A man already accused of multiple charges involving sex crimes against underaged victims appeared in court Thursday to face additional charges in new cases.

Raul Manuel Magallanez Jr., 32, made his first apperance in Lyon County District Court on the charges. He is accused in two separate cases of crimes against victims older than 14 but younger than 16.

The first case involves seven counts of rape or an alternative charge of aggravated indecent liberties with a child, 10 counts of furnishing alcohol to a minor for illicit purposes, with intent to encourage a child to commit a crime.

The rape counts’ wording alleges that the victims were “incapable of giving consent because of the effect of an alcoholic liquor, narcotic, drug, or other substance and their condition was known by, or reasonably apparent to, the defendant.”

Each of the rape counts carried an alternative charge of indecent liberties with a child (sexual intercourse). The crimes allegedly were committed between Oct. 1, 2005, and Dec. 30, 2005.

The second case accuses Magallanez of three counts of rape, one count of aggravated indecent liberties with a child, three counts of sexual exploitation, one count of indecent solicitation, and four counts of furnishing alcohol.

Bond set in each case was $100,000.

Magallanez’s next court appearance will be from 1 to 5 p.m. before Judge Lee Fowler.

And my kids think I'm mean because I won't let them hang out with people who are more than a couple years older than them or stay out past 8pm or that I want to know where they are ALL the time and WHO'S going to be there and I want to meet the parents of their friends - THIS is exactly WHY - preverts like this guy.

This isn't the only time this sick pervert has had problems with the law, or children. I think he should have been sent to prison years ago. However, since it didn't happen then, i hope it happens now. He will never reform, and prison is too good for the lives he has destroyed, and the girls' whose dreams have been shattered.

You know, it is people like this that made me move away from my hometown. I have a young daughter myself. I didn't want her to be subjected to the filth and horror of perverts like this man. If Emporia were smart, they would work harder at making the community a safe and wonderful place for families, as it once was. But you know, the minute that they started letting illegals in, was the minute that the town went to trash. Illegals are taking our money, our jobs, our home, they are raping our children, trashing our once beautiful parks and memorials, all that Emporia stood for. Sickening I tell you, just sickening.

Deductive reasoning at its worst. You can't blame all "illegals" for the repulsive behavior of one. Besides, I don't believe the defendant is an illegal. Unfortunately, sexual predators live all over this country, not just in Emporia. We get the news about it practically everyday. You can't move away from it. This case seems to have put a stain on our city, and I can only hope that the jury and the county attorney can bring justice to the victims of these heinous crimes and to the people of Lyon County.

I understand the topic of this article itself and if you would stop focusing on me being a racist, which I am not, you'd see I was responding to hogan's comment about getting perverts like this man off the street. Her point was this is ONE sick pervert, but there are MANY out there.

I just wanted to applaud you for doing what you need to do as a parent even if your child is not happy with you for it now. My parents were the same way and it irritated me beyond belief, but looking back (hindsight is 20/20) they probably saved me from making huge mistakes or getting involved in situations I was not ready to handle. In today's society I can't imagine parents now being even more paranoid. Parents don't always get much credit at the time, but one day your child will probably thank you for it.

Unfortunately, in our community and all other communities, predators exist. The number of victims of sexual and domestic violence nationwide, as well as in our county, is staggering. When we begin to hold perpetrators accountable for their actions, be it crimes against children or adults, we will see a decline. Too often, if the victim is not a child, we find fault with the victim's actions rather than with the perpetrator. It's easier to say that a person must have done something wrong to "instigate" the action forced upon them than to say that a perpetrator is accountable. I am glad to see that in this forum everyone is in agreement that it is the perpetrator in this case who should be held responsible.

It is through societal change that we will see a decline in violence against men, women, and children in our community. Unfortunately putting this one person in prison is not going to make our community safe. It is a start, but persons who perpetuate violence against others start with much less brazen behaviors. When we decide that those so-called, minor offenses are not OK either, perhaps we will see a change in our community.

I never said that I took the easy way out. I never claimed anything in my statement that comes close to racism. I never said Hispanics, African Americans, Caucasians, or anyone else. I was simply talking about those who are too lazy to come in to America and follow proper procedures. And I mean this by any person who is coming into this country and not applying for citizenship, but is more than happy to work in place of someone else who needs the job just as badly. I also never said that Magallanez was an illegal, I know he isn't. I went to school with one of his siblings from grade school on, so I know better than that. Do not judge me so quickly, you do not know me at all.

I also never said that we do not have predators or crime where I am now. It is just more easily controlled here due to the small population, and wonderful police and sheriff department we have. I consider myself incredibly lucky. I can leave my door unlocked at night, and not over concern myself about someone breaking in and raping me and my daughter, or stealing all we own. I do not have to concern myself over seeing gang graffiti plastered all over the walls of our monuments. I don't worry about finding disgusting used condoms on the grass of our local park. I am not saying I live in a perfect community. At one point, we had a high rate of Meth Labs on local farms around us. We have had break ins, and we have also had one or two children sodomized in the past. But, thanks to local citizens who were not afraid to stand up and speak out, we have controlled these issues. And we will continue to do so, as they arise.

If anything, Emporia needs more people who are willing to stand up for what is right. Emporia needs people who are willing to roll up their sleeves, clean things up, do more for the younger generations who will someday be the ones in charge. How many times will you have to wash off spray paint? Probably hundreds. How many times are you going to have to pick up their nasty trash they leave behind? Again, hundreds. How often should you report crimes instead of sticking your head in the sand? As often as you see them. How many times are our daughters going to have to stand in front of a jury to speak of the awful things that happened to them? Unfortunately, unless we watch our children more closely, it will happen more than we like. Is all that hard work worth it? Yes, I believe so. Had it not been for my husband getting a job with law enforcement in our small community, I would be one of the first ones there to clean up the town I still love so much.

I am glad that Magallanez was found guilty, just one more pervert off the streets. I commend those girls for speaking up.

I, too, remember the Bird Trial, as well as the boy who beat his girlfriend to death (Swain I believe is the name here), and the boys who beat to death the other young boy (there was a Pendlay and a few others here). I was around for all of that, and in some cases knew victims, victims families, and the accused as well. I also remember the day a man walked into a church and shot his gun. A classmate attended that church and happened to be there the day that happened. I know, none of these cases involved anyone who was not an American.
I never meant that illegals were the only ones behind the increase in crime. I also never meant that Emporia let them in.. I understand there is a demand for jobs, they were looking anywhere and everywhere they could. But I had noticed a trend, once more were illegals migrated into Emporia, is when things started to go downhill. SOME brought with them the need to defend themselves, or to prove that they were beyond anything we could ever stop. This brought on gangs, packs of people wishing to do just that. With the gangs came more problems, like the ones I had spoke of... rapes, murders, more drugs, violence, and yes, destroying the things that we hold dear to us, such as our homes, monuments, parks, and buildings. I know for a fact that not all gangs have illegals in them, it just seems that there is some sort of a connection here. And yes, I could be very wrong. I just had to state my opinion on here.
