The Emporia Police Department has released more information on a shooting that took the life of one person and left another in a Wichita hospital. The shooting took place after 2:30 a.m. Sunday morning.
Jose Leyva Arroyo, 25, also known as Samuel T. Rosado, was killed in the shooting that took place in the 500 block of South Union Street. Juan Jose Rosales, 28, was injured in the incident and is in a Wichita hospital.
Arroyo lived at the home where the shooting occurred. According to a press release by the Emporia Police Department, the address of Rosales is unknown.
Emporia Police Chief Gary Smith said this morning that the investigation is ongoing and more details are emerging. The shooting does not appear to be gang-related, Smith said.
“From what we can determine, this was a very personal kind of confrontation,” Smith said.
Smith said Arroyo and the shooter had been at a dance at the Anderson Building on Saturday night, where an altercation occurred. From there they went to a bar, Smith said.
“The guy who was killed went back to his house and they were in the garage drinking there,” Smith said, adding that the shooting took place when the victims stepped out of the garage.
Smith said no arrest has been made in the shooting, and the person the department is investigating has a strong Wichita connection.
“In the process, we identified two groups of people that weren’t even involved in the shooting that had guns in their cars that were from Wichita,” Smith said. “That brings a bigger issue to mind.”
Smith said the department is working with a lot of street names in the case and that many people are not being cooperative, as some aren’t legally in the United States.
“So they don’t want to cooperate,” Smith said. “We’re not going to be concerned about that (legal status) ...”
Smith said the Emporia Police Department is working with a wide variety of agencies in the investigation, including Alcohol, Tobacco and Firearms and Immigration and Customs Enforcement, along with several other agencies in other towns and also out of the country.
“It’s one of those spider web things, it tends to shoot out pretty fast,” Smith said.
The act of brandishing firearms has been a concern at social events in Emporia, Smith said. He added that Emporia police officers will be more aggressive in cracking down on anybody involved in altercations with weapons.
“If you bring your guns to a party you’re going to do hard time,” Smith said.
He added that the department is working with the Lyon County Attorney’s Office to enforce gun laws.

All I can say is that I am terribly ashamed of my hometown. I moved out 2 years ago and all I can say while I read all the posts from you Christian, Loyal citizens it makes me sick to my stomach how closed minded you all really are.
A life was lost for still unknown purposes and you sit there and you judge people of what their legal status maybe? It really is sickening to me.

Despite the recent shooting Emporia is a pretty quiet a safe little town by most standards, this SHOULD be a concern and I gurantee you that this will not go unoticed.

I would also wonder why our Police Chief is not concerned with certain lawbreakers legal status, the last I knew being an undocumented person was against the law. I recently paid over a $100 for a passport to get into other countries when traveling abroad and getting back into our country, I guess that just applies to law-abiding citizens who are in a class of their own. I also disagree in that everybody thinks that because someone is here illegally they are bad people. People who are here legally as well as illegally do the exact same thing. It shouldn’t all fall back on those people who are here illegally.

What I don't understand is this. Nearly every time there is a dance at the Anderson Building, there is either a stabbing there on the premises or some kind of altercation similar to this one takes place. All the little fighting cocks need to show off. This means they are armed! This burns me up because this is my town that is endangered!
Then they take their arguments to a bar where they mix more booze with gunpowder. True Mexican standoffs. Many innocent people at the bar are endangered.
This is so common whenever the Mexicans have a dance. Isn't it time the city required city cops, not just blind security guys to be there?

My ancestors came through Ellis Island and were processed into this country that accepted them with open arms when they adhered to the system. They did things legally all the way. I am more than glad to accept any immigrants that do so properly within the system, I am the offspring of immigrants. Why should the Mexicans have an advantage over the Chinese, Russians, or Africans. I understand that there are strong feelings in both directions for and against immigration, but I am certain that in the area where I live, NO WHITE MAN/WOMAN is out in the fields picking the crops, planting the crops and there to work in any aspect of agriculture, but many of you would complain if the prices were to rise and you had to pay more for the food on your table.
There is good and bad in ALL races. Once you learn to work together with your neighbors you will feel better about who your neighbors are, they are not all bad.
Just think about it. I live in a vast melting pot of many different races and the only time I see this type of negativity is when I come back to Kansas, that is sad.

