Please do not take this the wrong way, but I do not see where the Gazettes news story on this has accused anyone of anything ! The Attorney General is the one making the accusations, the Gazette is just reporting a news worthy story !
Do you not believe that the possible theft of $158,000.00 of taxpayer money needs to be look into, no matter who allegedly took it ? I agree with some, that if you are going to attempt to start a business, especially when government & taxpayer funds are involved, you had better have good bookkeeping skills, or hire a good accountant and have all you T's crossed and I's dotted and be able to document every expenditure, etc., its not only smart, but good business sense !
Again I am not pre-judging anyone !

Methusla, I am in total agreement with you and even though Vivian is my sister she does need to be held accountible for her actions. She does need to account for where this money went. We are are accoutable to God in the end and I believe that Vivian has done no wrong outside of not getting a book keeper to take care of things from the beginning. I have one because I run my business off a 1099 and I could not keep up with my paper work too many reciepts. My business is no where near as mind bogling aas Social Work is there is way too many things to account for. So I hope her lawyer and she are able to show that she is justified in her costs to keep this business going and her income from it.

I will keep my cap lock off this time. But just to let everyone know Vivian is a good person and all she wants to do is help others. That is why she has all of the people working with her, and we all know how hard she works. She is hard on people because she cares. She did not steal any money from no one, She is good with people NOT papers. I am not good with papers, But I love to help others with all my heart. Vivian has helped many, gave must of own time to helping others.
And the time frame does not add up at all, Cognitive Care Connecrion did not open until the end of 2007.

I agree with gen50. It is true vivian is very good at helping people with what they need done but she is not good at all with paper work. She did put in every one of those hours that are in question. The years that the att. gen is looking at vivian did not even have her own company up and running. She was contracting through other companies like, Three Rivers and Community works. And they were fully aware of what she was doing with the clients. And the money that is being talked about was not givien all at one time, This is over a period of several years. So to the person that made the comment about having their paycheck be 158,000.00 That would be nice and I think Vivian would agree also. If you added up your income for 3 to 4 years it would probably be a good amount of money.

some one from the other company is mad at Vivian, cause alot of the people went with her. To make a better company with people who really care for people with TBI and others who are needing help with life. There people need need help to learn how to live again and we that work with Vivian do care about the consumers that we work with.
Now because of this there are going to be more and more cuts to the program when people need us to help them. And believe me there are alot of them out there that need all the help they can get.
If some of these people that that work at Medicre/Medicaid would take time out of there 9 to 5 job and spend time with these people with TBI, they would understand why it take more time then when what we can do. Again I have been on both sides of this. It takes time to get these people to trust you, before they will let you help them.
How to you reteach someone who don't know what they are doing? Some time you have to start at the beginning, some with never be right again. Some will never walk again, all we can do is help them as much as we can and IT TAKE ALOT OF TIME.(I am not yelling) just want everyone that it is not easy.
YY4U sould know how things work with Medicare /Medicaid after fifteen computer don't make mistakes, right?

And I'm just saying that if she indeed has an attorney, I hope he is arranging for an audit of his own; any attorney worth his salt would do that.

If this woman is that bad at record keeping, and she is willing to admit it, then she should certainly either HIRE someone to keep them, let a local bookkeeping service handle them, or better yet, stay out of business period. Do you honestly think the IRS would accept "I'm not very good at doing books" as an excuse?
Speaking of the IRS, surely her tax returns will be subpoenaed as well. Just as surely, that government agency will get involved as well.
$158,000 is a lot of biscuits and gravy, and the people of Kansas deserve to know where the breakfast went. There are too many unanswered questions. I support the County Attorney in prosecuting this.

Just to let you all know that are trying to put vivian away so quickly, she worked every bit of the time that she claimed. She never charged for time that she was not with someone working. She has helped so many people here and in topeka. And the years that they are looking at she was contracting through other companies like Three Rivers and Community Works. Vivian is no longer do that kind of work since she opened her own company, she hires theropist now. And all of the charges are paper errors, I know that not very many of you have ever worked in this field so you have no idea what the paper work is.. some of you do know. And when you think about 158,000 over a period of 3 or 4 yrs that is not that much money that they are investigating. But vivian did not take money that she did not work for.

