Smoking ban passes

Emporia has a smoking ban.
On a 3-2 voice vote, Emporia city commissioners passed a proposed smoking ban with a few amendments, that are outlined below.
Voting in favor were Jim Kessler, Bobbie Agler and Julie Johnson. Jeff Longbine and Kevin Nelson opposed the ban, both saying they would support it if it included exemptions for restaurants and bars.
Both said the ban put undue hardship on small business owners. And, Longbine noted, many of Emporia's downtown bars and restaurants are geographically constrained from adding outdoor smoking areas. Most have no space in which to expand.
3:20 p.m.
During his comments, attorney Mike Helbert raised the issue of whether Commissioners Jim Kessler and Bobbie Agler had conflicts of interest because of their relationships with Steve Sauder, whose wife is one of the organizers of Clean Air Emporia, which drafted the proposed ordinance.
Commissioner Jeff Longbine, however, disagreed.
"It's not unusual for this board to have relationships with people on both sides of the issue," he said, before disclosing his own relationships. "Mr. Sauder and I played golf together, and Mr. Helbert lives across the street from me. Both are customers of mine."
In the end, he said, "I have no question about the interests or character of my two fellow commissioners."
3:10 p.m.
Stephen Cole, owner of Coles at 707 Commercial St., told commissioners he was concerned about the excessive response planned to reported violations. City Manager Matt Zimmerman also told commissioners that the process under the ordinance is that citizens can call 911 to report illegal smoking, then fire and police units would be dispatched to respond.
"This is very excessive for a very small thing," Cole said, noting that a violation would be a misdemeanor.
Only local attorney Mike Helbert spoke against the ban as a whole.
"This is a opportunity to impose the will of the majority on the will of the minority because you can," he said.
Two opponents of the ban — Steve Corbin of Town Royal and Matt Slater of Josie's — said they saw the writing on the wall and knew commissioners would vote today.
Slater, however, noted that the 10-foot rule hurt his business when there was a line of customers waiting to enter. He would, he said, have to tell the first eight people they couldn't smoke while waiting when others farther back in the line could.
Corbin, meanwhile, urged the commissioners to get the issue over with.
"However you vote," he said, "there's going to be a petition to bring this to a referendum.
"Vote on it today," Corbin said.
2:55 p.m.
The public is now being allowed to comment with 5-minute time limits.
2:50 p.m.
In a move Commissioner Kevin Nelson calls "unfair play," Commissioner Julie Johnson moved to amend the ordinance to implement it in 90 days — March 3, 2009 — rather than 6 months of June 3, 2009. Commissioner Jim Kessler seconded the motion.
The amendment carried 3-2 with Nelson and Commissioner Jeff Longbine approving the change. Longbine noted that state liquor laws require fences around outdoor drinking areas like patios. That, he said, might be difficult for business owners to accomplish during the winter months when it's difficult to set fence posts.
The short time frame for construction projects was key to Nelson's disapproval, also.
"I don't understand why businesses have to be punished," he said about shortening the implementation time frame.
2:40 p.m.
An amendment proposed by Commissioner Julie Johnson passes unanimously. It amends the punishment section to charge any person found in violation of the ordinance to be charged through municipal court of a misdemeanor with a fine up to $50.
So far, no comments have been taken from the audience, and there is no item on today's agenda that would allow for public comment.
2:35 p.m.
An hour into their meeting, commissioners begin discussion.
Commissioner Jeff Longbine began discussion by questioning the penalty structure. Mayor Bobbie Agler stopped discussion, questioning whether a motion needed to be on the floor before discussion could continue.
Discussion continues without a motion.

Yeah Emporia!!!! Way to catch up to the times! I will be so glad when all the restaurants in town are smoke-free, so I will not have to worry about exposing my children to smoke during our meals. That has kept us from going to a few places in town that we truly enjoy eating at, but won't take the kids to because of the smoke.

You people that are cheering for the passing of the smoking ban actually amaze me!! I wonder how many of you own a small business of your own, very few if any I am sure. I just can't believe that in "The land of the free" (so we thought) that you could cheer for something like this. This ban is like telling someone what they can and cannot do in their own home. I know you don't see it this way but think of it like this; These people pay property tax on a property they bought with their hard earned money and now you are telling them how they have to live and act in and on their own property! I am having a hard time grasping that thought. Smoking cigarettes, cigars, and other tobacco products is completely legal last time I checked so if you don't want to breathe these things THEN STAY HOME OR GO SOMEWHERE THAT OFFERS WHAT YOU ARE LOOKING FOR. Don't force this issue on everyone else. I am not a smoker but I do believe in the right to make your own choices as long as it remains within the realm of the law which obviously smoking does.

