Four charges involving sexual actions against a child were filed on April 27 against a former Emporia State University student who had been student teaching and helping coach athletics at a Lyon County school.
Darin Michael Redeker made his first appearance Monday afternoon in Lyon County District Court before Magistrate Judge Douglas Jones.
He is charged with two counts of indecent solicitation of a child between 14 and 16 years of age; one count of sexual exploitation of a child less than 18 years of age; and one count of attempted sexual exploitation of a child under 18 years of age.
The first indecent solicitation charge accuses Redeker of enticing or soliciting a child 14 to 16 years of age to “commit or submit to an unlawful sexual act” between Nov. 1 and Nov. 30, according to a complaint filed with the court. The second indecent solicitation charge is alleged to have occurred on or about Jan. 26.The indecent solicitation charges are a Level 7, Person Felony.
The sexual-exploitation charge accuses Redeker of possessing a photograph of a child 14 to 16 years of age “engaging in sexually explicit conduct with the intent to arouse or gratify promoting any performance” between Nov. 1 and Nov. 30. The charge is a Level 5, Person Felony.

What a sad situation.
This is a huge problem for young, good-looking male teachers. Young, teen-age girls get a crush...it's not reciprocated...they get their feelings hurt..and now a probable teacher is out of a job...in the middle of a teacher shortage. I can't help but wonder what the whole story is. This is why ALL teachers, especially young ones need to remember that they are not there to be students friends, they are they to be their teachers and coaches. Who cares if students like you or think you're the "cool teacher".....they are there to LEARN from you. Too many teachers are friends with their students on Facebook, students have their teacher's cell phone numbers. It all leads to trouble....and when it's one person's word against another....the teacher always loses.

All teachers, student teachers, and future teachers need to learn from this and realize that the consequences are harsh for even the smallest improper communication with students. FYI, if a student sends you an improper photo...requested or not...and you respond in anything but a strong NO - boom - you can get charged with a felony (i.e. sexual exploitation). In addition, any communication that can be construed as inappropriate can also get you a felony...a felony for each instance of this communication. Facebook can be a very dangerous thing. Learn from this people!

If you knew the story you would definitely not be making the claim that this originated from a young girls crush that was not reciprocated. When did innocent till proven guilty disappear? oh yeah, when the courts realized that it was to expensive to give someone a fair day in court. The fact of the matter is, that the standard practice nowadays is to charge first and ask questions later. follow the court reporting in the paper, and you'll see that the way the courts ease their docket schedule, is to charge someone with multiple charges, to build the presumptive imprisonment term of the collective charges. even an innocent man with a public defender, or little money to pay one of the "in" lawyers who lunch with the county attorney will accept a plea agreement to plead guilty to a single charge with low presumptive imprisonment, or presumptive probation, when faced with the possibility of doing half their life in jail. put away the ropes. smother the torches, and leave this alone. thank you Emporia Gazette for tainting the jury pool. i'm not defending or prosecuting either side, but don't you all think we should leave this to those who will?

neighbor.....if I am following your logic correctly then it would be alright for a fifteen year old to have sex with a ten year old. Your right...three to five years age difference is not at all uncommon. I was seven years older than my second wife.....but she was twenty when we got together. Those six or seven years of added maturity make all the difference in the world.
I agree with many posters that this paticular case.....as with all cases..... should be decided in the courts. But children are protected by the law from such advances by adults because the adult...in this case teacher....is in the power position and is assumed to have superior judgement skills. That's why we don't let children enter into contracts.
People claiming its always the childs fault in so many of these cases put me in mind of the 250 pound bozo that beats the living crap out of his 120 pound wife and then says.....but-but- she made me do it....it's all her fault. Sure thing dirt bag!

