Lyon County Attorney Marc Goodman filed an aggravated battery charge Monday against Dwight L. Swafford.

Earlier Monday, a charge of intentional second-degree murder had been dismissed in Lyon County District Court, where jury selection in Swafford's trial was set to begin at 9 a.m.

Why haven't any charges been filed against the person he was defending his home against. Shouldn't the same charges be filed against him or at least burglary or something?

What exactly does Goodman have against Swafford is what I would like to know.

File more charges against the man defending his home and friend, but leave the person who admitted to going there "looking for a fight" completely alone? Does Goodman have nothing better to do around the Holidays?

It seems as if Goodman is just throwing whatever he can at Swafford and hoping something will stick.
Does anyone know if anything was done to the actual criminal in this situation(the dude "looking for a fight")?

maybe theres more than meets the eye here. What part does the mother play in this whole thing? I agree that goodman is just throwing anything at this guy hoping to make a case. What charges will the other guy face? We havent heard anything about his charges in this!

Wow. Was there a provision in the new smoking ban that also banned defending one's life and property in Emporia? I hope terrorists never launch an attack in Emporia. It appears citizens could get prosecuted for fighting back.

Geez. Leave the poor man alone. He did what he had to do in a threatening situation. The people who run this city apparently forgot who they work for.

As I said yesterday. Good God! Is this for real! And I'll repeat my statement about "If this is how our local law enforcement works then I"M SCARED". I think it's time to oust Mark Goodman. He clearly has his own agenda.

Or perhaps he just didn't want to look like a fool after filing murder charges without enough evidence to make it stick. Now he's trying to "save face".

Agg. Battery carries the same penalty as the lower level homicide charges do and is easier to prove. Agg.Battery means you used a weapon to strike someone, which he did. But I still think when the case is tried before a jury, he will walk out a free man, I certainly wouldn't be able to convict him.