My grandfather was an immigrant and came to this country and worked in the sugar cane fields. Chopping cane, vato, that's hard, hard labor, man. But he taught himself English by reading old newspapers at night. He listened to the patrons talk. He saved every penny he could and bought one cow. In time, he turned that one cow into a dairy.

Because if I do , I would be disrespecting and slapping the face/faces of all those citizens who are " LEGAL, HARD WORKING, LAW ABIDING . TAXPAYING " , citizens of that country any country ! I don't know how many people posting on this thread or any other thread are in this country " Illegally ", you know who you are and you know you are not abiding by this countrys laws by being here " Illegally " !
And you know you are working at a job and taking money that is not " Legally " yours ! I do not entirely blame you for this ! I have to place a certain amount of blame on the people/businesses who will hire you and the government who will not force stronger and tougher immigration reform and policys to prevent this from happining !

Will yes i knew there are some people out there that have no problems with illegal or legal hispanics and im thankful for those people. Some years back I lost a beloved cousin, when he was shot to death in his church praying, by a cowardly S.O.B. foreign, immigrant from China or Taiwan ! Funny, I thought this was an investigation. An investigation that might progress quicker if the illegal immigrants mentioned in the article would cooperate. It's pretty clear to me, people know other won't say anything because they are illegal, so they know they can get away with murder literally. Whats sad is that some people here are likely defending this and in that action, hindering justice.
To this I say:
Shame on the Emporia PD and every legal citizen of this country for not being upset about the flagrant ignorance of our laws. I hope Gary Smith extends the same leniency to ALL citizens that break the law and stops favoring certain races, because like it or not this is favoritism for ALLOWING people to break the law.
I refuse to pass judgment on the guy that died, but after what I am reading from the PD I am having serious reservations that they can be trusted.
One last time, race has nothing to do with this, this has to do with laws and abiding by them, those that want to play the race card by all means keep doing so, you only denigrate your cause further by crying wolf.

My sympathy to the family and friends of this young man. Unfortunately the conversation has turned into, who is legal, who is not, who bears arms and dances at the same time.... The shooting did not happen at the Anderson building or the bar. This young man was shot outside HIS home. I doubt he invited the shooters over for a drink. Altercations happen all of the time when people are out not just when Mexicans have dances. I seem to recall beatings that ended in death and no one was Mexican. Sounds premeditated and the shooters are still out there. Don't anger anyone in Emporia they might follow you home. RIP

Its sad that all these shooting have happend around the Emporia area. All walks of life and races are capable of violence. Its a shame that people are not willing to cooperate with the police on this shooting based on the legal status. If they are friends of the shooter you cant really blame them. If one of my friends commited a crime I wouldnt sell them out till I sat in jail for awhile. No where in this news column has it said the deceased or injured where illegal or not, we dont know if the shooter is a legal citizen or not, So we shouldnt be quick to assume their legal status. For the ones refussing to cooperate with the police should be held till the shooter is caught and deported. This isnt the place or the event to spark an immigration debate.

Sounds reasonable when ya first read it; but one is left wondering, who Do you blame more? Do you blame them all equally?
Sure it's fun to blame the government, as if IT is some kind of entity separate from US, but IT is not. As a part of OUR Government MrC would like to say, sorry we haven't done more to keep them separated from you. We tried just saying "No." That failed miserably. We tried enacting laws and legislation, but those just ended up trampling on our own rights; some of which The Almighty Herself gave us. Some of US even thought it wasn't totally dopey to build a big ol' fence down there to keep 'em out. Of course that didn't work and never will, because it is totally dopey.
What would YOU have US do? Perhaps we should all join the Minutemen and arm ourselves an' move down by the border to keep an eye on 'em. Who knows maybe if we killed a few million of 'em they'd know we mean business and stay away of their own accord. But again MrC is afraid that wouldn't work either, besides it's so messy. Not to mention it's kind of like the gold mine owner; who so afraid of thieves, sits atop his goldmine with a shotgun until he starves to death.
No WE the government cannot keep those who are just a stones throw away from crossing a line that to all but us may be imaginary.