A teacher shouldn't be propositioning or dating a student just like a doctor shouldn't be dating or propositioning a patient. Professional detachment is a good thing. Though it's been a popular fashion for years for teachers to be involved with students, it doesn't make it right or acceptable.
There is a level of authority that comes with a teaching position and with that authority comes the responsibility of making mature, rational, ADULT decisions. Now, by "adult", I don't porn-store adult. We teach our children to talk to teachers, police officers, etc. when they need help at home (i.e. parents beating them, rape, drugs, abusive relationships, etc. ). He violated that social trust we have come to accept as a society and tainted the reputation of teachers, police, doctors & others in that same position of authority & trust to protect our young.
Let's put some perspective on this: She is 14 - 16. She can't drive yet, hold a full-time job, buy a lottery ticket, or go dancing at a bar/club.
Mr. Student Teacher has entered the age of majority. He was ready to enter his career, with a college education. He can legally get married, go to a bar, hit the casino in Vegas, etc. Congratulations, you're an adult.
Furthermore, congratulations to him on being "good looking". That just means that in combination with his education, athletiscism (sp?), & charms, he could have found a girlfriend that was of a legal age (& therefore can enjoy the same adult activities as he) that looked like she was 14 - 16, since that is, indeed, what he likes.
In closing, congratulations to the parents for bringing this incident to the proper authorities, for taking another predator in our schools out of play, & for doing their job & not just sweeping it under the rug. Hopefully their daughter won't be traumatized for life like so many others.
For shame on the folks that condone this type of behavior nationwide. It's time to put a stop to the intermingling of teachers/students, time to punish the guilty for deeds actually done instead of pleabargaining for lesser charges, & time for people to be responsible for themselves again as opposed to blaming their parents, personal traumas, & everyone but who is truly to blame: THEMSELVES. Exhibit some personal control next time you feel like being reckless & acting on an impulse. I thank the Gazette for bringing predators to our attention instead of turning a blind eye to them. Maybe the news is full of negativity, but at least we are aware of what's going on. Ignorance may be bliss, but knowlege is proactive. Perhaps life wouldn't be so negative if our children are raised to think before they act, & parents are a little more responsible, a little more involved, & a little more questioning. Stop pointing fingers and start doing what's right! :)

Fourteen and fifteen year olds...and sometimes even younger....being charged as adults has much less to do with jurisprudence than it does grand standing district attorneys trying to score some points with the law and order crowd.
The same crowd that applaud such moves the most are the ones that also scream the loudest at any suggestion of expanding the decision making ability of kids that age.

I agree with JeremyB---- in THE WORLD WE LIVE IN, what is the average age that sexual activity begins? 12! 12 years old, that is 6th grade; kids these days are experimenting at a completely different level that what we adults consider to be normal.
From drinking to partying and even having a cell phone these days, kids are growing up too fast. I don't care how "cute" the teacher is; we had "cute" teachers in my school too, but the fact is 14 to 16 year olds know better. I am not saying there aren't some instances out there where they aren't scared, or do whatever because they don't know what else to do.... but MOST GENERALLY they know right from wrong. Our children need to feel comfortable to come to us parents, no matter the situation, and tell us what is going on in their life. That is what we are there for to help guide our kids, be open and honest, start talking about sex, drugs, and alcohol at a young age. If we don't then something like this situation may happen.....
I am not making excuses for Darin, there are many different ways to handle many different situations. From what we all know (or don't know) about the situation, we should all step back and stop making accusations until it is played out in court.
I agree there are boundaries set for a teacher/student relationship and I do believe that we will all be seeing a change in rules with Facebook and Myspace. Best of luck to both sides. I hope both families are able to recover from this.

I must have missed out on the gossip of what actually happened in this case. From what is printed in the paper, it could be almost anything. It could be the fault of either or both parties. Did the girl flirt with him and he not rebuff her strongly enough and the parents find out? Did she make a move on him and when he didn't respond, did she cry to her parents or did they just find out and hit the ceiling? Or did this young man take advantage of his position to do something inappropriate with a minor girl? I don't think anyone really knows outside the families of the 2 people involved. I'm suspending judgement until more facts come out. And if something was posted on Facebook or whatever, what is to say it was even truthful? I agree kids start having sex WAY too early. And in some cases, the girl lies about her age and the boy pays for it. I had a high school classmate get in hot water over that. He was 18, she said she was 16 (legal age for sex in Kansas). Her parents found out and went to the cops. Turned out she was 12! A friend who was there told me he'd never have believed she was that young and that she claimed to them to be 16. I know that is not the case in this instance, but sometimes the girl is at fault. Sometimes people get into a power trip as teachers and take advantage, too. Until society pulls itself out of the collective gutter, we're going to have this stuff go on. I just hope I can teach my son to act better than most of his peers probably will.

I have to agree with madpoet. I don't think that anyone has enough information yet, especially when you read the article. If you ask the family it will just be he said she said. Wait for the evidence. Furthermore, I also agree that anyone in that position should know better. But as a 14/16 year old girl she should too. Once again we won't know until after the evidence comes out. Teenagers are not always victims. Unlike some of you act I was once a teenager and knew right from wrong then as did my peers, and there were differences in what we chose to do. Overall, there were girls who worked very hard at seducing men young and old and their parents sure didn't know. The men should have known better but that is a story that is as old as the human race... One girl I knew in high school was sleeping with a firefighter. He was married and had two small kids, but it didn't matter. He was still sleeping with this 16 year old. Think back to your high school days, I'm sure you can remember some of those same situations. I don't know about this situation, but isn't that the point, we don't really know. BTW, I am in no way condoning this sort of thing, overall I think that people should have more self respect.

