brothers family into theirs as their own. That is why I am so deeply offended at so much of this ignorant stereotyping that starts to rear its head whenever this issue arises.

Latinos are just like everybody else. They have the same dreams and hopes as the rest of us and that primarily translates to leaving a better life to their children than they had. So what's wrong with that?

Basically I understand that goodoleboy and I can generally tell the difference between the one's expressing legitimate concerns and those expressing hatred. But as open_eyes is always telling us..there is always a few that makes the rest look bad. But I guess the same can be said of a few latinos.

My family roots on this continent began before Cristobal Colon was born. Europeans immigrated here illegally and stole the land and forced my ancestors at gunpoint into death camps and gave them blankets infected with smallpox. They used my peoples land for profit and cheated each other so much that they declared independence and fought a war and instituted a constitution based upon the belief that all men are endowed by their creator with certain unalienable rights. Among those rights were life liberty and the pursuit of happiness. Yet even after that, they sent armies against my people murdering women and children so they could take more land for their European brothers to exploit with their African slaves. So today when people who are native to this continent move north and exploit the niches created by the Europeans I chuckle and eat some Mexican food and drink German beer. No speaky engles? That's alright, not many here do either.

3.) justice system related costs
4.) lower wages for blue collar workers
5.) burden on the schools(some have to be put into special classes so they can be educated)

Need more? I can go all day but the end result is HIGHER TAXES for everyone because we have support criminals that cross our borders and guess who gets the bill. The day our tax dollars do not support illegal immigrants and their progeny is the day you won't hear a peep out of me about my burden.

Hospitals cannot refuse emergency medical care so anyone who shows up must be treated. The hospital is reimbursed some of that money by the taxpayer and the rest is added to the paying customers bill. After the illegal alien has a baby here in this country, that child is eligible for benefits. Technically, the illegal isn't getting welfare, their newborn anchor baby is getting the benefits. Since nobody in the house will speak english to that baby, when it is five years old the people paying property taxes will be forced to pay for special english lessons. Not having to repay the hospital and getting WIC and welfare, the illegal has money to mail back to Mexico which encourages someone else to sneak into the EEUU and make a go of it. Why not? It's free right?

Yes....my sister-in-laws family came here legally also....and some of them have been in the Emporia area longer than my family has. I also recognize illegal immigration as a problem that deserves much more attention than it is getting. But I also blame it as much on the people who are hiring the illegals as on the illegals themselves......and those people are profiting from it as much or more than the illegals in many instances.

But I have no problems with expressing anger and frustration at the illegal immigration problem. My problem arises when some posters can not stop themselves from turning it into an opportunity to use ethnic slurs and stereotypes to denigrate a whole group of people with an undeserved hatred. That's what gets me all riled up.

It is scary when tbluma agrees with me. All I was dong was answering a question that missy_mms_2008 asked. That still doesn't say how to know if someone is an illegal alien.

Education required to become an immigration law specialist includes a four year college degree, three additional years of law school and passing the state bar examination.

Our police are required to complete a basic police officer course where they are trained to leave immigration enforcement to ICE.

The only way to know if someone is here Illegally is if they tell you they are here illegally and that doesn't hold up in court unless you can document that you informed them of their rights. You don't speak their language and they won't talk to you in your language so you can't know if someone is illegal or not.

All of my acquaintances here illegally have told me all about their journey because they trust that I will not rat them out so I won't.

The way I always understood it was that you have no obligation to report the commission of a crime. If you witnessed a crime being committed and did not call authorities...authority could not come back to you later and charge you with failure to report.

If they then start questioning you about what you saw.....you do have an obligation to respond. But even then you don't have to tell the truth. If caught in the lie however you can then be prosecuted for that...but that usually would only occur if you had sworn an oath about your testimony.

I'm not certain about any of this so trust it at your peril. But one more point to keep in mind, when dealing with law enforcement at the street level....the law is often what they say the law is. They hold all the cards.

But from a legal perspective...my guess would be that the crime would be entering the U.S. illegally...which I presume he did not witness....all the rest would be hear-say. That's because they are under no oath to tell him the truth and might just be making things up...or he might be making things up.

As to any other crimes he may be referring to I will let him address that himself.

I really don't know about that. I am fairly certain there are other charges that can be applied to an illegal that occur after he enters the country. And I am equally certain that ICE can determine that an illegal entry was made without actually having to witness the entry.

But koalemos does not have access to the documentation necessary to make that determination....so in the absence of his witnessing the entry.....he is only taking their word for it that it was an illegal entry...and that makes it hearsay. If it is hearsay then all subsequent violations based on that illegal entry or also hearsay......because the only reason he knows they are here illegally is their unsworn affirmation that it is true.

