Prison, probation revocation in Coffey Co.

Saturday, July 11, 2009

Coffey County District Judge Phillip M. Fromme recently ordered three people to prison for their convictions of crimes related to manufacture or sale of illegal drugs.

The sentencing were done this month in Coffey County District Court in Burlington.

According to a news release from Coffey County Attorney Doug Witteman, Fromme sentenced Nicole C. Lemons, 32, of LeRoy to 20 months in prison for conspiracy to distribute methamphetamine, a Level 3 drug felony.

Witteman filed charges in July 2008 after execution of a search warrant a few weeks earlier at a home in LeRoy. Coffey County sheriff’s officers provided evidence that Lemons had been involved in the sale of meth to people who lived at that home.

A second defendant in that case, Todd G. Combs, 44, of Burlington, was sentenced in November 2008 to a 17-month prison term after his conviction for conspiracy to distribute methamphetamines.

Alfred Chad Forbes, 29, of rural Lebo, was sentenced to 55 months in prison for his November 2008 conviction on conspiracy to manufacture methamphetamine, a severity level 1 drug felony.

Witteman said in a news release that Forbes had entered a plea to the conspiracy charge on the morning his jury trial was to begin.

“Forbes later attempted to withdraw his plea,” Witteman said. “However, Judge Fromme denied the motion before sentencing him to prison.

Two others involved in related cases — Marcia Rucker, 46, and Michael D. Raffa, 21, both of Osage City — were sentenced last year to 40 months and 83 months imprisonment, respectively, for their convictions on conspiracy to manufacture methamphetamine convictions.

Also on July 1, former Burlington resident Samantha Wright, 26, was ordered to serve an 18-month sentence, after her probation was revoked from a conviction for possession of marijuana with intent to distribute.

Witteman filed the revocation motion and alleged that she had failed to abide by the terms of her probation imposed at her sentencing in May 2007. Fromme granted the motion and ordered Wright to serve the underlying 18-month prison term.