15 year old girls are not capable of making rational decisions. They are very impressionable and any attention they are getting from an older man is going to make them feel special. Girls at this age have blinders on and only live in the here and now. And we aren't talking a 5 year age difference, we are talking an almost 10 year age difference. The adult in the situation is the one responsible. Those saying its her fault, too, sure she probably consented, BUT it should not have come to that point because as an adult and a person in a position of power over the girl should never have let it happen. An adult is supposed to be mature enough to understand the laws. For me, a 15 year old is still a child.

14-16 year old girls today are not the same as they were 20 years ago. Sex education is taught in 4th grade nowadays...at the age of 14-16, many girls know exactly what they've got and how to use it.
Until all the evidence is brought to light, the girls are not innocent and the teacher is not guilty. If these accusations are found to be false, I hope this teacher can recover and his life is not ruined. Accusing someone to be a predator is not something to be taken lightly.

how much more our children have to learn to deal with a younger age than they used to.
If that is too much for you to deal with then work to change the legal age of maturity to fifteen,,,,,or fourteen.....or maybe even ten or twelve. Heck....if the guy is good looking enough maybe we should set the age of consent at six or eight.
But if you want to lower the age of consent.....don't be mamby pamby about it.....give fourteen year olds full adult hood then stand back and see how wrong you were about their ability to handle responibility.

We can have a debate about whether a 14 year old has the mental maturity to have sexual relations with someone 10 years her elder. Which they do not. All you have to do is listen to a 14 year old girl talk for 15 seconds to know that.
What is not debatable is that this adult knew the laws before he started student teaching. He knew better. If he broke the laws, then his butt needs to be in prison and his picture needs to be in sexual offenders’ website. If he broke the law, then these girls are victims and do not share in any of the responsibility.

I dont' *know* the situation, but neither do any of you. You may think you do, but the only two that actually know what happened are the two parties involved and now we have to construct the information we do have and determine if this is in fact a breach of the law.

Actually, oswaldorf, in some cases, women are "asking" for it. Women can be incredibly stupid and put themselves in bad situations with the wrong kind of people. If women want to be treated equally in this world, then they need to be responsible for their own actions. What she sees as dressing "sexy" and acting flirtatious, a man may see as a "fling" or a one-night stand. Add alcohol to that and you have a women who didn't say "no" and later claiming she was raped.
That said, if evidence is presented about this teacher that proves him guilty, then I agree, he should be sentenced firmly and swiftly, however, he is innocent in my book until that moment occurs.

I do not have an opinion on this particular situation, I will let the proper authorities and people sort it out !
However, I will say this ! The whole world is in dire straits and falling apart, as scripture and prophecy has foretold !
In my opinion there are fewer and fewer decent role models for the children, young people and yes, even adults to look up to, idolize and pattern their lives after and has been getting worse everyday !
Everything in todays world is based on Money, Wealth, Greed, Stature, Social Status, how to aquire these things and Peer Preasure !
Role models, as I see it there are getting to be fewer and fewer to pattern ones life after !
Children need positive role models while growing up, during their impressionable years and if their parents are not good role models, then they will, inevitabley seek out role models elsewhere, good or bad !
My biggest role models, when I was growing up were Jesus Christ, Gods word, and perhaps the most influential were my Mother and Father, who worked hard, treated everone with the respect they deserved, they taught me right from wrong, hard work was almost always rewarded, and to respect others that were deserving of it and to use common sense in making decisions that could have an affect on my life !

I wonder if this young man could even get a fair trial in Lyon County. It is just amazing to me that so many people are assuming he is guilty because he had charges filed against him. We have all heard the rumors but don't know how much truth is in those rumors, if any, anyways. So let's all set back and not pass judgement until we let the judicial system work. People were quick to pass judgement on Dwight Swafford when he had charges filed against him and look how that ended up.

I think we need to reserve judgement until the facts come out. We have no idea what happened here. It could be she got his cell # and sent him a naked picture he didn't ask for. If so, he was at fault not to turn it in. But that would not make him a sexual predator. He may have harassed the girl and if so should be punished. We really don't know what happened. Two reputations are being smeared by this case coming public. This is a sad situation for all involved. The whole Olpe school is going to be effected, too.

The trouble with this is we are all human and make mistakes, some small some HUGE! People also don't think before acting, or at least act on impulse. I for one try to weigh all options before doing most things, but can still come up short handed. I can say that I would never be in this situation, as I have made sure to not put myself in one. That is what most people should do, but they don't. I am not saying that either side is innocent or guilty, there isn't enough info for any of that. What I am saying is that we are all headed down a steep side of a mountain we are trying to climb, some people just keep dragging themselves down, and often taking others with them. Can we solve these age old problems? We haven't for thousands of years, and now there is so much arguement, I for one doubt we ever will.
You can't have punisment fit crime in this country, it is cruel and unusual to some. As if the crime wasn't cruel and unusual. Consequence isn't harsh enough, therefore it is not enough to curb crime.
One last thing before I go, if this country would return to the true democratic rule of majority rules, we might not have quite so many conflicts gone wild. Just something to think about.

