HAS ONE PERSON on the board of directors of Clean Air Emporia or DARE ever served in the country’s armed forces? Has any of them ever fought for the rights and freedoms we have as Americans?
If any of them have ever served, I can’t believe they are now trying to take away our right to allow smoking in private businsses. It is America, Land of the Free, not America, Land of You Can’t.

Newsie: The problem with your argument is that no one is stopping you from breathing all of the clean air that you can take in. On the other hand, proponents of this 21st Century version of Prohibition want to place serious limits on the American rights of private property ownership and the ability to use that property for a profitable purpose. Its been that way for 200 years, and you want to take it away because you can breath clean air in only 29 of the 30 restaurants in town?

Again, how private can a business be when it:
1. invites the public in
2. is already subject to government rules.

NEWSIE; there is no arguing with you.Go to the Town Royal tonight and tell the bartender that you demand all smoking cease so you don't have to breath 2nd hand smoke. When he/she tells you to leave, DON'T DO IT. Stand there and loudly proclaim your rights for smoke free bars. When the bartender tells you to hold it down, DON'T . IT IS YOUR RIGHT TO SPEAK. When the bartender tells you to leave because yoU are bothering the customers, DON'T DO IT! YOU HAVE YOUR RIGHTS! When the Emporia Police pull you out of the Royal and give you a ticket for Trespassing GO TO COURT AND FIGHT IT. IT'S YOUR RIGHT! When you lose your case and are fined along with court costs you will then have a 1st. hand view of PRIVATE PROPERTY RIGHTS.

If you happen to be in any of the Emporia businesses parking lot owned by that business and have a fender bender and call the police, do you have any idea what the police are going to tell you, well I can tell you what the police will say, they will tell you there is nothing they can do because the accident happened on private property and the property owner is the one who will have to file a complaint, so if you think that you have the right to dictate policy, or choice to a business owner you are dead wrong, just as that business owner has no right to dictate your choices on property you own.
I would like all of you clean air advocates to tell me exactly where and what is clean air now-a-days, what with billions of vehicles, factories, power plants, etc. spewing pollutants into the air, also I would like you to try and put a ban on farmers and ranchers burning their fields, now that would be a fight you would never forget.
All of you clean air advocates need to wise up and realize that you have wise choices you can make and not force others to live by your choices and way of life, also just because another town, city, etc. does something, does not mean that it has to be done here in Emporia.

Business owners don't acutually, verbally invite you into their business, neither do they twist your arm or threaten you in anyway to come into their place of business. It is entirely your choice to enter that business or not and if you choice to enter a place of business that allows smoking and you do not want to be in a smoking environment, then that is your bad choice.

HOW ABOUT IT NEWSIE? Are you going to go to the Royal tonight to get your lesson on private property rights? I would love to be there to see you learn this lesson, even if I had to gaze through all that smoke.

I would just like to let everone here know that I used to smoke, did so for over 20 years, however I quit smoking when I figured that the price of smokes was getting to expensive and I have not lit up or smoked for going on 24 years, but I am wise enough and respectful enough of others peoples freedom of choice, not to go to businesses that allow smoking or be around someone who smokes, including my daughter,son and daughter-in-law and they all respect my choice of not wanting them to smoke in my home or vehicle and I am respectful enough of them or any of my friends that do smoke, that when I visit them or travel in their vehicle, even though I tell them to go head and smoke because it is their property and I can go outside their home or roll the window down next to me in their vehicle. Of course I could tell them that I will no longer visit or associate with them because they smoke or will not quit smoking, but that would be very disrespectful to them and their freedom of choice and freedom to choose and live the lifestyle they want.

ronsmith and newsie: I made no threats on my post. Newsie asked " how private can a business be if it invites the public in" I thought it was useless to argue the law with her, so I proposed how she could find out personally. I don't consider that a threat, but if it came across that way, I apologize.

Wow, Rbow, I thought this was the place for lively debate on serious issues. Did I miss something? Are we reduced to threats? If I thought your apology had an ounce of sincerety, I would accept it. If I thought your intention was to continue this debate civily at Town Royal, I'd even buy the beer. However, I have no desire to walk into any business where a patron things I need to "learn a lesson."
