Shooting victim’s condition upgraded

A man shot Wednesday night during a domestic disturbance has been upgraded from critical to serious condition, according to Maria Loving, spokesperson for Via Christi St. Francis hospital in Wichita.
William Michael Calvert was taken by air ambulance from Newman Regional Health to St. Francis after he received a gunshot wound during the altercation at 2507 Lincoln St., the home of Calvert’s mother, Denise Calvert. The shooting occurred about 8:45 p.m. Wednesday.
Dwight Lee Swafford, 55, who also lives at 2507 Lincoln St., remains in the Lyon County Jail on suspicion of attempted second-degree murder. Lyon County Attorney Marc Goodman will decide whether formal charges will be filed in district court.
Emporia Police Chief Gary Smith said this morning that he can release no further information on the case.
“The county attorney has basically sealed everything,” Smith said.
Goodman was not available for comment before press time.

I am anxious to see what Calvert will be charged with. Everyone should have the legal right to protect themselves in their own home. It looks like to me the wrong person is in jail.

I'm with you, jeri. If that hoodlum had broken into my house and begun wailing on me or a member of my family, he wouldn't be recuperating in a hospital, he would be decomposing in a bag.

"Kansas removes the duty to retreat from its use of force statutes and adds a general statement that a person not engaged in illegal activity who is attacked in a place where he has a right to be has no duty to retreat and has the right to stand his ground and meet force with force."

I agree with all three of you.
I have known Mr. Swafford for 15 years, some of those were working daily, side-by-side with him. I cannot believe how he is the one that is sitting in jail right now just for protecting himself, his friend, and their property. For him to be treated as the criminal here is obsurd. I understand there are certain legal procedures that must be followed, but I don't think he should be the one under arrest. I would've shot the dead-beat drug addict kid too if he had broken into my house, threatened, and beat me.