"Innocent until proven guilty" is the motto.
Unless you were righ there listening when he did (or didn't) make solicitations, you don't know what happened.
We can't make assumptions without hearing the other side of the story.

let's say this girl had a crush on him. There is no law against a girl having a crush on a teacher. There is however a law against the teacher acting on it. So this girl isn't on trial.

Interesting, seriouslyfolks, sad really, we are ultimately turning into that oligarchy, pretty much there by most standpoints. Time to start over if you ask me. People are too afraid though, and ultimately we will have anarchy for a long time before we get any better. Prolonging the inevitable...

No one in these forums can judge this person by what we have read in the paper and the rants posted here. i doubt this case will even be heard in Lyon County. Innocent until PROVEN guilty is for everyone.

My understanding was that he was never officially arrested. Rather he was served with a criminal summons. Interesting in my opinion that he wasn't arrested and booked in following standard procedure.

Let's cut his testicles off and stuff them in his mouth. You people have convicted him and hung him without the United States Of America jurisprudance that used to be guarenteed every American. For god's sake people, give everyone their day in court and then pass your judgment.
I've included God, America, and the rule of law here in this statement, anyone care to debate? Give it a rest until the court date.

I WISH WHOEVER IS THE EDITOR FOR THE GAZETTE WOULD NOT LET THIS KIND OF CRAP INTO THEIR NEWSPAPER. WHY NOT WAIT UNTIL HE IS CONVICTED OF A CRIME BEFORE YOU PUBLISH IT. WHAT ABOUT ALL THE OTHER CRIMES THAT GO ON AND NOTHING IS WRITTEN ABOUT. PICK AND CHOOSE WHO YOU BLAST IS THE MOTTO FOR THIS PAPER. ITS SAD THAT I LIVE IN A TOWN WHERE YOUR NAME IS ALL MS. MYLNAR LOOKS FOR. I'M SURE YOU CAN GO TO THROUGH PENDING CASES AND FIND LOTS OF PEOPLE TO WRITE ABOUT. WHAT ABOUT GUYS SELLING DRUGS IN NEIGHBORHOODS HOW COME THAT NEVER MAKES PRINT. I GUESS ANY GUY WHO COMMITS A CRIME AGAINST A FEMALE GETS BLASTED. GRANTED WHAT THIS GUY HAS DONE IS FLIPIN HORRIBLE AND HE SHOULD BE PUNISHED FOR WHAT HAS HAPPEND. BUT I REALLY WOULD LIKE TO HEAR ABOUT IT ONCE ALL THE FACTS AND THE STORY IS TOLD TO A HONORABLE JUDGE. IT REALLY GIVES ME THE CREEPS TO HAVE TO EVEN HEAR ABOUT SOMEONE PREYING ON YOUNG WOMEN. I DO KNOW THAT 16 AND 24 IS A BIG AGE DIFFERENCE. HOWEVER MY SISTER IS THAT AGE AND THE WAY YOUNG WOMEN ACT THESE DAYS, THERE IS NO PLACE FOR A GUY HIS AGE TO BE IN A SCHOOL WITH TEENAGERS. I UNDERSTAND THAT IT IS HIS DEGREE BUT COME ON, SHE CANNOT BE 100% INNOCENT HERE. I DON'T KNOW THE GUY I RECOGNIZE THE NAME THOUGH. IT HAS TO BE SOMETHING THAT THE FAMILY WILL HAVE A HARD TIME OVERCOMING. LAST I CHECKED THEY ALL LIVE AROUND OLPE. ITS A ALREADY A SMALL COMMUNITY, I BET IT HAS DESTROYED ALOT OF RESIDENTS THERE. ITS REALLY SAD THAT THIS HAPPENS. HIS CAREER IS OVER, HIS LIFE IS NOW OVER. THIS WILL FOLLOW YOU AROUND FOR EVER AND EVER. I FEEL BAD FOR THE YOUNG GIRL FOR PURSUING THIS, AND I FEEL BAD FOR HIM. INSTEAD OF BLASTING AND CALLING NAMES, I JUST FEEL SAD, WE ARE ALL HUMAN BUT SOME ARE MONSTERS, OTHERS JUST MAKE REALLY F-ING STUPID CHOICES. NOW ITS UP TO THE BOTH OF THEM TO FIX THERE LIVES. THIS WHOLE THING MAKES FOR SICK.
