A Kansas Highway Patrol trooper who served a number of years in Lyon County is charged with a felony and two misdemeanors.

Clint Dwayne Epperly, 35, was charged Thursday morning with a felony count of official misconduct and two counts of misdemeanor theft. The case was unsealed this morning after proof of service was returned to Lyon County District Court.

The case, investigated by the Kansas Bureau of Investigation and filed by the Kansas attorney general’s office, alleges that Epperly removed property from a vehicle after a drug stop on Dec. 17 of last year. The property was removed after the vehicle was taken to a secure inspection area of Williams Automotive. No forfeiture action was ever filed, according to the KBI agent who investigated.

No one should make snap judgements until all the information is out in the open. We don't know what went on, it may have been an innocent mistake.

One should never pass judgement based on what they read or hear in the press. Give this guy his day in court, where justice has the best chance of being served.

I take it MrC has a problem with law enforcement in general from his blogs on that earlier article. That article has no bearing on this one except it involved another K-9 officer. Also I see people of all colors pulled over on I-35 all the time. I think it has more to do with out-of-state tags and behavior than race when they pull someone over. But it seems a lot of Hispanics with Texas tags get busted. Hmm, could it be they're running drugs north from the border?

Until we get more information (probably after the trial), we can't condemn or excuse whatever it was Epperly did.

If everyone recalls there has been a long going investigation with Mr. Epperly... he has not worked for the last almost 6mths! With charges being filed and such, then I would have to say they have a heck of a case against Mr. Epperly and that we can all count of justice being served... No one wants a dirty cop on the streets we all lose! But yes the trial will be interesting and the outcome just!

I think MrC and I have a lot in common! Sometimes you have to think outside of the box madpoet... just because they have a badge doesn't make them correct or perfect or above the law! Sometimes the worst are the ones with the badge who think they are above the law!

You can bet the fallout from this arrest is going to have a big effect on any cases this rogue cop worked over the past few years....your going to see many cases dismissed, charges dropped, etc...because he put his greedy ways in front of the integrity of the badge...defense attorneys will have a field day with this rogue cops cases..Way to go Epperely you put the community at risk!!!!

MrC, your comments seem like you're judging all law enforcement officers as thieves and liars. They are human too and some are good and some bad. Just like any profession. They are held to a higher standard of behavior because of their job. So if one screws up, people go nuts. I have seen too many people ruin their lives on drugs to not be happy when they take money or vehicles from a drug runner. I think the officers do a tough job for darn little appreciation. I've known some who came across as callous but most seem really nice. The good ones seem to go into law enforcement to help others. Like fire fighters and EMTs.

I think everyone on this post needs to ease up! We all know there are TWO sides to every story and to unfairly JUDGE someone is ridiculous. You will all feel really stupid when the truth comes out. This is someone's life - show some respect.

Some of us may be speaking with more knowledge than others and if you have ever had contact with Epperly or know anything about him like some of us do, then I doubt you would be saying what you said nascar! Justice will come out in the end, is what all of us are saying.......... Two sides to everything yes, and some know both sides.... and like I said justice will be served!

There is two sides to every story, however, when you have the KBI investigating the case you can bet your bottom dollar they won't make a mistake & the evidence must be overwhelming for them to take the step & charge an officer of the law!

I was referring to your comments in the earlier article, MrC. You called the deputy and the sheriff thieves and seemed to be saying drug seizures were just thievery. If you had watched classmates totally fry their brains on drugs like I have, you might view them differently. Anything to hurt those drug pedalling, life destroying jerks makes me happy. It's all done within the law and people with legitimate business can go to court and get their stuff back if wrongfully seized.

MrC don't worry they are unaware of real issues... and hawks422 you have made great point... why doesn't everyone think about what hawks422 has to say.... our tax dollars could be spent big time retrying cases due to Epperly's mess up... he is going to cost us all big time and as we have said time will tell.... justice will be served...!... But like hawks422 said, if KBI is involved they don't point the finger unless they have something and one my ponder why it has taken almost 6mths to press charges but here they are... so KBI don't mess around and I think we all have a reall issue on our hands....... think about it..... I agree with the point, that noone is above the law, no matter who they are.
But if I am not mistaken, the KBI would get involved in any alleged wrong doing by a law enforcement officer, employed by the State of Kansas. No matter what the alleged misconduct may be and no matter how trivial it may seem .
I believe that is just SOP for the KBI to get involved. What I am saying is don't read anything into it, because the KBI is involved.
Lets, just wait and see what comes of it. No matter whether you like the man or not !

