David Foley of rural Clements was sentenced Monday in Chase County District Court for his role in a Sept. 29 incident when he was accused of aggravated assault on a law enforcement officer.
Foley, 62, pleaded guilty to a reduced charge of criminal threat on Feb. 9. Chase County Attorney Bill North said that Foley was given a seven-month prison sentenced, then placed on 12-month probation.
Foley originally was accused of pointing a silver revolver at Chase County Sheriff Richard Dorneker and threatening to kill him.
Dorneker had gone to Foley’s home after a caller to sheriff’s dispatch requested that law enforcement check on Foley’s welfare. Foley had not been seen since Sept. 27, when his girlfriend left the home after a domestic problem.
A special response team from the Kansas Bureau of Investigation assisted the sheriff’s department in handling the situation and taking Foley into custody. Officers from the Lyon County Sheriff’s Department and the Kansas Highway Patrol also assisted in the operation.
Among conditions of his probation, Foley will be required to attend individual therapy, Level I outpatient drug and alcohol treatment and follow all conditions for after-care, plus standard conditions or probation, including a prohibition on being anywhere alcohol or drugs are sold or consumed, submitting to random testing, attending Alcoholics Anonymous meetings, and not possessing firearms.
North said that Foley was very cooperative during the legal process.
