Two boys accused of breaking into the David Traylor Zoo of Emporia and killing two black swans and two cereopsis geese on June 22 will have hearings at 9 a.m. on Aug. 21 in the courtroom of Judge Lee Fowler.
Andrew Vincent Rodriguez, 11, and Angel Ray Rodriguez Jr., 13, appeared in succession Tuesday afternoon before Lyon County Magistrate Judge John Conklin.
The boys were brought in separately, both restrained by chains connected at the wrists and ankles.
Each sat quietly, heads slightly down, with their attorney, Don C. Krueger, who asked Conklin to set the next hearings for both on the same day. Angel Ray Rodriguez Jr., the second of the brothers to appear, mouthed “Hi, Mom” to his mother as he was led from the courtroom.
The proceedings took a total of approximately 15 minutes.
“The kids haven’t been in trouble before,” Krueger said of his clients after the appearances in Judge Conklin’s court.
“I would like to think this is an aberration.”
The brothers were to be returned to the custody of the Juvenile Justice Authority in separate cities out-of-town.
The case was continued for a third boy accused in the incident, Hernan Hernandez, 11.
Each of the three is charged with four counts of cruelty to animals, which includes intentionally killing, torturing, or maiming animals; one count of burglary on a building not used as a dwelling, a level-7 felony; and one count of criminal damage to property with loss less than $1,000. Four flower pots broken during the incident were valued at approximately $50, according to case records.

I'm wrong. Parents need to be more responsible about their kids. Judge should sentence both parents & kids w/therapy,counseling & community hrs.

Thats right.
The parents have abdicated their role in teaching these children respect for property and the lives of others. Probably bad role models.
How could they like to think this is aberrant behavior? Do they not know there own children?
Furthermore, it is obvious that these children have never been punished before when the parents needed to correct or punish them, probably thinking is was the school systems or the states job to teach them right from wrong.
I think their behavior was monstrous, not aberrant
It would be very interesting to see who raised these monsters in our community and to see what values they projected to their children.Perhaps better said who did not raise them or teach them values even if tough love was necessary.
If they had only damaged property I would not be so harsh but it was the killing that sets these monstrous children apart from the rest.

Go to YouTube and put Emporia in and you will see some crazy stuff and these kids are so dumb they are puting it online so everyone can see it !!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Bring back the paddles and belts and some real punishment. The sitting in the corner is not making it. Spare the rod , spoil the child !!!!!!!!!!!!!!!!!!!!!!

I 'd like to know why 2, 11 years olds and a 13 year old are running the streets after dark???? why aren't they at home??? I am the mother of 3. One is a 24 year old firefighter/EMTI and one is 23 and graduated with honors from ESU and is working full time and furthering her education and one is 13 and has never roamed the streets where he could get in trouble!... what is wrong with parents!!!! If you bring a child into this world be A PARENT, teach them respect, be home with them at night.. be a parent.. then be a working parent...but child rearing should come first.. unfortunately, to do both good is nearly impossible...These parents certainly do play a roll in these kids doing what they did.... To be able to kill a animal, (bird) without it bothering them is scary to this mom...All my kids love animals.. they couldn't do something so horrible.. A kid that can has problems...serious ones that better be dealt with now.. or We (Emporia) will just have 3 more gang members, or thieves , or murderers in our city...