It is after all a telling message you good folks send out at a particularly telling time of the year.

Of course it doesn't say that everybody is going to lose their guns, but unfortunately, some may construe it that way.

People read the horrible comments of others and they point out how horrible they are and snuggle up against them in hopes that by comparison they themselves look really good. This may be true for awhile but eventually the true yardstick that we will be measured with will be held next to us and we, no matter how righteous we think we are, we will realize just how far we fall short. We will find ourselves standing no taller than even the person who pulled the trigger in this tragic crime. The One in whom we will be measured left the comfort of His Father's side to live in this world the perfect life that we ourselves cannot and died the death that we deserve out of love for us and His birth is the one we will celebrate in a few days. I pray that the family's of the victims and the family of the perpetrator are comforted by God in this very difficult time.

Before my 13 year old was killed several years ago, he wrote a paper in his class and wondered why everyone in the world just can't get along and be friends with each other. When I read posts like I have read here. I think it is so sad. I think he was a very smart 13 year old. Who just wanted to be everybodys friend.

I am so glad the 1st amendment is still alive and well in Emporia, it's great everyone on BOTH sides of these issues were allowed to speak their minds, it was enlightening to me to hear the other side. The thing that struck me most is that there are many people who think many of us are racists when we are not. I would love to see some of my German and Russian ancestors come to this country if they wanted but would expect them to go through the processes that our country has in place, plain and simple. What is so hard for the other side to understand about that? I have 3 Mexicans in my home right now, doing warranty work, I trust and respect them and do not feel any hostility towards them. They may be legal or not, I know the only English being spoken is when they speak to me, but it is insulting to me that some people think I am racist because I want our laws enforced. I thank the Gazette for allowing people on both sides to vent and speak their minds, even though there were some pretty strong statements from both sides.

It's tragic that someone had to die here, that lead to a headline, that lead to these posts, that turned from talking about a tragedy and really how it may have come about, pure speculation, as everyone does from time to time. Because let's face it assumption is what happens when there is too much unknown, but I digress...
This turned from speculation, to being angry and at odds as to how to find justice. Then from there, it dropped into a bottomless pit of hatred, and thinly veiled threats from some.
I would like to say this, I do not hate anyone for who they are, it doesn't matter to me where they came from. Character is what determines how I feel about you. I'm pretty simple that way.
Some people on this thread have perhaps gone too far, and many realized that they got overheated and have apologized for offensive comments. I too will apologize for any comments that seemed unsavory to whomever. There are some who are just continuing to spew hate and incite violence.
Being reasonable, the ability to agree to disagree, and apologizing for hurtful actions, shows true character. I am glad there are still people here who can do that. To those who cannot, you haven't looked deep enough.

I am an out-of-towner reading these comments and honestly I have heard all of this before. These aren't just arguments in Emporia, KS. Different people have different opinions, most based on personal experience and I respect that. I am no stranger to Emporia either. My opinion, based on personal experience, is if you don't like living in Emporia, then go somewhere else. If you can't leave Emporia for some reason, then try to make the best of it. Spewing negative words won't make things any better. Once again, that is just me opinion based on my experiences. I am by no means telling anyone that they need to leave Emporia. It is an opinion and everyone is entitled to their own. I do like reading Steve's comments as he sounds very level-headed and concious of the different audiences reading these comments. I appreciate how he and several others have noted that things got out of hand on here. Using profane language doesn't help make an argument any stronger. I pray for the families involved and I hope that the person who did this is brought to justice. I wish everyone in Emporia happy holidays and safe travels!!!

