Emporia Zoo cases are completed

Monday, October 27, 2008

One boy remains in the custody of the Juvenile Justice Authority and two others face long-term probation and work service for their roles in an incident on June 22 at the David Traylor Zoo of Emporia.

The boys — Angel Ray Rodriguez Jr., 14; Andrew Vincent Rodriguez, 11; and Hernan Hernandez, 11 — were accused of four felony counts of cruelty to animals and one count of criminal trespassing.

Two black swans and two cereopsis geese were killed in the incident, which also resulted in damage to plants and flower pots at the zoo.

In court on Thursday, Andrew Rodriguez was remanded to JJA, with authority to place him out-of-home in foster care or other authority.

He was given 50 hours of community work service and must pay court-related fees and restitution.

Also on Thursday, Hernan was sentenced to 50 hours of community service work, 24 months of JISP, and also will wear a monitoring device, among other terms of probation.

Andrew’s brother, Angel Ray Rodriguez Jr., was sentenced on Oct. 2. He was to remain in JJA not more than 30 days, then be placed at home under Juvenile Intensive Supervised Probation for 24 months.

He will wear a monitoring device, complete community service work, and his parents will attend parenting classes, among other terms of probation.

The boys “jointly and severally” will pay $2,477.25 in restitution for their crimes, including purchasing and shipping birds to replace the ones they killed. The repayment terms require each to pay one-third of the restitution; however, if anyone fails to pay his share, the other boy or boys will be responsible for paying that unpaid share.

I wonder how these boys will manage to pay $2,477.25?
Going to have to shovel a lot of sidewalks this winter and maybe mow a few lawns next spring to make that kind of money. I only hope the parents dont take it upon themselves to make the payment, the boys should be held accountable and They should have to work off the debt. I hope they learned a lesson. time will tell I suppose.

" if anyone fails to pay his share, the other boy or boys will be responsible for paying that unpaid share."

This is by far the best plan for restitution I've ever heard about. See what it does? Peer pressure. It works just as well for something as it does against.

I think our court system did a good job of dealing with these boys. I'm sure they will think twice before ever doing something like this again. Better to get them under control now then wait till they go to the "big house" later.