But please don't mistake us for idiots..... if kbi has spent almost 6mths investigating someone, anyone with a friend in biz so to speak will tell you that is serious stuff... so make no mistake that this is big time and kbi nor the kansas att. general waste their time unless they have a case... might be why it has taken almost 6mths to press charges........ just something for you to chew on methusla

There is a difference between the ones who know and the ones who THINK they know. I think the only the KBI is the only agency who can investigate this case because it is the one with the least amount of ties to Epperly. And then there is that whole innocent until proven guilty stuff...

I am with Madpoet on this one.

I'm sure KHP summoned the KBI due to the serious allegations & charges but if you read between the lines one can determine that KBI has many resources at their disposal & certainly no prosecutor would take this case if there wasn't hard evidence against the man....especially in light of the fact this is a law officer with many many cases on the table that could be thrown out because of his impending legal troubles. In my opinion the Attorney General must have an open & shut case because they would of never put all the other cases this officer has worked in jeopardy...they have no other alternative but to take this all the way & produce a conviction?! As for Epperly he better hire the best attorney money can buy!

Can anyone fill me in on what it means when it says that after the drug stop the vehicle was taken to a secure area and property was removed? It doesn't sound like he was using it for his personal use so was it an administrative issue? Did he not fill out the proper paperwork or was he keeping it for his own use?

come on people,,,this isn't the first time Epperly has done this,,,just the first time getting caught...And the reason is because on this drug stop he was doing these actions in front of other officers that actually have integrity and values and busted him out...enjoy your next job at Burger King....

I will stand up for the 'accused'. Our family has learned that ANYONE can be charged with a crime, felony, whatever and be completely innocent. This Lyon County Attorneys office lays charges first asks questions later. I don't know if its because they are trying to impress tax payers or what. But I have been watching them ruin to many lives because of it. Not only does a charge "infect" families reputations, their finances but also their emotional well being. So before this community just thrashing out opinions, INNOCENT UNTIL PROVEN OTHERWISE.......

hawks422.......You hit the nail on the head......Prosecutors are very reluctent to bring charges against law enforcement officers because doing so makes them extremely unpopular if the case ends in acquittal...and only slightly less so if it ends in conviction. And that's before your ever get to the problem you addressed about other cases being thrown out or even reversed in cases of evidence and witness tampering.

Their natural tendancy would be to proceed with extreme caution unless the have a pretty darn good case. That doesn't mean he's already beeen proven guilty.....but it does mean he better have some good council.

I am totally shocked that my earlier comment was removed! All I said was we shouldn't judge until after the trial and that a man's reputation was being shredded. I mentioned I've taken this stand in earlier posts for Redeker and Williams. Wow, I wouldn't have thought that would offend anyone. Compared to other posts on this, it was cotton candy! I guess I'll see it this one gets removed too. Heaven forbid someone could suggest moderation.

KANSAS HIGHWAY PATROLMAN CHARGED IN LYON COUNTY DISTRICT COURT

A Kansas Highway Patrol Trooper based in Emporia is being charged with two counts of theft and one count of official misconduct. The case is being prosecuted by the State Attorney General’s office, and alleges that Trooper Clint D. Epperly took a global positioning system and a tool chest from a vehicle and driver that Epperly had stopped. Court records state that he allegedly detected a large quantity of marijuana in the truck that Eduardo Cruz Bravo was driving. Bravo's truck was towed to a storage area. Later, Trooper Epperly was seen by a sheriff's deputy carrying a Nextar brand global positioning system. After deleting information stored in the GPS, Epperly allegedly offered the GPS to the deputy. When the sheriffs deputy questioned if that was alright, Epperly is alleged to have replied that if neither one of them didn’t take it, "someone up the chain" would get it. Epperly also allegedly took a toolbox and tools. A KBI evidence custody report completed by Epperly did not mention a GPS system, or any tools being seized. Court records say that Epperly submitted a second inventory report listing a GPS being transferred to the sheriff’s office, and it lists a toolbox and tools. Epperly’s first appearance is set for July 8th at 12:45 Pm.

The only thing that distresses me about all this is that it casts a pall of mistrust over all law enforcement. That is so damaging to a community.

