Medical office zoning request withdrawn

An application for a General Business Medical Office was withdrawn temporarily following Wednesday evening’s Lyon County Planning and Appeals Board meeting.

Tracy Tucker, a general practice physician, brought an application to the board requesting that 11 acres just outside the city limits of Neosho Rapids be zoned for Agriculture Special Use Single Family Dwelling and General Business Medical Office. Tucker, who works full-time as an emergency room doctor, wants to build her home on the site as well as eventually build a medical office at 2112 Road 150.

Planning Board member Phil Mott said the commercial property needs to have its own legal description. He recommended Tucker get the property surveyed and bring the application back to the board for that portion of the property.

The board will recommend approval to the Lyon County commissioners, who have the final say of all zoning applications, for the property to be zoned Single Family Dwelling. The other portion of the application was withdrawn until the legal description is done.

Other applications, all of which gained unanimous approval for recommendation to the county commission, were:

• A request for Agriculture Special Use Single Family Dwelling with Minor Plat by M. Theodore Brown. The property is 30 acres to be split off from 70 acres. The Browns plan to split the property and sell the home with the property. The property has to be zoned minor plat because it is split off three or more times. The Browns don’t plan to build a subdivision in the area. A minor plat zoning is part of the zoning process.

• A request for Agriculture Special Use Single Family Dwelling by David E. Hill Estate. The owner of the land died, and the family is doing an equal value split on the property between two family members.

• A request for Agriculture Special Use Single Family Dwelling by Shirley Hogan for a tract at 2249 Road 170. The home is on 11 acres and wasn’t zoned properly after being split off. Hogan requested the zoning change to bring the property into compliance with zoning regulations.

• A request for Agriculture Special Use Single Family Dwelling by Scott Smiley at 1895 Road P5. The land is on 10 acres. Smiley said he wanted to obtain zoning for a future building site.
