Arrest made in weekend shooting

A 32-year-old Emporia man is charged with first-degree murder in the Sunday shooting death of Jose Leyva Arroyo, also known as Samuel T. Rosado.

Jimmy Anthony Dominguez was booked into Lyon County Jail at 5:35 a.m. today. When he was booked in, his address was listed as 1321 Neosho St. He is charged with first-degree murder and attempted first-degree murder, according to the jail log. No bond has been set yet.

Dominguez was arrested around 2:30 a.m., according to Police Chief Gary Smith, after the EPD SWAT team “extricated him from a residence in Emporia.” Dominguez is accused of shooting Arroyo on Sunday morning at a home in the 500 block of South Union Street. A second man, 28-year-old Juan Jose Rosales, was injured.

Smith said earlier this week that Arroyo and the alleged shooter had been at a dance at the Anderson Building on Saturday night, where an altercation occurred. From there they went to a bar, Smith said.

“The guy who was killed went back to his house and they were in the garage drinking there,” Smith said, adding that the shooting took place when the victims stepped out of the garage.

The investigation into the homicide continues, Smith said, with help from the Bureau of Alcohol, Tobacco and Firearms and Immigration and Customs Enforcement.

“We expect to arrest at least one more in connection with this,” Smith said, but Dominguez “is the primary suspect.”

The arrest, Smith said, came from “developing information through pretty good police work by our investigators, including Mark Senn, who’s the sergeant back there now.”

At least one of the suspects is in custody, hope the other one is soon. And I hope the County Attorney can have a successful prosecution and conviction in this case.

To the EPD: Good job! It is somewhat chilling to think that the person charged may have deliberately waited outside of Mr. Arroyo's home to gun him down after some stupid argument. That's the folly of youth and testosterone in combination with alcohol. I'm just glad I grew out of that phase of my life without hurting myself or someone else.

Yes, jamesbordonaro, I agree about the chilling part. I wonder too whether he actually lived at 1320 Neosho where he was arrested, or whether he was hiding out there. If he was hiding out there, I hope the police also arrest those who were letting him.

And I would like to again offer my condolences and sympathys to the family and friends of the loved one who lost his life in such a tragic act of unnecessary violence !

This wasn't a kid that(allegedly) did this. He is a 32 year old man. I'm sure he has to shave everyday like an adult man. When I was 32 I had been out of the Army for a decade, I was a veteran of the U.S. Army for a decade, not a youth. I had been a home owner for eight years, not a youth. 32 is not a youth. Just sayin'.

For 2010 Gary Smith's New Year's resolution should be to rid our city of the illegal immigrants he chooses to ignore. Everyone is so concerned about taxes and rising costs, I can guarantee we would see some immediate savings if this law was enforced. A few of us have written our Congressmen about this issue, my only hope is that people quit injecting the race card into the equation, the issue has nothing to do with race.

I haven't weighed in with any comments before now but I don't think you can completely say this crime is without ethnic undertones. Emporia clearly has a somewhat anonymous undercurrent of illegal immigration and that surfaces in crimes against persons more so than what our city leaders openly acknowledge. What I'd like to know -- and I wish we had more aggressive media to find out -- is who personally rented the Anderson Building that spawned the dance that eventually led to this murder? We'd like to ignore the roots that this underground community has in this town but they are here. Point is we look the other way. Or like the Gazette and KVOE, we don't even have anyone on staff we speaks Spanish. We don't delve. We act surprised when we shouldn't be. I know this isn't the first nor the last crime to be committed in Emporia that involves a largely silent and unknown community. Obviously there's some kind of safe harbor that exists here. It has for generations.

Excellent post, railroadhorn, and I definitely agree with you. But apparently some posters who have pulled their heads into their shells will call you out. Not I. You say, "Point is we look the other way." Absolutely true!

Some will say that it matters not who rented the Anderson Bldg because the crime took place elsewhere. But the deadly seeds were planted at that dance.

Skirmishes and even crimes of different levels have gone on for years at the Anderson Building dances and still no more than light private security is required.

Witness all the "mind your own business" posts that have taken place on this forum, and we can see that safe harbor you refer to. Yes indeed.

Dear railroadhorn - "create" was correct in saying that it matters not who rented the Anderson Bldg because the crime took place elsewhere. But I've been there many of times and have witnessed many fights from Parties, weddings and fair dances. Which included Whites, Hispanics and AfricanAmericans. I agree the security is usually limited, but that is why people who rent the facility have to hire security. And if things get too out of hand then the police are notified.