It is amazing how many of you are so involved in your community so that you are able to make these comments and feel good about yourself. Truth is if you really believe in your justice system then shut up and watch what happens. In the end you all SHOULD be ashamed of yourselves for the things you have said.

Have you all forgotten (or just not as knowledgable as you would like all the readers to believe you are) about the amount of drugs Epperly has removed from the streets and the drug money this trooper has turned over to the state.

Now all of you that are so knowledgable tell us how many major drug busts have taken place on I35 in Lyon County since Epperly has been on leave.

You have to be TOUGH to be a trooper or any law enforcement officer so these comments being made about this trooper are only hurting you by showing your stupidity.

Have fun laughing at yourselves when this is all done and you are proven WRONG:) We will.

Okay, let's be clear on this madpoet. No drugs were seized in that case. No drugs were found in that case. Except for the inference of the deputy and his dog that case was not even about drugs. Yet somehow when you read that article you inferred that MrCmonkeeDo "seemed to be saying drug seizures were just thievery" and "...all law enforcement officers" are "thieves and liars." That kind of logic leads to mayhem.

MrC doesn't know how old you are, but he grew up in the 60's and has seen way more peeps trying to "fry their brains" than were ever able to do it. In fact if pressed, He couldn't name one, NOT ONE who ever succeeded. Sooner or later they all stopped wasting their time on the endeavor and joined the rat race. Some of 'em even became law enforcers or other highly regarded public servants.

Most of us like to pretend that we are normal and that life is divided into Dos and Don'ts. That for instance, there are right ways and wrong ways of Doing things and behaving. We like to pretend that those who Do right are good and those who Do wrong are bad. DoGooders are rewarded; DoWrongers are punished. In fact madpoet, we are so good at pretending these things are true that we sometimes forget that they are not true. And so we infer or imagine that reward and punishment are dangling carrots that propel us ever forward in righteous dignity. That without reward and punishment our lives are imperiled and life as we know it (remember we are just pretending) will be stolen from under us. Being that we are a frivolous lot we even pretend that we can spot the DoGooders and DoWrongers by their professions or the cut of their clothes or the whiskers on their face or the car they drive or the money in their pockets.

But with few exceptions just about all of us who choose to play this game think of ourselves as the DoGooders; and there's the rub. When we forget to signal a lane change, for instance, it's okay because we are basically DoGooders who hardly ever forget to signal a lane change. But the guy driving just ahead of us who forgot to signal his lane change is probably just a jerk who never signals and needs to be punished. The guy with lots of money in his pocket must be a DoGooder because he has been so richly rewarded; the guy with nothing can't be trusted. The cute girl must be good; the girl with bad teeth is probably on meth. The college graduate is good; the high school drop-out is bad. The jock is all American; the fat kid is a slob.

So we yell at the fat kid and the drop-out and treat the ugly girl with contempt. The rich man is greeted with smiles and open arms while the penniless man is frowned at and shunned. As if our disdain will somehow lead the DoWrongers down a path of normal righteousness. That's why we spank children for doing childish things and kick dogs for poopin' on the floor and rejoice when ugly girls wear make-up. It's reward and punishment and it's fake, imagined and only for pretend.

If you want to pretend and play games madpoet that's okay. Lord knows MrCmonkeeDo can't stop you even if he yells at ya or throws ya in the hoosegow. But please don't try to convince any of us that got tired of that game that C. Epperly has some kind of corner on the DoGood market. And PLEASE, PLEASE, PLEASE don't harp on that innocent until proven guilty baloney. Jose Nunez and Raul Ruiz certainly weren't extended that courtesy.

Don't know if you noticed but cepperly went fishin' in that article's forum and would have liked nothing better'n to git MrCmonkeeDo's name, rank and favorite cereal in his squad car for a brainwashing "ride along." So when MrC noticed the charges brought against C. Epperly this morning he naturally remembered that discussion and Epperly's comment and how concerned he seemed that We just didn't understand how hard it is to pretend to be law abiding enforcers of justice. You know something? He's right; we don't understand.

Well to start with this is not Trooper Epperly. Do you honestly think he is even reading these. Coming from a life long emporia resident I know all the facts and maybe you should brush up on your facts before you start posting about things you know nothing about. And quit trying to recruit co workers at Burger King. When is the KBI and the attorney general going to start investigating the deputy that was in possession of the GPS?
