City Commission hears proposal to postpone smoking ban
Ordinance may be pushed back until after vote

The Emporia City Commission will consider an ordinance to postpone the start date of the smoking ban at its regular meeting next Wednesday.
The smoking ban ordinance is set to take effect March 3, but commissioners will vote on an ordinance that will postpone the ban until it goes to a public vote on April 7.
The city commission passed the smoking ban in a 3-2 vote early in December.
Immediately after the ban was passed, Emporians Open for Business, a group of local business owners opposed to the ban, began collecting signatures to force a referendum on the issue. In a little over a month, the group collected over 1,000 signatures to put the question on the April 7 ballot.
Commissioners discussed a possible postponement at their study session Wednesday morning after members of Emporians Open for Business asked for the date to be moved back to give the public a chance to vote.
Commissioners also discussed the development plan submitted by D.J. Christie, the developer who is working on bringing Lowe’s to Emporia.
Mary Carson, the city’s bond counsel, spent some time going over the major points of the plan that will create a transportation development district (TDD) on land northeast of 24th Avenue and Industrial Road.
The process, begun last August, is entering its final stages. The city commission next Wednesday will take public comments on the Lowe’s plan before deciding on the creation of the TDD and the acceptance or rejection of the final development plan.

It is clear that separation of smokers from non-smokers combined
with air exchange technology is a complete solution to this largely
artificial problem. All it takes is regulating authorities setting the
standards for indoor air quality on passive smoke, and the technology
does the rest. Such air quality standards are common in industrial
and environmental contexts. But, to date, no country in the world has
set them for smoking areas. It seems clear that the reasons are not
scientific, nor are they economic or technical: they are political.
As to the annoyance of smoking, a compromise between smokers and non-smokers
can be reached, through setting a quality standard and the use of modern
ventilation technology.
Air ventilation can easily create a comfortable environment that removes not
just passive smoke, but also and especially the potentially serious
contaminants that are independent from smoking.

Who will the first criminal charged with breaking this new law? Will it be a bar owner, bartender, customer?
Or will it be the local plumbing or heating company or the local motel owner? Will Walmart get charged under this ordinance when someone waits until they are 5 feet from the entrance to extinguish their butt? Does the city really want to deal with court cases & the costs involved for 30 some days only to have the ban overturned? Seems to me a couple of posters here are really eager to give up their rights ASAP.

Kansas needs statewide smoking ban

A comprehensive statewide smoking ban makes sense for Kansas.
Prohibiting smoking in places where the public gathers would be fair and effective in promoting public health.
Those places should include restaurants, bars, motels and veterans organizations' gathering places.
Exceptions for private clubs - and, perhaps, casinos - may be necessary to limit legal action and keep Kansas competitive with neighboring states.
But the whole point of a smoking ban is to protect the public from the effects of second-hand smoke. Employees who work at these gathering places deserve that protection, too.
It is not too much to ask smokers to step outside to smoke - just like they do at their grandma's house. And when they smoke, they should be required to be at least 10 feet away from a building entrance.
Smoking bans don't kill anybody. Second-hand smoke does.
With all the respiratory illness, heart disease and diabetes we have in Kansas - and the cost of treating those problems - a statewide smoking ban makes sense for all of us.

San Francisco bartenders had dramatic improvements in respiratory health within two months, after the implementation of California's ban on indoor smoking sharply reduced their exposure to secondhand smoke.
In a study examining 53 bartenders before and after the ban was implemented, Dr Mark Eisner and colleagues at the University of California at San Francisco found that 59% (23) of those bartenders reporting respiratory problems before the ban--including wheezing, shortness of breath, and morning coughing--were symptom free less than two months after the ban on indoor smoking began.
Prior to the ban, bartenders were exposed to a level of secondhand smoke estimated to be four to six times that found in other workplaces, and 74% (39) of the bartenders included in the survey had reported respiratory symptoms (JAMA 1998;280:1909-14).

Where is the proof, in the way of a certified death certificate, that states that anyones cause of death was due souly and explicitly to exposure to SHS.
All any reports on I have seen on SHS explicitely state that exposure to SHS, alone may or may not cause death in humans. Also all of these reports, that have any credance at all, also take into account what is called " CONFOUNDING" factors in any of their final conclusions.
Come on commonsenseemporia, more scare tactics by the ban smoking army !

That's the one thing I've noticed throughout this whole ordeal. Everything CAE has put out, whether it was the "War and Peace" ban proposal, or the argument against the "trial" period, or the two posts above between lackofsense and me. Everything they have put together is long, complicated, not well thought out. In my opinion, everything that EO4B has put together has been very clear, concise, short, simple, and effective.

