A pre-trial conference has been scheduled at 2 p.m. July 31 for Gary N. Drawbaugh, who has been accused of two counts of theft by deception and one count of making a false writing.
Drawbaugh waived his preliminary hearing this morning in Judge Jeffry Larson’s courtroom in Lyon County District Court, and was bound over for trial.
The charges evolved through a bidding contract Drawbaugh and his companies — Sterling Supply & Manufacturing, Vehicles of Kansas and Vehicles Inc. — held with the U.S. government.
Larson accepted Drawbaugh’s waiver, after questioning him to ensure Drawbaugh understood the consequences of the waiver.
Defense attorney Don Lill also waived reading of charges at the arraignment that followed.
Drawbaugh remains free on a $7,500 bond.
The U.S. Defense Logistics Agency has placed him and his companies on an “excluded parties” list, banning them from bidding until October 2011, according to information from the DLA.
The DLA asserted that Drawbaugh, through his companies, had received payments from the government for materials he had contracted from other companies, and that Drawbaugh did not pay the companies he hired as subcontractors.