For whoever made the comment about Portugal - that was over 100 years ago. Back then, it was much easier to get into this country. All of us have immigrant ancestors - whether its from Europe, Asia, Africa, South America, Central America, etc.

All I mentioned was that if an immigrant was in a country legally, then fine, if an immigrant was in or entered a country illegally, then that was not fine and that they were breaking the laws of that country ! I stated, what I personally perceive as the reason for the problem ! And have been severely chastized, been called stupid, a bigot, racist, cursed and told to " shut the f-ck up ", to get a life, been accused of saying " were mexican'z are the bad one ", threatened with harm or possibly with death by being shot by " a shooter " that someones family may know ! And yet after all this, I am the bad one !
Well, people, I am done with trying to show what one of the Big Problems with the situation this country is presently in and how to possibly fix part of the problem ! Because no one wants to hear what real lifes problems may possibly be and what the remedy may be, no matter how distasteful or drastic the remedy may be !
I will just set back and watch this country sink further and deeper into the pit of dismay and dispair it is already in, without any climbing out or way back from the abyss this country already has one foot in !

Actually, Landa, it was much more difficult to immigrate to this country 100 years ago than it is nowadays. Back then, people had to register according to their national origin. Only so many Chinese could enter, so many English, so many Portuguese, so many Irish, so many Germans etc. There was a quota. You also had to have a sponsor or a job waiting for you when you arrived. That was the legal way.
My grandfather registered in Portugal with English labor agents who gave him a job on the sugar cane plantation before he even left Portugal. They paid for his passage on a ship then he went to work as soon as he arrived to pay back the passage money. It was deducted from his salary every month.
Nowadays, it's a lot easier, isn't it?

I think something that needs to be thought about here, other than the race issues, or the police response issue is the fact that there have been two very questionable shootings in the past few months.
I think that we need to read a little deeper into the story:
“In the process, we identified two groups of people that weren’t even involved in the shooting that had guns in their cars that were from Wichita”
This is something that needs to really needs to be an issue of concern. If we have people in this town from Wichita and Topeka carrying guns in there vehicle’s, doesn’t that strike some concern for you? Anyone?
Here’s what I see happening:
With Omar Flores death and now the death from this weekend, people are getting angry. I’m not saying that either one of these men are gang affiliated or not, but they have friends and family that are not happy about either one of these incidents.
Where I see this going :
A. We have another shooting, stabbing, etc.. Retaliation? Maybe. Mounting tensions? Maybe.
B. We have person shooting at our police, sheriff’s or troopers.
To me this doesn’t seem over.. by a long shot.
What concerns me and I hope concerns you, is that our police/sheriff/troopers are stretched out very far. VERYYYYY far. With very limited resources.
If this is a gang situation, we are not equipt to deal with something that gets any further out of control. We just aren’t. We do not have enough officers, equipment and training.
I have said before on these comments that our police forces are amazing. Far and away we are luckier than a lot of small towns in Kansas. But you can only expect and ask so much of a person. They can not be everywhere at once.
While I have no opinion of Chief Smith, I think his priorities are not where they need to be. He is too busy with too much talking and not enough DOING. We have got to gear up for what’s going to happen next.
I don’t care if you are white and hate Hispanics or a Hispanic that hates whites or you all love each other or whatever, we are all here now. There is no changing that. Emporia has always had a tight knit Hispanic community and a part of the population that does not like them. Either way.. both sides aren't going away. The simple fact of the matter is that these two shootings have now put Emporia on another spectrum as far as criminal activity.. That’s our truth now. And if we want to change it, we need to start taking the community back.
We need to stop talking about what happened before and who did what and start thinking about what to do NEXT.

