The investigation is continuing into the shooting death of Omar Gerardo Flores who died at the University of Kansas Hospital in Kansas City, Kan.
Flores was transferred to Kansas City shortly after he was shot Tuesday evening around 8:10 p.m. at the Rodeway Inn and Suites.
Emporia Police Chief Gary Smith said this afternoon that the police department doesn’t know why Flores was at hotel that evening.
“We have a couple of witnesses that we are working on,” Smith said. “We’ve got a number of people that we are looking at. We’re working with a number of other agencies.”
Rumors have circulated that Flores was at the hotel helping the police make a bust. Smith denied this allegation and said “we don’t operate like that.”
Smith said the police department is attempting to track down the rumors, which takes time away from the investigation.
“This kind of stuff really jeopardizes our investigation,” he said. “We are going to have to track that stuff down, figure out who started it and why they did it ... and determine if there are to be criminal charges against those who are spreading the rumors.”
Smith said rumors also hurt the family.
“It’s hard on the family anyway and the more they hear about this kind of stuff ... it’s not very kind to them,” he said.
Smith said credible tips need to come to the Emporia Police Department at 343-4200, or Lyon County Crime Stoppers, 342-CARE.

That is one of the most ridiculous things that I have ever read. Why on earth would they waste their time on the rumor mill when there is a REAL crime that needs to be solved? They have addressed the gossips concerns with this article, so that should be a dead issue. Please find whoever is responsible for this horrific crime so that the family can get some form of justice and the citizens of Emporia can rest easier. There could possibly still be a killer amongst us!

I think that everyone needs to stop and think "what if this were to happen to themselves or someone in their family?" would you want for your family members to have to deal with the comments? Yes justice needs to be served for his family so stopping the allegations would be helpful, so that the police can get on with their investigation.
The rumours that have been started seem to imply that people know things that they aren't coming forward with so why wouldn't the police look into it? Every corner needs to be checked. This is someone we loved and would like to know that who ever is behind bars, for doing this to him.

Rumors can damage an investigation. People hear things and it can distort their opinion on what happened. It can taint the jury pool. People may be unwilling to come forward with real information due to some rumor. It's called interfering with a police investigation and it is a crime. And it is hurtful to the family who are dealing with the loss of a loved one. To have their reputation dragged thru the mud can't help one bit.

First, I know for a fact that the police department uses hotels to set up drug busts so that right there is a bold faced lie and you put it in print. First, I'd like to apologize to the Flores family. My comment was not meant to hurt anyone, but to try and help figure out what happened.
I was the first one to post about this "rumor", but definitely not the first one to hear it or tell it. I also added that I didn't know this to be 100% fact, but as usual all that comment has already been censored, but to those of you reading this, as I said I don't know this to be a fact, I'm just posting what I was told, nothing else.
Lastly, this will be my last comment on this site. Being censored has gotten really old. Emporia needs a site where people can be guaranteed free speech and anonymity. Otherwise people will be too scared to come forward in these cases and won't say what they feel about things because someones going to track them down and charge them with a crime. If anyone hears or knows something, they should be able to get that information out there without having to actually deal with the police. Hopefully these threats won't keep someone who seen or knows something from coming forward.

The police around here make up their own laws and rules. Maybe if the police here in this po dunk town would actually spend the time investigating this crime instead of posting their butts outside of bars and strip clubs maybe this horrible crime would get solved. I'm no lawyer, and I don't know what Chief Smith is talking about exactly. But... if a rumor started with malice and no basis in fact really does jeopardize an investigation in a tangible way, and the PD can track down the rumor starter, maybe that person can be charged with obstruction of justice. Maybe that's not correct, and I don't think it'd be a good use of tax dollars to pursue that anyway. But maybe that's what Smith is talking about.
It always makes me laugh when people on this or any other forum get their posts removed, then whine about their free speech rights. The gazette doesn't have to provide space for reader comments at all- it chooses to. The site editors can remove anything they please, up to and including the whole forum.
If you want a site where locals "can be guaranteed free speech and anonymity" start one yourself. I'm sure www.emporialiesandgossip.com is available. And like this forum, I'm sure its credibility, and effectiveness in solving open criminal cases, will be off the charts.

