An Emporia man faces 12 counts of computer crimes after being charged in Lyon County District Court with developing a scheme to obtain and use gift cards at JCPenney.
Each of the counts states that Cesar Cabrera feloniously used “a computer, computer system, computer network or other property ... for the purpose of devising or executing a scheme or artifice with the intent to defraud, or for the purpose of obtaining money, property, services or other thing of value by means of false or fraudulent pretense or representation.”
Cabrera also faces two counts of theft involving two or more transactions.
An affidavit filed in the case by Emporia Police Officer Jeffrey C. Illk states that Christine Cross, manager of the Emporia JCPenney, reported that Cabrera “used the JCPenney system to put refunds on gift cards and that some of the gift cards were used.”
Cross told Illk that she was alerted to the discrepancies as gift cards were used in combination with Cabrera’s employee discount when making purchases. She believed that 10 acts of theft had occurred over a 4-day period.
“Cross stated a transaction number was used to create a refund that was then used to purchase a gift card,” the affidavit said. “It is unknown if any refunds went to any customers. Cross stated Cabrera would then purchase different gift cards with the gift cards that were purchased with a false refund.
Some of the gift cards were used in Emporia and some at the JCPenney store in Topeka.

Its sad to see that this individual would be so stupid to due such a thing and then to think he would not get caugth I guarantee you that this individual did not even give it a second thought as to not following through with such a stupid act now he sits in jail and awaits his fate and looses his job too what an idiot.
