The owners of Menu Foods Midwest are the targets of a class-action lawsuit filed last week in Emporia by pet owners. The lawsuit alleges that the Menu companies sold contaminated pet food and continued to sell the pet food after the companies became aware of the contamination.
Emporia attorney Thomas A. Krueger has filed the lawsuit on behalf of pet owners against a variety of Menu pet foods holdings. Those companies are: Menu Foods Limited Partnership, organized under Ontario, Canada, law; Menu Foods Acquisition and Menu Foods Limited, business corporations organized under Ontario law; Menu Foods Holdings and Menu Foods Midwest Corp., Delaware corporations; and Menu Foods, a New Jersey corporation.
Krueger filed the complaint Thursday in Lyon County District Court on behalf of Tamara Temple of Otis, Kan., and McKay Perry of Dodge City on their own behalf “and on behalf of all similarly situated.”
The complaint states that “plaintiffs hereby demand a trial by jury of all issues so triable.”
The law suit alleges that the Menu companies sold contaminated pet food and that Menu continued to sell pet food it knew was contaminated and failed to recall that food.
The complaint identifies Temple as the owner of a female calico cat who ate “Special Kitty” brand cat food with gravy. The cat suffered kidney failure and was hospitalized for at least four days in March. The cat survived the poisoning, but will need “expensive special food and prescription medicine for the rest of her life,” the complaint alleges.
Perry is identified as the owner of a 3-year-old female cat who ate an unidentified cat food manufactured by Menu and was hospitalized for approximately three days in February of this year. The cat’s recovery was marginal and she was euthanized on March 20.
The complaint contains three counts alleging product liability, consumer fraud and consumer protection violations and breach of implied warranty.

I am sorry, but why not sue the US Government? After all, they are the ones who allowed the import of contaminated products to come to the United States?

I agree dave. Our government allowed the contaminated wheat to come into this country from China along with how many other contaminated products that are now being discovered that came from China. I thought we had a trade deficit with China but it seems like foreign policy and "good will" are what's calling the shots these days. Wasn't there enough wheat in the U.S.? For that matter, isn't there enough toothpaste made in the U.S.? I realize that some domestic products are more expensive to buy but in the long run what's really cheaper - made in China or made in the U.S.A. (if you can find anything made in the U.S.A.). I guess it's kind of like "Shop Emporia" - why should I buy local when I can go out of town to shop. Why should these companies buy U.S. goods when they can shop China, Hong Kong, etc. Is this trickle down economics that has finally even reached Emporia?

Good say dayjob. I agree with what you have written. I wish the government would wake up! The sad part, how many people will lose their jobs, insurance, homes, etc because of what has been done? This will be a true trickle down economics when it all hits home right here in Emporia. It is too bad that the attorneys can not see past the money they will get when and if this settles.We should think of the innocent people who might get hurt because of this. Is a lawsuit really necessary? Think of the tax money Emporia will lose if Menu closes it's doors, because people will not be able to afford to stay here without a job. After all our commissioners are all for wheeling and dealing to get company's to come here for tax breaks.

Sue the US Government? Did they contaminate the food? You would be suing yourself because the money has to come from somewhere! Sue to company that actually contaminated the food. Let the money come out of their pocket!

Realize, the US Government is the ones that allowed the wheat into our country!! You would rather see a company close and people from here lose their insurance and jobs because of this stupid lawsuit. Of course, no attorney in his right mind would even attempt to sue the government! Do not get your bowels in an uproar over this unless you are for people keeping their jobs and homes!!!!!!!!!!

Is this one of the companies that come into our fair city that got tax breaks for building here? I was just wondering why you would be supporting them when you obviously don't want any more companies comming in here that get tax breaks.