They either need to allow comments, ALL OF THEM, or no comments. It just isn't right to pick and choose which is ok and which is not. I too have had comments pulled that niether attact someone by name or a business by name. It was both time a general comment of my own opinion that was not slanderous but yet was pulled. I dont care either way just pick one and leave it. I also think a forum would be good for public opinions.
Topeka has this kind of thing and it is not a out of control chat for lies and gossip. People just want to be heard for what ever it is worth. Pllus people in office could use it for a tool to get opinions or ideas too and to reach out to the general public.
You would be suprised if you put a little faith in the community, yes you are going to have a few who get out of line. Don't you have those everyday in life? We are all grown ups and know how to handle those situations without over reactions. Banning and pulling comments is a fast way to ruin the confidence of a community. Ladies and gentlemen of the jury, I have just learned from a good friend and collegue as to what the rumor floating around is. I will NOT address the rumor because when I posted previously I did not know what the rumor was nor did I know any specifics of the case. My comment was targeted at the article and what the Chief publically released. Now that I am informed, I can understand why the Chief would carelessly release such an article. The investigation holds the truth and so do more people other than the Chief. Again, I stand behind my previous statement and I now understand why the Chief would be so reckless with such an unnecessary article. Stop trying to protect the liability of the PD and focus that energy on catching the shooter.

Free4all... I agree completely that it wouldn't be right ethically for the gazette to just pick and choose which comments to remove. The point I was making was that some act as if when their posts get deleted, the freedom of speech rights the founding fathers gave them have been violated. They haven't been, because the fact that this forum even exists for them to use is just a bonus. But if the gazette deleted a message simply because the powers that be didn't like it, it would certainly violate the *spirit of the 1st amendment, yes.
There are user guidelines for this thing. Ethically, it's up to the gazette to only delete messages that violate the stated policy.

Based on his/her grammar and true persona reflected in the obviously angry later postings, I suspect that if this quality of writing reflects his/her ability to complete police reports, it explains a lot of why he/she is bitter.
Another consideration is that the media generally call the police every hour on the hour for information on cases like this. How much of this was paraphrased by news staff and how much of it is quotations? Spreading information around that could interfere with an investigation by intimidating potential witnesses or alter the perception of potential jury pool candidates is a crime. People should be careful what they say for the unintended consequences that result. If you want to be mad about wasted tax money on sidetrack investigations be mad at the rumor mongers since failure to follow up on any source of information could have serious ramifications once the matter goes to trial and a person is charged.
There is no deputy chief right now so the chief is probably pretty much stuck putting out most of the information so the investigators can try to do their job without distractions.

I doubt if he is a law officer because he apparently doesn't know that maybe one of those rumor spreaders may just provide leads that could solve the case. I find it kind of funny that at an odd hour of the night several people who happen to agree with each other started posting at the same time within moments of each other. I hope everyone remembers the Gazette only allows you 'one' account on the website. ;)
On a side note, this is asinine. If a rumor was strictly calling out a member of the police department, which no I don't know what it is, but from the sounds of everything it would appear it does not look favorable for the department, then they should know not to pursue it and keep their eyes on the murder investigation at hand.
I'm aware rumors could compromise an investigation, but at the same time shouldn't it be more productive to find out who a killer is in Emporia before going around and trying to find sources of gossip?
If gossip and rumors are a crime then the EPD will be very very busy after this investigation because I know A LOT of rumors about A LOT of things around town. ;)
Hell, my high schools years, half my friends should have been tried in a juvenile court for all the rumors they had around about other people and what they were in trouble for! (That could compromise an investigation too). Equality!

I am happy that you have FINALLY allowed other agencies to help you with this matter. It is sad that it has taken you so long to do so; maybe this family could have already had some closure. Don’t arrest me for spreading a rumor, but I find it funny how you like to state you are working with other agencies in the newspaper, when your agency has a reputation for not working well with others.
My suggestions for you:
1. stop wasting time with ridiculous articles such as this one, which clearly made you look like an inadequate Chief (you may want to read up on freedom of speech).

the judicial system here in emporia sucks and thats putting it nicely, 2 years ago i had checks stolen from me and more than 600 dollars was forged and i knew exactly who did it. i filled out a police report, i signed statements in front of a notary saying they were forged at the bank with the officer i called there with me and the police dept has done NOTHING!! two months ago i reports a 30 yr old man having sex with my 13 yes 13 year old daughter and again NOTHING!! i now have my own shot gun with bird shot, obtained legally,and i guess i will have to protect myself and my girls the best i can becasue i have witnessed first hand the damn police here WON"T do it!! i guess they are too busy fighting all that rumor crime. what a waste every one of them. we do need a community blog that is un censored so people can say what they THINK and KNOW. if people choose to go there than thats their chioce just like it is their choice to believe whatever they want.