First of all I would like to say that I am happy that thing is finally over with. I was for the ban, so I am also happy that it passed.
However, there have been a lot of people on here who have opposed the ban from day one and have formed there own groups and proposed changes. I commend them for excercising their rights, letting their thoughts be known, and for fighting for what they believe in.
While some believe that this issue draws a line in the sand, I think it has caused more people to become involved in what happens in this town and that can only be a benefit to the community.
So no matter what side you were on today or will be on in the future, I want to thank you for the input you provided to this issue and I can only hope that you keep being involved in future issues.

Wait, what? 911 is for 'emergency' use. A $75,000 fire truck 'and' a $20,000 police car (excluding the human and mechanical equipment required to compliment these machines) for someone smoking in a bar or restaurant? The fine to cover that expense will be....? Who is going to respond to a 'real' emergency while these professionals are chasing smokeers? Hire more people you say? And pay them with what?

You go to bars to drink
If you want to smoke at either place, excuse yourself for the 30 seconds that it takes to suck down one of these cancer sticks and then come back inside.
If it's too cold wear a coat
What would be sad is if there was a smoking bar, that sold nothing but cigarettes and that was all you could do in the bar and they banned it, but that isn't the case so I think people should be greatful for this being passed!

people don't want to go to the blind for they are only a 3.2 bar and close at midnight.. nice try.. I really was hoping that the city commisioners would work harder on this issue instead of jumping in the boat.. I can not even vote on this issue for I do not live in the city.. I have never understood why the city chooses all these laws and the county has no say about anything but, I would think the fair way to take care of this matter would be: If you are a bar that serves food, and as long as you are serving food, your bar should be Non_Smoking, If you are only a Bar with no food served, then you should have the choice of smokin or Not.. This way family could have the right to go to non-smoking and besides, you don't need to take minors into a bar anyway.. Thanks, commisioners for ruining more businesses in Emporia, KS . I don't smoke but do go to bars to be with friends and have fun. Get a life..or stay home. For the commisioners that voted for it...Maybe we will shop else where now!!

What a historically sad day for Emporia. This won't affect me much. I never to to bars and rarely go to local restaurants, but it will have an enormous negative impact on bar owners, Emporia's image, and our overall economy. The three individuals masquerading as city leaders sworn to serve us should be deeply ashamed for allowing this small group of malcontents to control their thoughts... and their votes.
What else should we expect? Emporia is what it is: cliquish, out of touch, and poorly governed.
Anyone who supported this ban or, worse yet, voted for it, should be very ashamed and held accountable in the future as the adverse effects of their stupid decision become evident.

The cash flow from all the speeding tickets along the turnpike work zone is soon to dry up. Now the new cash cow will be the tickets given to ADULTS in ADULT places trying to relax and have a beer and a smoke after work. Kids aren't allowed so tell me why I can't enjoy that legally? It should be the business owner's choice to be smoke free or not. Government makes to many decisions for me now. I don't want them making more, it's just the start. Soon they'll be helping you make more of your personal choices. Just you wait, now they've got the ball rolling. Do we have a democracy here or something else? Who do these council members represent? Was your opinion taken into consideration? When in Rome, do what the Romans' do and look what happened to them. Some people are meant to be conformist and some are not. But I'll still fight for my rights, my choices even though I don't smoke.

Smoking is a bad habit, but this manufactured outrage over second hand smoke is ridiculous. Sounds like people are cherry picking their health concerns to me.

Well, I can't say that I am surprised. It's too bad. A handful of places wanted to do business with smokers and cater to that niche market of clientele. However, now they are told they must do business a different way.
I don't live there, but do own property there. Already have a good CPA (not there), but I know who won't be getting the call for my next heat/ac repair needs.

You all need to grow up. There are several towns in KS that are smoke-free in bars and restraunts that are doing quite well, one being Lawrence. I think ya all are crying because you don't want to admitt defeat over most don't like second hand smoke. Say what you will but it is proven even sitting in a non smoke sect and smokers are still in the building I am still getting the second hand smoke which is just as dangerous because it is unfiltered. Why do I have to risk getting cancer from those who don't care if they smoke. I have made the choice to not to why do my rights have to be impeded??? Rights are a two way street. Grow-up and focus on how to get jobs in and improving our schools

In the past, say in Lawrence KellyG, 2 bars were side by side. One smoking, one nonsmoking. I'd bet you the smoking one would be busier. therefore the nonsmoking bar says "hey, everybar needs to be nonsmoking", because they don't like the FACT that smoking bars are more popular than nonsmoking.

For places that worry for lost of business I was in KC this past weekend they have a smoking ban and I couldnt find a empty bar or a place eat in the area I was in. They were jam packed !