I myself have rented the facility and I had to hire security. And yes we had an "altercation" which involved Hispanics, but they were from here born and raised. Not Illegals! It was all because of the alcohol! I was even present when a fight broke out right after a country dance, but it was outside by the livestock pens. I had to step in and broke up the fight because the security was busy with something else . And why? Because they were really drunk. PEOPLE, young and old who like getting high, drunk and stupid at the same time are the ones that cause the trouble. It's not a race thing! Alcohol is the #1 cause of these problems.

Oh by the way we are not an "underground community" we are very much above ground. And yes I do believe that the media outlets have people who speak Spanish. In fact, I hear a Spanish program on KVOE and read a Spanish newspaper once in a while.

So congrats to the EPD for capturing the shooter and Hopefully everyone can have a Feliz Navidad and a Positive New Year!

I agree 100%.

I think that even though this incident did not take place at the Anderson building, that the county will probably re-visit the terms of renting out the building. Possibly by forbidding alcohol completely on fairground property. While I don't think that would be the answer, I have heard rumors to that effect.

There have been many incidents over the years that started at the Anderson Building...involving several races and groups ....and some revision of the rules may well be in order. But at the risk of being accused of coddling criminals......stopping alcohol consumption at the Anderson Building will not only not stop it there....it will just move it to unknown locations.

Telling me to become Police Chief is just idiotic. I have a career and changing it midlife is not an option. What I can do is make certain agencies aware of the illegal immigrants that are being harbored in our town. I can be proactive and inform media outlets(since the Gazette is fine with us being a sanctuary) our elected officials and at some point if I get some names make a citizens arrest( if for nothing else than to make a point). I don't care what color your skin is, I don't care what language you speak, if you are here illegally, you are in the wrong.

I'm not sure why everybody thinks that the illegal immigrant problem is specific to our fine community. It is wide spread and will only be solved when business owners/operators are held responsible for hiring the illegal immigrants. Think about it....no job = no way to stay in town. It's not that I wish anybody, legal or illegal any bad will, I just want for people to go about being here legally...there are ways to do that ya know.
Now, that being said, I think that the ignorant people, not the illegal immigrants, are the problem here. First of all,according to a friend of mine from KCK PD, local police cannot enforce federal immegration laws....INS/ICE can only get involved when the person is wanted by INS/ICE or when they have been convicted of certain crimes and they are illegal. Stop bashing the cops for not deporting people..they can't do it.
Lastly, for all of of you complaining about the ethnic color of crime here, maybe you should pay attention to the court dockets. There are just as many Caucasian and African American offenders as there are Hispanic. Also, remember that the Hispanic community is rather large here, so proportionately, the criminal activity may be divided equally.

Cops who know of illegal immigrants can contact the appropriate authorities, not be quoted saying "we are not concerned with that". I think a certain Sheriff in Arizona has made some progress arresting Illegal Immigrants and turning them over to ICE/INS. I just really have doubts about our PD and their allegiance, last summer there was a protest at 5PM where a bunch of people walked over the Prairie bridge, holding up traffic, when there is a walkway along the bridge. The police department supported them, I even saw a certain detective shuttling water to them. Protesting is fine, I support that, but I can't for the life of me fathom how that was either legal or justified, they pissed off half the townsfolk they held up. I asked this question politely to an officer and was told the "shut up and sit there"

So adding all this up no wonder I think our PD is a complete joke. Who wouldn't?

Well, I am certainly glad this event is nearing resolution. Seems alot of people are blaming alcohol for the problems. Could the opiate of the masses a.k.a. alcohol be banned next? Seems I heard a parade permit was granted for the walk across Prairie Street. Dunno about the water provider guy. Maybe it was family of his? Just guessing. I have also heard that INS isn't interested in illegals unless/until the local cops round up 20 or so at a time. The street cop does what his supervisors, and that goes all the way up to the cm and the commissioners, tell him/her to do. So "we are not concerned with that" maybe they're told not to be [concerned].

We all need to stop all the RACE CARD ISSUE, What we really need is for our legislatures to step up to the plate, including WASHINGTON!!! I work hard for my money every week. I had to take a drug test to get my job and money and I continue to do so after I get hired, called a RANDOM DRUG TESTING. I pay taxes so others can have. Why don't we have a system in place for those on WELFARE to go through the same at getting their money, they need an action plan like we all have. I'm tired of giving money away to ABUSERS.