I disagree with your take on the past. One must relate to the past in order to grasp the present problems.
This isn't the first time that rivals have made themselves known in Emporia. It used to be guys from Topeka who would show up every time there was a dance. They were armed with knives, and more often than not there was a stabbing. Usually it was over some woman. But back then, drugs weren't even a part of the picture. So they toked a little weed and shared it out in back and bragged about who had the good stuff. Most of all, those roosters were spoiling for any fight just to count coup. Just plain old machismo, nothing more. Some would even crash wedding dances which were private. Always there was hell to pay in flesh. I've been to many, many dances over the years where many fights and stabbings took place. Often the stabbings were small cuts, never serious. But this was La Raza or locals with a long-time Emporia or Topeka connection. Now, its more complex with people and customs from all over south and central America.
Now the rivals are from Wichita. Now they're armed with guns. So the problem is escalating. So what now? Notice I have not used the word gang.
With our resources stretched so thin, and the possibility of more budget cuts looming, we will have to work with even less. Who will scream the loudest?
You can't stop rivals from coming to Emporia. How about gun control? I can hear the screams of "we have the right" now. Besides, if I check my gun, how can I trust my neighbor to check hers?
What about closer controls of drug pushers? The police know who they are, at least some of them. More arrests. I have had drug activity in my neighborhood, but when I reported it, was told there wasn't enough "probable cause." I always wondered why they didn't come see for themselves.

So, in all this, how come no one has suggested tighter rules at the Anderson Building? How many of these fights start there? Can the hours be restricted enough that these parties no longer go there? I thought that security was required for events that occur there. Why not make tighter requirements for private parties, and maybe lesser ones for groups with a non-profit status like beef fest? It seems to me that there is no secret that big drunk parties are out there, so why don't we hear from the fair board or the county commission? We had to keep the thing in town, so it ought to be regulated tighter for public safety. As it is now, it seems to be the biggest gun & knife club in the area.

And you don't do the same thing. All of this started when I said I was shocked by some of what I was hearing from people who's opinion I normally (or maybe usually) respected.
You then twisted that to mean that I no longer had any respect for any of them.
That is your usual all or nothing mentality. A person can agree with 95 per cent of what you say......but let them make one negative comment and then old methusla is railing on about how we won't have him to kick around anymore and he will quit posting forever. This has happened with such regularity the last time you did it people were taking bets how soon you would be back.
Since you sir have taken it upon yourself to explain what is wrong with me......let me then explain to you that your anger and your apparent inability to take what you dish out is getting to be something I see more and more often with you.
While many others apparently feel the need to coddle you and make you feel good......I sir......being the same age as you.....feel no such compulsion.

The more I think about this the madder I get. You have zeroed in on me for all the disrespect I have heaped on you just for stating the truth. I have gone back and reread the posts in question and I believe you sir do not even know what you are talking about.
True to form, your massive ego allowed you to take my post about people that I normally respected and convince your self that I had to be attacking poor you. The truth is that post of mine was made a full three hours after your last post and was not written with you in mind at all. Truth be known it was written about two others that I chat with a lot and still do respect on virtually all other topics. If you could quit feeling sorry for your self long enough and go back and read it in context I believe that would become quite evident.
A few minutes after I made the statement that wasn't about you, you quipped that if you were the one who had lost my respect you figured you would survive. Although my disgust with the over all nature of the dialogue increased I still never mentioned you by name nor particularly had you in mind until after your little duh...dumm ...drool tirade caused two other posters to ask you to chill.
Then when I responded to one of your post with a couple of questions you went off on me first and that is when I started personal remarks about you.
So old boy......you didn't start out losing my respect......but now I guess you are just gong to get to survive. And this is the truth...go back and check it all out.

1. The family photo you speak of was NOT posted on the forum by myself or anyone in my family. I don't have a clue how it got there.
2. The signs on the wall of my "dive" are old advertising signs as well as pictures, old and new. You may be to young to remember that way back there were advertising items depicting people of color in an unflattering manner. It was part of our countries history, and you would probably find those signs in many a museum. So I will not apologize for them, just like I won't apologize for the fairy soap and Indian motorcycle or Big Chief signs. The days of political correctness are over for me. The fact that YOU found them offensive goes to prove my #3.
3. I am of the belief that there is a certain degree of racism, (per say), in all of us. It's human nature. People like sameness and are wary of those that are different. It is how people react to those feelings that bring the negativity or positivity to their lives. We all judge one another rightly or wrongly, based on 1st impressions, race, age, intelligence, whatever. Am I "guilty" of it?
You bet. I'm only human. But my New Years resolution will be to work on it so next Christmas I may join you in your perfect world.
But then the TOPIC was a shooting incident wasn't it?