Ludicrous! I pray that none of my family or friends is truly in need of emergency services in this town! Apparently a heart attack or stroke victim's call will be considered equal in need to a smoker protesting this ridiculous plan and breaking the law just to prove a point. I am a non-smoker and I would love to sign a petition to change this decision. Using our already overworked emergency system to monitor smokers is the worst idea I have ever heard!

We are actually way BEHIND on the times when it comes to smoking bans, they have passed all over this nation and state, if you want stats on this I'll gladly link but I can promise you once again, you are very wrong. And this list is old and does not include many recent changes that occurred this fall, but yeah, we are definitely out of touch and cliquish lol!
On a side note I really do hope this does come to a vote so that it can but put to bed properly, having a commission vote on this is not solid enough in my mind.

I know that the smoking crowd is mad about the vote tonight, but those three commissioners that voted "yes" did you a favor in my opinion. Stay with me here... If the majority votes no, EDA then pushes its membership for a referendum. In that instance, their base is the one that is motivated to come out and vote. By voting yes, the pro-smoking crowd signs their base up to vote in an effort to overturn the ban while the other side says "didn't we already vote on that?" Just from a strategic voter energy standpoint, this is the outcome you should have hoped for.
That being said, we still need to find a compromise, and by that I mean a resolution equally despised by both sides where no one gets everything they want. I empathize with bar owners worried about their cash flow in this economy, but I know it's hard to get two sides to come together when you aren't using the same values to reach a conclusion.
Just remember that our founders tied rights to responsibilities, and a government of, for and by the people means the government is us (not some innocuous third party existing outside our space and time making rules and taking taxes). This referendum COULD be a case of responsible democracy in action IF we can all act respectfully and responsibly. I have now officially reached my quota of defending city officials for 2008. See you in 2009.

Nice list. Most of the cities have reasonable limitations to the law, and many others claim they had REJECTED efforts to ban smoking. Glad you pointed that out. Why did Emporia vote for a blanket ban? Isn't that what it is?
I don't even smoke, and I think this is stupid.
If we can have Sports Bars, Motorhead Bars, Cozy Bars, Artsy Bars, and Gay Bars, then why not Smoking Bars, Non-Smoking Bars, Bars with Naked Dancers, Bars with Pool Tables, Bars with Darts. Heck, I'd be alright with a Cozy Motorhead Art Bar with Naked Darts and Smoking Pool Tables. Isn't it kind of in the spirit of American Freedom be able to create a business and carve it out the way you want, and to serve the people you want to serve? It's not the City of Emporia's job to refuse service to anyone. That is the sole responsibility of the business owner.

I recently packed my bags and am in the process of moving away from Emporia. My family is still living there. It makes me sad to know that the city is reducing itself to making decisions for business owners around the city. It's horrible to know that the commissioners could vote on this even regarding all of the relationships within the system. I guess if I had a few commissioners in my back pocket and my wife was running a campaign on an issue....why wouldn't I do some subtle hint dropping to get my way?

I already signed a petition before they voted. The rules behind this ban is ridiculous. How are the downtown bars going to add an outdoor patio so they can still have the business of the smoking customers? I guess they could go out in the middle of commercial or 6th Ave. and litter their butts up and down the street while dodging traffic. Or maybe close off the alleys behind their business to make a patio? Thank god I'm moving away. I don't want EMS making a run on a renegade smoker while someone I know is having a health emergency.

I want to give a big pat on the back to Steve and Matt, if I didn't travel I would have joined the fight. Emporia is my home lived her all my life and I know most the people involved. OOPS! ALL! I am glad that Zippy will be able to stay in Despo's longer can I call 911 now because putting him in a car after his has been able to stay longer will make me feel safer on the road. Drunk driver killing someone is safer than the chance of you dying from second hand smoke. Question we didn't have all these rules and regulations before and my dad smoked 3 packs a day and I don't have cancer!??? Some of you people really shock me. No one can say what will happen, and I know a lot of college students that are still going to go to the bars and blow all their money no matter if they can smoke there or not. I also know quite a few that will travel to Lawrence on the weekends to see other friends because they can go out to the bars and enjoy a great time without having to smell like smoke when they get home. And personally I know quite a few people that smoke just because others around them and I am sure some of them will be happy to see this because they won't have to be social smokers anymore. Their choice yes. But a public place is a public place. And if you want to keep your business then make your service great. Isn't that what makes a person choose to go there in the first place.
Haven't you business owners learned this? I hope this proves everyone wrong and businesses see more people coming in and enjoying each bar or restaurants atmosphere!