Its like I could tell you that I had murdered somebody. You could go to the police with what I told you and they might well come and question me about it. But all I would have to do is say....Oh I was just shining him on and making things up...and in the absence then of any concrete proof that such a murder did occur.....they couldn't even file charges on me....much less convict me of anything.

But hey.....I'm just being the frustrated lawyer wannabe that I am and am arguing for the sake of argument. Nothing personal.....just arguing for fun.

I wish the cops would deport my neighbor but he was born in the US so he gets to commit crimes scott free. My illegal alien friends help me pick up that stuff and they help me weed my garden. I like drinking their beer and watching them stack stones or chop down trees. Illegal aliens are hard workers and if they like you, great friends. Plus they get great prices on meat from Tyson. My gringo neighbors wouldn't help my with my garden or get meat for me so I don't care if my friends are here without papers. When this shooting happened they told me all about it. I knew more about it that the paper could tell. It is a real tragedy but like they say down south...que sera sera.

Myself I don't care if they are here legally or illegally. If they are here to work and abide by the law then fine, the ones that don't should go back. I'm waiting for the day when all the illegals get deported and the prices sky rocket here in the good old USA. Many of you say that illegals take the jobs away from our fellow Americans. Many of the illegals are filling the jobs that our citizens won't do. Why? Because no one wants to go work in the fields 10-12 hours a day making $6 an hour. So, when they all get deported. I'm going to sit back and watch all the people crying and sobbing over having to pay $4 for a head of lettuce, $7 for a pint of strawberries, $9 for a bag of oranges or apples, everything will sky rocket once all the illegals are gone.

I worked for an organization in Wichita for 5 years. We would (try) to find jobs for people whom were unemployed. On a percentage of 100 people, 90 of those refused a job because it paid under $6.00 an hour. I recall so many unemployed people stating they wouldn't take the job because they were worth at least $9 an hour. Okay, so it's better to stay unemployed and sometimes on the street than to accept a pay check of $230 a week. In my eyes I don't think so, but this is a common problem all over the U.S. Once all the illegals are gone, expect the prices to sky rocket, because then these companies will be forced to hire employees expecting to be paid $10 - $15 an hour. ( And it will happen one day.) So all of you go on and whine, get your blood pressure all out of whack fretting about getting all these illegals out of our country, then when their gone you can whine and fret all about the sky rocketing prices. LMAO Dammed if you do damned if you don't situation.

The amnesty back in 1989....Our good ole Government messed that up too...I'm all for amnesties, but the Government left out an important rule in order to become documented workers in the U.S. > All immigrants must learn to speak English within 6 years to remain in lawful status. All those people whom were given legal status in the U.S. back in 1989 were in no way obligated to learn the language here. I think the problem with you theory is that the ones immigration allows to come in legally are the one's that are qualified to make 25-40 dollars per hour. The trained ones with marketable skills that take jobs from us.

The ones with no marketable skill except their bodies are the ones immigration will not allow to enter legally. The ones that might gain some from being able to pick our cucumbers legally.
Now, I wonder who set things up this way.....I'll bet it wasn't the Mexicans. You don't suppose the employers who are capitalizing off of filling their low end jobs with cheap illegal labor might have had anything to do with it do you?

If the illegal was legal and could speak english there are serveral jobs that have the opportunity for $50K
plus insurance, pd. vacation, and retirement.
High school grad. or GED is not really necessary, but they would need to be able to learn.

No argument there tbluma. All immigrants (legal or otherwise) would be so much better off if they would just learn the language. That doesn't mean they have to give up their own language when with friend and family from home.....but their earning potential goes up greatly when they learn to speak English.

Of course it takes time....especially for adults....and we should be patient and helpful. The lady from Cuba I just mentioned. I help her practice her English...and by so doing...she is teaching me more Spanish. It is a win--win.

More than likely I spend more time with people of different races and creeds than anyone on these threads. Some people I get along with great, some not. Race has never been an issue for me. I give everyone an equal opportunity. When I met someone I great them with a smile and keep that smile on my face toward them until they give me a reason to change my attitude toward them. The one thing that everyone on this planet has in common is that we all would like to think that we try to do good better than the next guy and none of us like it when we are belittled by that guy cause we are better and that guy either doesn't understand or he is doing it on purpose which is bad so the other guy is the bad one and we are on the side of the angels and if you point out that someone in our group is bad so we'll point out that you can't judge the whole group by the actions of one rogue person. That would all depend on whether I understood you correctly or not. Even in environments where everyone speaks the same language some people become offended due to misunderstanding. The same can be said of so many of these super-patriot types that equate the exercise of freedom with blind obedience to patriotic bells and whistles. Question the bells and whistles and you must hate freedom. The true lover of religion or freedom either one however is the person that recognizes both can be practiced in a multitude of ways different than our own.