There is a difference between actually working/logging hours and billing against the rules. There are limitations on payment despite hours spent. The burden of proof lies on the prosecution and they will either prove that Ms. Mundy billed for time she felt entitled to despite the regulations Medicaid has set up, or they will not. That is a hard thing to prove and for the sake of all of her very dear family, I sincerely hope that proof of intent to defraud does not exist and therefore cannot be found. For the sake of justice, this matter must go forward through the courts, however, and we will rally around Vivian and her family with prayers for God to grant strength to endure, peace to obtain and truth to prevail.

$158,000 divided by 4yrs = $39,500.
really05 can I have $39,500? I mean really, it's not that much money. That would double our entire household(of 4) income. I probably wouldn't notice but go ahead and give me that paltry sum and I'll let you know if I notice or not.

Clean out your hearts make it right before going after someone else. There is only ONE that can throw the first stone. If we start looking at everyone we will find something that we don't want the world to know. We will all have to answer in the End also. Take a good look around us, everthing is falling apart.

I'm pretty sure I never said anything bad about Vivian(who I actually know by the way). I do not believe as some apparently do that just because I know someone that automatically makes them innocent.
I just couldn't let a statement go that said that $39,500 isn't much money. Maybe to some it isn't but they are few and far between in these parts.
Ultimately the courts will decide and if she is innocent I'm sure the court will find her that way.

Shame on anyone who thinks that $39,500 is only a small amount of money. It is certainly higher than what a lot of families in our area make. I'm sure they would welcome making such a sum.

I remember when Vivian thought about starting her own company. I didn't know her prior to late 2006 or early 2007. AND she didn't have her own company then. It wasn't until months later that the business was created out of a need to have another option for people with TBI. How in the world can she be accused of running a business poorly for those years when the business wasn't in existence?!! That is like arresting a person for a crime that was committed before they were born!!
These charges are bogus just from a look at the time frame!!
I don't know if it is slander from the news report side or slander from the competing companies who don't like losing customers. Either way, it is SLANDER. The people who put it forth should be charged with defamation of character!!

I have some second-hand info that it is looking good for Vivian, but I don't wish to give away the defense her lawyer is building or some of the items he has found. I will leave that to her family's discretion to reveal.
I will say that I am told that the IRS has been very slow and uncooperative about providing the copies of all the papers they took that they are legally obligated to provide to her lawyer--ironic considering one of the charges they filed against Vivian.
I don't know when the court date is or if it has even been scheduled as of yet.

09/11/2009 State stops paying Vivian (Steavenson) Mundy (V.M.) /Cognitive Care Connection (CCC), and she doesn't clue anyone in. 10/01/2009 (Payday) - Payroll was held until V.M. was sure that there was money in the bank to cover it, paid this instance out of her personal funds. Refused to pay several employees stating "I know it is vindictive but…" because the client they were working for had decided to switch to another company due to being unhappy with his services from CCC. One employee after being told he would not receive his paycheck (during a phone call) threatened that he would come and get his check and it would not be pretty. We contacted VM about this threat, she laughed and said that we'd prolly better lock the doors and call the police. The disgruntled employee did show up and took us hostage in the office, refusing to move from in front of the locked door, being loud and verbally abusive, threatening, and doing things such as hitting the windows and punching them. There were 4 phone calls made to Topeka Police Department during all of this which lasted over an hour, TPD arrived, made the disgruntled employee leave the premises, and when the situation was explained, were aghast at the reason he was down there to begin with, stating that she {Vivian Mundy} had no right to hold his paycheck for any reason. The disgruntled employee left, and so did TPD.
Assistive services fund, meant to be used as emergency funding source for individuals on TBI/PD waivers as a last resort for certain things, was used regularly by VM as bargaining tool to recruit and keep consumers. VM would tell them, “Whatever you want, we can get it for you up to $7,500.00. If you want a computer, we will get you one. If you want a camera, we will get you one.”
It has also come to our attention that V.M. plans to leave the state of Kansas on 12/04/2009. This information was leaked to us thru a mutual friend, not given to us by V.M. herself. The friend said that V.M. does not want anyone to be aware that she is leaving.