I hope more people start coming in too, but I don't see it happening and I will tell you why. I don't see it happening because I have been working in a bar for over 5 years, and have owned my own for 2 1/2. I like to think I have a decent feel of what customers want and what they don't. However, if you have more experience than that in the bar industry, by all means speak your mind. Otherwise save your breath for something you know something about. By the way, I like to think our service is pretty darn good.

In my garage I have invented a smoking machine. I don't smoke but I like second hand smoke. I wonder if machines are banned from smoking in Emporia businesses also, or are people the only banned smoke generators. Emporia and the other cities that GOB listed might provide a ready market for my new device. It can be adjusted to just leave a trace of smoke in the air or really smoke it up. Frankly, I like a heavy haze but not eye watering. It makes for a very nice working atmosphere in my garage.

To call 911 for any purpose other than to report an emergency could result in criminal penalties. Each state has different penalties for 911 misuse, but in most cases, abuse can lead to jail time and stiff fines.

Longbine is still questionable in my view....he had no right to vouch for kessler and agler and their association with the Sauder family......This should have been a no vote.....I can say that I will not be using Modern Air ever again anyway....any time I've had them come out they say I need a new unit....justaflushaway is right, but I don't think that they ignore people....they just can't see them with their noses high up in the air.....

I am pretty sure they probably have loyal customers just like every business in town that will keep coming back no matter what the decision on the smoking ban was.
If people use this as an excuse not to use certain businesses, then they are hurting the economy more then this smoking ban really should.
Pretty soon just watch I bet the CDC gets on the National government and smoking in public places will be out everywhere in the Land of the Free. Give it time! Atleast we will be ahead of that and already used to it so it won't affect us later!

The British Isles went non-smoking, and all the nicer bars were able to make and still make good money, The little bars on the corner who lived for the daily drinkers/smokers closed. The liquor store business boomed though because so many people choose to stay home to drink and smoke. I guess DUIs will go down.
Smokers...just think that the city has helped you in your quest to stop smoking!
Personally I will go out more now. I hate smoke, makes me sick, hate the smell...so maybe there will be others like me who will keep many of these small businesses open, and we will be the new regulars.

All of you for the ban make it seem like you walk out your front door and are just bombarded by cigarette smoke, that you go sit at the movie theatre and the person next to you offers you a Camel... that you're driving across town and someone pulls up next to you and flicks there cigarette butt into your car... I haven't had a single unpleasant outing in regards to smokers... and against I stress... I'm NOT a smoker.

This is by no means over! It is going to drag on through the spring as we try to get it on the April ballot for a city wide vote. More back-biting,name calling and hard feelings. The legal requirements for a petition are many and EOB is working to get one approved for circulation. Only city residents will be able to sign the petition and vote on this come April. We'll see you at the voting booth.
And for the posters who list all those other cities that have denied their citizens their right of choice and think we should to, Emporia is not a town full of Lemmings jumping off a cliff just because the first one did.

I don't even know where to start... this is insane... calling 911 to report someone smoking! WTF!?!?
I am a smoker, and I would not have any problem with a ban IF IT WERE VOTED IN BY THE PUBLIC AS A WHOLE!! NOT BY FIVE PEOPLE (AND BARELY PASSING THERE) WHO OBVIOUSLY DIDN"T PAY ATTENTION AT THE HEARING WHERE A GOOD 80% OF THE PEOPLE THERE STOOD UP IN OPPOSITION TO THIS BAN!

I just think it needs to be revised..
I think the main one we are talking about here are the bars. If there is such a high demand for a non-smoking bar someone go build one so all of these people (most of whome wouldn't go to a bar anyway) have a place to go. The first bar that opens up just outside the city limits will make a killing off the smokers who want to go out and relax and enjoy thier ciggs how they want.

Also , there may be no conflict of interests between the parties involved. Why then did the city attorney,(who is on the board of EDA), cut off Mr. Helbert in mid-sentence at the meeting? I doubt that the radio station or the Gazette will make the concerns public but they should and let the public make their own judgments.

Hey Slater,
All is not lost. I like your bar. I like to hang out there with my non-smoking friends, as well as some other places in town. We have for years. Long before you even owned it. We often leave when it gets too smoky though, or don't go into a place at all if there's a smoke cloud hanging about. We go there to sociallize, not to get choked. If you're so worried about losing your smoking customers, realize you may gain many more that detest the trashy habit.
This goes for you too, Corbin. TR is a great place to hang out, but a piss-poor place to breathe.
And yes I enjoy The Blind too. It's so clean! Funny that it's called The Blind, I know it's name comes from the hunting decor, but it's often the only place in town that one can see from one end to the other without being blinded by the haze in the air.
See you at Josie's and Town Royal next April. It'll be fun to hang out at those places again!