I compare CAE's smoking ban tactics to the tactics the Nazis used to promote their own smoking because they are an almost perfect match. If your Jewish friends are so offended, have them come on here and speak up for themselves. I'd bet they would be very interested to know how you are using and exploiting them.
I posted before and I will do so again, if your Jewish friends are offended by these comparisons, please tell them to get over it. It has been 2 days since the start of the boycott against my bar and the results are mixed. Sales have remained about the same, BUT ..............
Last night I had 5 non-smokers & 1smoker donate $382.00 for our advertising campaign against this ban. Didn't solicit any of them they just walked up and dropped the money on the table and said let us help.

I would like everyone on here to respond and tell me their answer to this yes/no question.
Would any of us be on here hurling these insults and accusations if CAE hadn't tried to change the existing city smoking ordinance?

MisterO, I also appreciated your remarks. Those "pro-Semitic" comments haven't set well with me either, but I haven't been able to pinpoint why. You nailed it!!! This never had anything to do with races or religions and, besides, I thought it was important that we all knew that the Holocaust was real and know how it came into being so it would never happen again--to anyone. irish's statements were oxymorons..................
And as to communism being dead!! A myth. Have we forgotten about a big chunk of Asia that we call China? Communism is pretty big over there as well as North Korea and just a bit off of Florida in Cuba (to name a few). To say any form of government is dead is a very naive statement--all of them are still alive, although some are more dormant than others, waiting for the conditions to be right to sprout up again. But certainly, none that are currently claimed can be listed even as dormant.

We've already talked about this and yes I believe that what was wrong with the last 8 years was that the "right wing" was acting like the left in some very big ways. So I fail to see the logic in continuing in the direction that is the problem.
Maybe Bobby Jindal can bring the Republican party back to their core values when he is elected President in 2012. Hey a guy can dream, right?

I'm not Steve, but I can answer this: because the CAE declared war on local business owners and there are two sides to every war.
For a look at the reasoning of certain posters, look at the "The Wrong Road" story forum where someone who is always a victim of others' actions felt wronged upon learning that Steve is, in fact, personally offended that his business is under attack, including by that poster. That poster then threw a fit and declared a boycott. A second poster jumped on the "ban wagon" and there you have it.

I had finally had enough of ole crackys nonsense and told them if I knew who they were I would "BAN" them from my bar. Told them what I thought and they decided to "Boycott the bar". Then enry8 decided to join in, because "I forgot who pays the bills", the customers. What they BOTH forgot was ,so far the customers I have now are paying the bills, and it is MY decision, so far, on whether I want to run them off to get new and better non-smoking customers. If all non-smokers boycotted all smoking bars, there would be no need for this ban. When crack gets back tomorrow you can talk to her about it.

While I support the ban, I think this whole discussion has gotten far to personal (yes, I am equally as guilty and am ashamed of my behavior the other night). I've said it before, smoking or not, I admire anyone who is willing to run a business, especially a bar. If the ban passes, I'll be a regular in both your's and Matt's bars. Not because I want to "rub it in your faces," but because I want to support your businesses as I promised. If it doesn't pass, I won't be stopping by -- not because of any boycott, but because i want to limit my exposure to SHS.
Whatever happens, I hope you have a long and profitable business life.

You and some others feel that SHS exposure is unhealthy or irritating to yourselves. By exercising your CHOICE to avoid my business, you are in effect, boycotting it. That is fine with me, it is your right, and most of all it is your CHOICE!
Others feel that the health issue is not proven and the SHS doesn't bother them. By coming into my business they are giving me my niche market. That is fine with me, it is their right, and most of all their CHOICE!
Both sides have a CHOICE now.
After the ban they won't
Why is that so hard to see?
If I thought a non-smoking bar was the right niche market for me, I would have already done that, by my CHOICE!

And that is really good news for the bars that used to allow smoking, who may lose 5, 10, 20 or more regular customers.
I suppose that those bars should be happy as a pig in a waller that they are going to gain 1 regular customer , maybe, after losing possibly 5, 10, 20 or more of their regular customers. Really makes dollars and " sense" to me.

I have made the business decision,(so far) to allow the use of a legal product in my bar, as it is my right to do that.
Beginning March third, I will no longer have that right, and neither will my niche customers.
Until the air quality in my business is proved to be toxic under governmental levels, or the sale of cigarettes is illegal, THIS ban takes away the rights of a certain group of citizens for the convienience of another group of people. That is discrimination and that is not the American Way.
