Jury convicts Lank of aggravated burglary

Wednesday, February 27, 2008

A jury on Tuesday afternoon convicted Joshua Ryan Lank of aggravated burglary in conjunction with an incident in Americus last fall.

Ryan was arrested on Nov. 5, 2007, after breaking into a home that was occupied at the time by a man, a woman, and their three sons.

The man held Lank at bay with a gun until Lyon County Sheriff’s deputies arrived.

Lank’s trial began Monday in the courtroom of District Court Judge Jeffry J. Larson.

Lyon County First Assistant District Attorney Rick Buck said that the jury received the case shortly after 10 a.m. on Tuesday. The panel went to lunch and also requested that court officers set up a video for them to review before coming back with a verdict. Buck estimated the jury deliberated a total of 2½ hours.

Lank took the stand to testify in his own defense, Buck said.

Sentencing will be at 10 a.m. April 10. Buck said that a final pre-sentence investigation will be used to help determine Lank’s sentence.

Lank testified in his own defense? I wonder what he could have possibly said to defend himself for breaking into someone's home?