Voice of Reason: please re-read the article. It is about the police department taking time away from the investigation to track down rumors. Its not the rumors that are hurting the investigation, its the fact that the detectives are detecting rumors and trying to find their source rather than the finger that pulled the trigger. Even if they do find the source of any such rumor, this will lead them to the many dead end leads they have investigated. They are very use to dead end leads and maybe they should consider using real police investigative techniques rather than, hey my buddy said that there is crime here; go investigate.
Another thing, I said I was emloyed in law enforcement, people on here assumed that I was a gun toating testoterone freak. There are many other jobs in law enforcement. Stop assuming things based on this blog, that is how rumors get started. I could pick up animals or dispatch. Who even said I work for the city. You just don't know unless you assume you know.
I flat out called the Chief a lier becasue his article was not truthfull. Take it for what its worth. I know that hotels are used for drug operations, if you need evidence, go to one of the PD's court hearings on some drug cases then you will know.
Pulling the wool over the public's eyes in the press by the Chief of Police is wrong and unethical. I find it hard to believe that Commissioners can sit idley by and let this happen. Where is the city manager on this issue? Maybe he needs to address this with "HIS" chief.
If the city has liability in this incident, then they will have to face the music, not try and obstruct peoples views because the chief says he wants to dispell the rumors. I didnt hear him putting press releases when he was terminating his deputy police chief and I can assure you, there were many more flying about that than this case.
Again, Gary, would you like to appologize to the public for being less than truthfull? You and I both know how the PD operates and they do use hotels for drug busts...

I also thought we had a "traffic team" to handle accidents and take care of traffic related items. I belive it was in the paper that this team was developed to allow other officers time to work other cases. Perhaps rumors ??? Do you expect your officers to issue a certain number of citiations per month??? That is the question.

The chief was responding to questions from a reporter. Pretty silly line of questioning if you ask me.
When the police get information they have to verify the truthfulness of it. Now wouldn't rumors need to be proven or disproved? Whether true or false, it's information isn't it?
BTW liar is spelled "liar" not "lier". Really now, that shouldn't be too difficult to figure out because if you misspell a word in this forum, it is underlined in red. It's called a "spellchecker." Left click on it and it will give you a choice of correctly spelled words.
Those who have no analytical,nor critical thinking skills jump to false conclusions to fit their own mindset. Guess that is easier than waiting for enough facts to make a rational decision or looking at the big picture.
Aren't y'all going to feel silly when an arrest is made ... oh wait is that a rumor I am hearing? ... an arrest?

silly no for chief to say investigation is going to slow down because they will have to investigate a rumor is silly since the rumor was about the epd they should know if it were true or false without investigating right? very glad a arrest was made and hope they dont slow down for rumors

This forum has no built-in spellchecker. Some browsers have this capability and will recognize text entry fields and check them for you, but this isn't the case for everyone.
What OS are you using? What browser? Any toolbars or add-ins that give you the spell-check ability? These are questions that you must ask someone before assuming they have spell-check ability on this forum.
I think it's funny that you are acting like a know-it-all when you don't even know what exactly gives you the spell-check ability. Don't assume that because you have it everyone else does too.

It makes me feel good that the only thing about my comments to attack is my spelling. I wish this thing would tell me what is spelled wrong. You get so use to some things and when they aren't there you really appreciate them.

In fact, that really hadn't crossed my mind until Voice got so defensive about me spreading my "rumors" that Voice was. Unless I am wrong in that respect and Voice decided to mesh two different points into the same post directed at me, which is still strange because I wasn't even in on the discussion of them being an employee.
Which was this section of their point: "and I am not the police chief, nor am I a member of EPD. So keep spreading your rumors ( aka: lies)"

The 'main' part of my post was Voice's assertiveness that I was spreading "lies" about them being a member of the Emporia police department.
We can harp on me being a pain all we want, but I never flat out said that they were two in the same. I still do find it odd that two people were posting within moments of each other agreeing at a late time of the time. And the Gazette still only allows one account per person.
