A man accused of attempting to rob the Ayan Restaurant on Jan. 9 waived his right to a preliminary hearing Thursday afternoon in Lyon County District Court.
Clinton D. Peck, 18, is charged with two counts of attempted aggravated robbery and one count of conspiracy to commit aggravated robbery.
Peck is accused of entering the restaurant with two other men early on the morning of Jan. 9. He allegedly was wearing a ski mask and was armed with a rifle. He allegedly demanded money from a restaurant employee and, in a separate incident, demanded money from another restaurant employee who entered that area of the restaurant. Both men said that Peck struck them with the rifle.
Peck is living with his parents and wearing an ankle monitor. He requested to be allowed additional freedom of movement to accommodate his employment. Judge Lee Fowler agreed to include Peck’s place of employment in his perimeters, and stipulated that Peck’s ankle bracelet would need to have a Global Positioning System function.
“That way he can work, but I’m sure he’s actually going to work and (is) there,” Fowler said.
Fowler set Peck’s pre-trial conference for April 27.