All I was trying to inject into this discussion is that there are more ways of getting here than wading across the rio grande. There are people who are tricked into coming here too. Many of the people who are here illegally didn't know they were going to be outlaws by being here. If you don't believe that Tyson doesn't recruit illegal immigrants your naive to how the world works.

If you don't believe companies recruit illegals consider this. Back when Tyson was still running the kill floor operation here I ask a group of guys how they found their way to Emporia, Kansas of all places. They said recruiters down on the Tex-Mex border tells them about here...gives them names of people to see...and sometimes provides transportation to bring them here and drop them off at Tyson's hiring office. Sounds pretty organized to me.

Who said they didn't believe that Tyson and other companies try to get cheep labor? What does companies trying to get cheap labor have to do with illegal activity? Are the lowest paid people working at Tyson better off than the average person in Mexico?

The more I think about the many and great opportunities people have in this country the more thankful I am for the capitalistic ideals that built this country and provided those opportunities.

A summer or so ago, I witnessed a ICE protest. My thoughts and sentiments were, if you have done no wrong, you have nothing to fear. I am sure there are people that are here under false assumptions, but I am confident they are the minority, and there is always the fact that as they find out the truth it is morally compromising of them to continue residing here knowing they are in the wrong.

My thoughts and sentiments are, If the government sends armed men to your workplace checking everyone's papers, you have everything to fear. I never carry my birth certificate with me to the job site. Of course my skin doesn't have a whole lot of melanin so nobody ever bothers to check my papers. YET.

There are legal ways to work here in the USA. Say you have a big farming operation and cannot find enough American Citizens in your area to help you farm. Then you can apply for temporary worker visas to fill your human resource needs. The workers you will get will come with representatives who will ensure the work conditions are tolerable and that the workers are not being subjected to unlawful employment abuses or practices. If you can meet the requirements, you will have a steady flow of temporary workers at hourly rate determined by the governments prevailing wage for the job title. Or, you could just contract out the planting and harvest to someone with a crew of undocumented workers and save all the hassles with documentation and inspections and tax withholding and payroll and just get your crops to market and count your profits.

When I was a young guy living predominantly with people of Mexican descent....I learned the color of your eyes could be pretty important. Many of the Mexican girls were quite fascinated by guys with blue eyes....I had blue eyes and blond hair......hence I thought blue eyes were very important.

Unfortunately.....many of the blue eyed guys treated the Mexican girls in less than nice ways.....to my shame I was one of those guys. The Mexican girls quickly learned there was nothing special about those blue eyes, and my blue eyes then were no longer important to me either. I was the loser in that learning experience.

Within the past year I received an opportunity I didn't think I would ever get in my life. I actually got the chance to see one of those girls that I had treated badly so many years ago and to tell her how sorry I had been for so many years. She was very gracious and forgiving. She ultimately took me by the hand....looked straight into my face....and said...you still have those beautiful blue eyes. That is a true story.

Why would you want this guy to rot in a cell for the rest of his life? He didn't shoot anybody. At least not that I'm aware of. I'm not saying he doesn't deserve jail time, but I don't think he should spend the rest of his life in prison. The shooter should be the one spending his life behind bars.

Thank you for your caring and compassionate thought on this matter. But you apparently have forgotten.....or just don't care...that as of this moment he has been convicted of nothing. So locking him away for the rest of his life is at present a bit premature.

That is unless you have personal, direct, knowledge that would establish his guilt beyond a reasonable doubt. If you do I would suggest that you take it immediately to the proper authorities....failure to do so might also land you in some hot water. Perhaps you and he would then be allowed to share the same cell whereby you could exchange your thoughts on this matter.

If however you are attempting to prove to the rest of us what a thinking individual you are......you sir have failed.

It seems quite obvious that you knew the victim and had positive feelings about him.

After having read that I feel I better understand your pain and anger.....and I then apologize for my knee-jerk reaction to your posts. The wheels of justice do seem to turn slowly...but most of the time they do turn. Give them that time.

As to our rather rambling discourse......it happens all the time. If you have read or followed any other threads on this forum you would be aware of how one thing leads to another. It's just the way these things work