I am one hundred per cent in agreement with your #3. People seem to be very thinned skinned when it comes to somebody suggesting that what they are saying might sound a bit racist.
But truth be known we are all guilty of a certain fear of those different than us and comfort with those more like us. And that's the truth no matter which side of whatever border your on that you might be talking about. Why people are so uncomfortable with that is beyond me.

I for one do not want nor need you or anyone to coddle me ! As for me leaving these threads at times, I do so when I feel that I may say something that may be hurtful, derogatory or demeaning, to someone ! Which is something that some on these threads do not do !
I could tell you what my exact words were about your loosing respect for someone, anyone, because of their comments, thoughts or how twisting ones words is done by most everyone, at times, you included ! But that would not serve any useful purpose ! But you must remember one thing, the lack of , loss of or earning " respect " , pendulum, so to speak, swings both ways and you are not immune to lossing or loss of the respect you once may have had !
I will no longer address such a pompus individual, who evidently believes he has no faults at all and his every comment is the absolute " gospel " and are not derogatory, bigoted, racist, insulting or demeaning !

Isn't that just quibbling over semantics. Racism is a problem---no prejudice is the problem. Racism clouds our thoughts and decisions---not that is prejudice that does that.
I once had a poster that spent sometime trying to convince me that the definition of racism was so broad...that by using her definition....virtually everything could be called racist.....so then in a way it could be applied to nothing.
So I don't care what you call it...call it pea soup....insert what ever name in its place you want....racism is still a problem here and everywhere.

for the illegals who have tried to become legal its a long process, so long that sometimes that have begun setting roots here while they are waiting to become legal. with your slave theory, as long as the process is long, there will always be plenty of illegal, low wage workers. there should be some way for the large numbers of immigrants to be legalized in a reasonable amount of time. although i dont know anyone involved in the shooting, i wasnt because they were hispanic, it was the bad mixture of booze, arguments and a gun.

I certainly hope it will not be interpreted differently by me. Now calling for concrete and positive steps towards the elimination of the illegal immigration problem in this country is most definitely not racist. Being concerned about the side-bar problems and cost caused by those estimated 12-million people is not racist. Wanting.....even demanding....that the government do something about this problems is not racist. Realistic immigration reform is not racist and in fact has my support just as I'm sure it does yours.
Making disparaging remarks about a people and their culture.....making fun of their lack of full understanding of our language and customs......and treating them with contempt and ridicule may not be racist in every instances....but it certainly is a strong indication of some potential prejudice at the very least.
It would be foolish for me to sit here and say that everybody that spoke out against illegal immigration did so out of racism....but it would be equally foolish for people to try to convince me that the above mentioned types of ridicule......when injected into an other wise legitimate concern about a legitimate problems...is not steeped in prejudice at least if not downright racism.
One other poster mentioned at one point that he thought he could tell the wheat from the chaff....[my words..not his].....and I like to think I can also. But when the wheat is filled with a lot of chaff it makes it a lot tougher job. So since people obviously take very unkindly to people thinking their remarks might sound a little racist.....maybe they should try and keep as much of the chaff out of the remarks as possible.
This is just my opinion...and in no way is intended to claim that it is the only opinion that is worthwhile on this matter.....nor that I believe that it is an opinion of any more value than any other opinion that might be expressed here.

Your description of the subservient status of the illegal immigrant is sadly often right on target. I've heard horrific stories of illegals from China and other places in the far east being held as virtual slaves right here in the good ole U S of A. It's just another one of the dirty little secrets that is part of this very complicated problem.
This as always is just my opinion...and I hate feeling like I have to say that all the time.