I'd think that sounds like a great idea...but FarmRaised might be right about the cost...we might end up spending more that we save......don't know though. But maybe we ought to go a step further and include alcohol testing. After all if they need government help to get by they don't need to be setting around drinking all day.

I'm not sure than the drug testing would cost more than it would save. Even if you randomly testing 1% of recipiants on wellfare, you would probably be getting enough people off of wellfare that tested positive to cover the cost. I might also agree with the testing of beer and cigarettes. I don't like telling people how to live at all. However if you're going to depend on me (my tax dollars) for food, then maybe you shouldn't be spending the money you do earn on unneeded things. Ask grocery store cashiers how many times they see people come though with a big cart load and pay for it with a vision card only to ring up the 30 pack and carton of cigarettes seperately.

My condolences to the family of the deceased.

I know Jimmy Dominguez, he went to Emporia, Kansas to work hard and take care of his family. He is kind to everyone. He always helped his neighbors regardless of their color of skin. If you met him, you would say the same.

Everyone who reads this post, please know that sometimes innocent people get blamed for things they did not do. Of course, the evidence/alibi/testimonies will prove he is innocent. I just hope he gets a fair trial and that his color of skin does not automatically make him guilty.

I also hope that the real shooter is found and brought to justice.

Some of us are fed up with law enforcement turning a blind eye towards a problem that has become a massive burden on the taxpayers of this nation. Our police chief all but declared us a sanctuary city in an earlier article, some of us are trying to be proactive about the problem, and more to the point would like to see some effort out the public servants we employ.

So we have illegals not cooperating with a murder investigation, and Police Chief looking the other way. What more do you want? Illegal Immigration costs this country close to a trillion dollars a year. Open Eyes and my self have presented plenty of credible data from sources, there is a plethora out there, I find it hard to believe you cannot find it. At last count it is estimated that each tax paying citizen pays out approx $225 a year for subsidies to illegal immigrants, so if your married, one could see about $500 a year is tax breaks, and that is just on what we can measure. It's sad when it takes a recession/businesses downsizing to thin out a lot of our problems we have faced with this issue in this town, clearly our public servants do not care, as evidenced by the above quote.

Disclaimer: nowhere above did I mention race, illegal immigration knows no color, and this is not a racist issue, it is about the law.

Sometime ago a poster wrote on a completely different thread about some problems his ex-wife had experienced. The thread was about burglary and his ex had apparently had something burgled...on several different occasions....by one or more burglars. The way it was written was very funny. And though he never mentioned specifically what it was that had been burgled, it was immediately clear to all who read it just exactly what he was talking. So it is not always necessary to say what you mean for people to know what you mean.

Now.....many of the post expressed here have no covert or overt racial undertones that I can see. And anyone whose feelings on this topic might be driven by either overt or covert prejudices would probably not reveal them openly in their remarks. anyway. But a cursory reading of the post on this topic over the past several days certainly appears to me to show an undercurrent of strong emotion not always present when discussing other problems dealing with those that break the law. And to claim that all this outpouring of emotion on this and it's related threads has no connection to things unsaid doesn't mean those things unsaid are not being heard.

To me it is as foolish to deny that the specter of race and prejudice has anything to do with this topic as it is to claim that it is all driven by race and prejudice. Neither extreme is true. But any real conversation seeking solutions must include a recognition that it is there.

This, like all my opinions is just my opinion. And it.....like all other opinions expressed here...only goes to prove once again that opinions are like a--holes....everybody has one.

Right now.....on another thread there is a discussion taking place about the legalization of marijuana....and or many currently illegal drugs. Possession of these drugs at present are against the law and the people that possess them are criminal. In addition the war on these drugs cost us a hugh amount of tax payer money. And yet that discussion is taking place without the anger and hyperbole often witnessed on this and it's related thread. In fact, some sympathetic views are being stated by some of the same people asking over here "What part of Illegal do you not understand?".

My question is why?

A lot of illegal things come over the borders without permission, TB, flu, HIV, drugs, etc. The smugglers worship the all mighty dinero and nada mas. The gangs that bankroll and organize them are the same ones invading our cities. As far as I am concerned they are enemy combatants and deserve to go to Guantanamo (but not near the west beaches where the snorkeling is great).
